A Settlement Agreement dated 1/8/04 was subsequently reached, which resulted in a permit modification dated 3/15/04 that changed the mercury limit compliance schedule from 1 / 1 /04 to 10/ 1 /04. Since the Settlement Agreement and Permit Modification ultimately activate all other requirements of the 2002 Final Permit, we are correcting the new permit effective date to 5/ 1 /04. By setting the effective date to the first day of a month, all monitoring frequency requirements and limits will remain constant for the month. This corrected effective date will also provide the necessary lead time for the permittee to schedule for additional monitoring requirements associated with the new permit. A new Permit Cover Sheet with the corrected permit effective date is attached. As previously indicated, this effluent limit may be deleted in the future, if the permittee provides updated effluent data that shows no reasonable potential to exceed applicable water quality standards. TN nutrient limit required by HB 515 is deferred until results of nutrient response modeling effort are completed. 6. Compliance shall be based on a quarterly average of weekly samples, with quarterly periods defined as January -March, AprilJune, July -September, and October -December. 7. Chronic Toxicity (Cetiodaphnia) at 90% with testing in January, April, July and October (see Special Condition A. (2)). 8. The quantitation limit for cyanide shall be 10 pg/L; levels reported below 10 µg/L shall be considered zero for compliance purposes. 9. The mercury limit will become effective 10/1 /2004. Effluent samples must be analyzed by an EPA -approved low level mercury analysis method. Grab samples will be allowed in conjunction with low-level mercury analysis. 10. Instream monitoring requirements are waived as long as facility retains membership in the UCPRBA. If membership is cancelled, facility will monitor 3/Week (June -September) and 1/Week (October -May). Stream sampling may be discontinued at such times as flow conditions in the receiving waters or extreme weather conditions will result in a substantial risk of injury or death to persons collecting samples. Upon such discontinuance, stream sampling shall be resumed at the first opportunity after the risk period has ceased. SETTLEMENT AGREEMENT N.C. DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES, Respondent. Respondent North Carolina Department of Environment and Natural Resources (the . Department or NC DENR), under authority duly delegated by the Environmental Management Commission, and Petitioner City of Greensboro (City) hereby enter into this Settlement Agreement in order to compromise and resolve, without adjudication, matters in controversy between them raised in these contested cases. A. The City owns two waste water treatment plants, the, North Buffalo Waste Water Treatment Plant located at 2199 White Street, Greensboro, Guilford County, North Carolina (the North Buffalo WWTP), and the T.Z. Osborne Waste Water Treatment Plant located at 2350 Huffine Mill Road, McLcansvillc, Guilford County, North Carolina (the Osborne WWTP). The City operates the North Buffalo WWTP pursuant to NPDES Permit NC 0024325 and it operates the Osborne WWTP pursuant to NPDES Permit NC0047384 (together, the Current Permits). B. During June and July 2000, the City submitted applications to the Department seeking renewal of the Current Permits. Under cover of two letters dated December 1 I, 2002, the Department issued to the City renewals of the two Current Permits (the Permit Renewals). The City riled Petitions for Contested Case Hearing challenging thePermitRenewals and, pending resolution ofthe parties' disputes, the City has continued to operate the North Buffalo WWTP and the Osborne W 4VTP pursuant to the Current Permits. The agency actions challenged in these consolidated contested cases are the decisions by the Department to include in the Permit Renewals certain obligations and restrictions with respect to mercury, including mercury concentration effluent limits and sampling and analytical requirements for mercury. NOW, IT IS THEREFORE AGREED AND CONSENTED BY THE PARTIES THAT: 1. Through this Settlement Agreement, the parties intend to and do hereby settle, compromise, and resolve with finality and without adjudication the parties' disputes concerning the agency actions described in Paragraphs A through C and the issues raised in the City's Petitions f Contested Case Hearing. 2. The Permit Renewals (as originally issued by the Department in December 2002) are hereby amended as provided in this Paragraph 2. (a) Permit Renewal for NPDS Permit NC 0024325: Section A(1), footnote 9 ofthe Permit Renewal is hereby deleted from the Permit Renewal and the following new footnote 9 is added to Section A(1) of the Permit Renewal: 'Me mercury limit will become effective October I, 2004. Effluent samples must be analyzed by an approved low level mercury analysis method. Grab samples will be allowed in conjunction with low level mercury analysis." Section A(2), footnote 9 of the Permit Renewal is hereby deleted from the Permit Renew and the following new footnote 9 is added to Section A(2) of the Permit Renewal: "The mercury limit will become effective October 1, 2004. Effluent samples must be analyzed by an approved low level mercury analysis method. Grab samples will be allowed in conjunction with low level mercury analysis." 3_ The City agrees to undertake weekly sampling of effluent for mercury pursuant to Permit Renewals (as amended by this Settlement Agreement) for a period of six months, beginning October 1, 2003 and ending March 31, 2004. The City represents that it began weekly sampling f mercury of effluent from both WWTPs beginning October 1, 2003. 4. Except as amended by this Settlement Agreement, the Permit Renewals are effectivq as of March 1, 2004-, and on and after that date, the City will operate the North Buffalo WWTP the Osborne WWTP (together, the: WWTPs) pursuant to the applicable Permit Renewals as amen in this Settlement Agreement. Promptly after the last weekly mercury analytical result is repo for both WWTPs pursuant to Paragraph 3, the Department will perform a reasonable We analysis for each 'WWTP separately to determine whether, based on the six months of mercury analytical data, there is a reasonable potential for a future violation of the mercury effluent limit (the Mercury Limit, i.e., the mercury effluent limit established in the Permit Renewals) at each WWTP (an RP Analysis). if the RP Analysis shows there may be a reasonable potential for a future violation of the Mercury Limit at a WWTP and if the City so requests, the Department agrees to perform a -3- 1 I WATER & LAND SECTION Fax:919-716-6766 Jan 7 '04 15:57 P.05 second RP Analysis taking into account any sample field blank corrections for that W1NTP in accordance with US EPA Method 1631, Revision E or later revision (the Second RP Analysis). Thereafter: (a) if the RP Analysis (or, if _ requested, the Second RP Analysis) shows ther is no reasonable potential for a future violation of the Mercury Limit at a WWTP, the Mercury 'limit in the Permit Renewal for that WWTP shall be deleted from the Permit Renewal and the monitoring frequency for mercury at that WWTP shall be amended to require quarterly monitoring; and, within a reasonable time after the RP Analysis (or, if requested, the Second RP Analysis), the Department shall issue a letter or other appropriate written document to the City reflecting these amendments to the Permit Renewal for that WWTP, or (b) if the RP Analysis (ar, if requested, the Second RP Analysis) .>•hows there is a reasonable potential for a future violation of the Mercury Limit at a WFT 'F, the City shall be required to continue to operate that WWTP pursuant to the applicable Permit Renewal (as amended by this Settlement Agreement), including the Mercury Limit and weekly monitoring frequency, as long as the Permit Renewal remains in effect, subject to the City's right to sock a future reasonable potential analysis if the Department alters or amends the assumptions, procedures, or other parameters or application of its reasonable potential analysis in the future. 5. Within twenty days after execution of this Settlement Agreement by all signatories, the City shall file with the Office of Administrative Hearings a Notice of Withdrawal of the consolidated Petitions for a Contested Case Hearing the City filed in the Office of Administrative Hearings (i.e., 03 EHR 0084 and 03 EHR 0091), whereby the City withdraws both Petitions with prejudice. -4- WATER & LAND SECTION Fax:919-716-6766 Jan 7 '04 15:57 P.06 6. Nothing in this Settlement Agreement precludes or limits the rights ofthe City to: (a) continue discussions with the Department concerning the appropriate assumptions, procedures, parameters, application, or use ofreasonable potential analysis orto seek rulemaking or pursue other procedures to obtain changes in kw or policy (not including appeal of the Permit Renewals) concerning the appropriate Assumptions, procedures, parameters, application, or use of reasonable potential analysis, and (b) request a reasonable potential analysis in the future for the Mercury Limit or other limits in the Permit Renewals if, in the future, the Department changes (or rulemaking or other law requires a change in) the Department's assumptions, procedures, parameters, application, or use of reasonable potential analysis. 7. This Settlement Agreement contains the entire understanding of the parties, and there are no representations, warranties, covenants or undertakings other than those expressed and set forth herein. The agreements, statements, and covenants in this Settlement Agreement are made solely for the purpose of settling this matter amicably without farther litigation. S. The parties agree to bear their own attorneys' fees, costs, and other expenses that have been incurred in connection with any stage of this contested case up to and including the filing.of the Notice ofWithdrawal of Con=rested Case.
