PUBLIC NOTICE
STATE OF NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION
The Division of Energy, Mineral, and Land Resources (DEMLR) invites public comment on, or objections to, the following individual
statewide NPDES Municipal Separate Storm Sewer System Permit to be revised and re-issued. The public comment period begins at
9:00 am on 03/15/2022 and ends at 5:00 pm on 04/14/2022. Persons wishing to comment on or object may submit written comments to
the address below during the public comment period. All comments received during the public comment period will be considered in
the final determinations regarding permit issuance. Public comments may result in changes to the proposed permitting actions. All
comments should reference the specific permit number NCS000250 for the North Carolina Department of Transportation, proposed
issuance date 05/02/2022. The Draft Permit may be viewed at: https://deq.nc.gov/about/divisions/energy-mineral-and-
landresources/stormwater/stormwater-program/stormwater-public. Please direct comments or questions to: Jeanette Powell,

This is to acknowledge receipt by the EPA Region 4.
R4NPDESPermits@epa.gov is a shared mailbox for states to submit NPDES permit packages to
EPA Region 4 and should only be used for that purpose.
We may provide written comments and recommendations or objections to a draft or proposed
final permit.
If we do not respond within the timeframes below, as per the current State/EPA Memorandum
of Agreement (MOA) (Section IV), then the State may issue the final permit.
However, if other parties raised significant concerns objecting to the draft or if the final permit
is significantly different than the draft the State needs to send a proposed permit to us for
review.
Timeframes for EPA review:
· Draft Individual Permit: the EPA has 30 calendar days to review it and may request 90
days for review
· Draft General Permit: the EPA has 90 calendar days to review it
· Proposed Permit: the EPA has 15 business days to review it and may request 90
calendar days to review it

consultation requests will only be accepted in the expedited format. We have successfully
conducted over 300 expedited informal consultations with almost 30 different Federal
agencies in the last 6 years. Expedited consultations are completed in 30-50% less time than
traditional informal consultations.
