Dear Mr. Lashua:
The Division received your application for a wastewater discharge permit on January 10, 2005. Division
personnel have reviewed and approved your application. Accordingly, we are forwarding the attached NPDES
discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-
215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection
Agency dated May 2004, and as subsequently amended.
For outfall 001, a Fecal Coliform (Fecal) limit has been added to this permit. Because you may need time to
make modifications to your plant in order to comply with this new condition, the Fecal limit will not take
effect until April 1, 2007. In addition, a Total Residual Chlorine (TRC) limit has also been added to this
permit. Because you may need time to make modifications to your plant in order to comply with this new
condition, the TRC limit will not take effect until April 1, 2007.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following
receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of
the North Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service
Center, Raleigh, North Carolina 27699-6714. Unless such demand is made, this decision shall be final and
binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.

to receiving waters designated as the French Broad River (outfall 001) and Lower
Creek (outfall 002) in the French Broad River Basin
in accordance with effluent limits, monitoring requirements, and other conditions
set forth in Parts I, II, III and IV hereof.
This permit shall become effective October 1, 2005.
This permit and authorization to discharge shall expire at midnight on September 30, 2010.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under
the permit conditions, requirements, terms, and provisions included herein.
Transylvania Utilities, Inc.
is hereby authorized to:
1. Continue to operate an existing 0.30 MGD wastewater treatment system with the
following components:
• Concrete influent flow splitter
• Dual aeration basins with mechanical aerators
• Dual rectangular clarifiers
• Chlorine contact chamber
• Flow meter
• Sludge digester with holding & drying beds
This system discharges from Connestee Falls WVVTP outfall 001 at 5999
Greenville Highway near Connestee Falls in Transylvania County.
2. Continue to operate an existing 0.020 MGD wastewater treatment system with
the following components:
• Influent bar screen
• Influent flow meter
• Extended aeration package plant with tertiary mixed media filter
• Chlorine disinfection and dechlorination equipment
• Aerated sludge holding
This system discharges from Connestee Falls WWTP outfall 002 at Walnut
Hollow Road in Transylvania County.
3. Discharge from said treatment works at the locations specified on the attached
maps into the French Broad River (outfall 001) and Lower Creek (outfall 002),
which are classified B-Trout and C-Trout HQW waters respectively in the French
Broad River Basin.

Inn. Please have regional office staff review the drafts and provide any written comments or

We are in receipt of your June 22, 2005 letter and draft permit. We have reviewed the draft and have the
following comments:
1) NH3-N testing is specified for outfall 001 but has no limits. Limits are set for outfall 002 so we need to
clarify if this was an omission.
2) The plant description for outfall 002 does not include a flowmeter. Also, the flow monitoring
requirement for this plant should be changed from "instantaneous" to "recorder". Flow frequency
from "weekly" to "continuous".
3) Total Phosphorus and Total Nitrogen is required for outfall 001 but not outfall 002. Is this because of
size?
4) The facility discharge location map for outfall 001 is not correct. The discharge is actually at latitude 35°
11' 15" and longitude is 82° 44' 05". Quad 67NE (Brevard). A copy of the quadrangle map is
enclosed.
5) The description for outfall 001 may need to be modified. While the plant does have a baffled chlorine
contact chamber, no other equipment is currently present. Disinfection was only done and required for a
brief period in the late 1970s. Disinfection was originally done with chlorine gas, which is no longer an
option because of safety and liability issues. All the disinfection equipment has long since been removed.
Therefore, the new fecal limit will cause us problems until we can install a liquid sodium hypochlorite
(bleach) system and make other disinfection provisions. We would request that the fecal limit be delayed
for 18 months after the permit is issued to give us time to install chlorination — and dechlorination — to
meet both the fecal and ultra low level chlorine limits.

The chlorine contact chamber is in place, and I had them run a flow through on it to
make sure they could meet 30 minutes detention time. I far as I know, the only thing
they would need would be the equipment installed. I can't imagine 18 months for that.
Will check on it to make sure I haven't overlooked some other issue that would warrant

draft permit with some comments. One of which concerned the lat/longitude
numbers for outfall 001. They indicated the numbers as listed on the draft were
incorrect. These numbers were listed on their prior permit as well, so I would
like to have the region's input. Would you please have staff verify the outfall
location, which he indicates is incorrect as well, and latitude/longitude
numbers for this facility (NPDES permit NC0024295). Thanks

Was looking through mail and realized I hadn't sent you comments on the renewal of the
Connestee Falls permit. I talked with Carolina Water Services a couple of years ago
about the upcoming Fecal Coliform limit that would most likely be imposed. They do not
need much for the installation of chlorination/dechlorination as the tanks are already
in place.. What they do need is a new plant but then that's not the issue here. To
answer your question, we have no concerns regarding issuance of this permit. Kerry

indicated below, the permittee says their discharge (outfall 001) is actually at
352110150/822440050 (Lat/long) rather than what is indicated in the draft permit. In
addition, they submitted a map showing the discharge location to be different from what
we indicate. Please take a look at the faxed map and let me know its validity and what
the lat/long numbers should be.
Also, since the fecal limit for outfall 001 will be newly added this permit cycle, they

I figure towards the middle or end of this year you will be gearing up

insanity and issues with each facility, I figured a reminder from the
region would be helpful. So I am sending you an early heads up email
regarding this past issue. This way, if need be, perhaps you can slip a
cc of this email into the files as a reminder when you go through these

decided not to re -open the two permits in question.
Both sites already have disinfection equipment, though they do not have
fecal limits. As it's unlikely that either permittee would install
disinfection gear they didn't plan to use, we believe it's safe to leave
these permits as -is until the next renewal cycle. Given our current
permit load (over 300 applications in-house) we can't spare the time
unless the situation at either site worsens.
Sorry about this, but given that disinfection is installed at both sites
the risk to the streams should be minimal. If you have questions on
this, just let me know.

The Asheville Regional Office sent out a memo dated August 1,2000
to the NPDES Group requesting permit modification at several facilities
to include Fecal Coliform limits and monitoring. The memo explained the
receiving waters extensive recreation use and the recommendation for a
classification change to "B" waters. The two facilities listed above,
NC0024295 and NC0020460 should have been included in the permit
modification but were not. Please re -open these permits and modify them
to meet Fecal Coliform limits and monitoring. These two facilities also
discharge to "trout" waters therefore we are also requesting
dechlorination.
