Enclosed please find a signed copy of the Memorandum of Agreement for the North
Buffalo Creek Instream Monitoring Study. We began the official sampling for the
Instream Study effective February 1, 2003. The D1 downstream site sampling pier
was in an unsafe condition due to age and damage from the recent ice storm. As you
are aware, the D1 site is not one of the sites included in the Upper Cape Fear
Monitoring Coalition MOA.

MEMORANDUM OF AGREEMENT
This Agreement is made by and between the Division of Water Quality ("DWQ") within the North
Carolina Department of Environment and Natural Resources, and the City of Greensboro ("CITY")
which has voluntarily approved this Agreement. This Agreement does not affect any of the NPDES
requirements under NPDES Permit No. NC0024325- North Buffalo WWTP.
Under this Agreement, the CITY will collect two years of weekly instream data for ammonia, pH,
dissolved oxygen, and temperature at the following historical sampling locations:
• U- upstream at influent conduit
• D1- downstream at unimproved road 0.8 miles east of White/Nealtown Rd intersection
• D2- downstream at Rankin Mill Road
• D3- downstream in Buffalo Creek at McCleansville Road
The study period shall begin 30 days following execution of this Agreement, and run for 24 months.
The CITY will electronically tabulate and summarize the data for each study year, and annual
summary reports will be submitted within 90 days following the end of each study year. DWQ will use
the data to reassess the instream ammonia and dissolved oxygen conditions in North Buffalo Creek.
The summary reports shall be identified by permit number (NC0024325) and mailed to the following
address:

Failure by the CITY to collect and submit the water quality data described in this Agreement may
result in the revocation of this Agreement by DWQ and the return to a Special Condition within its
NPDES permit. This Agreement may be modified by written consent of both parties. The CITY may
also request that the study be terminated after one-year, provided summer low flows are adequately
represented during the first study year.
Stream sampling may be discontinued at such times as flow conditions in the receiving waters or
extreme weather conditions will result in a substantial risk of injury or death to persons collecting
samples. When there is a discontinuance pursuant to this provision, sampling shall be resumed at
the first opportunity after the risk period has ceased.
This Agreement shall become effective 30 days following execution of this document by both parties.

Dear Mr. Williams:
Based on your comments to the Draft NPDES permit, the requirement for an instream study
was removed from the Final NPDES permit (issued 12/ 11 /02), and these requirements are
now addressed in the attached Memorandum of Agreement (MOA) between the City and the
North Carolina Division of Water Quality. Please review, sign, and mail back one copy of the
executed MOA. Under terms of this MOA, the City will conduct a two-year instream
monitoring study at four (4) stations in North Buffalo Creek to evaluate both instream
dissolved oxygen and ammonia, following the facility upgrade and removal of the upstream
Cone Mills discharge in 2001.
