Division personnel have reviewed and approved your application. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143- 215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 2004, and as subsequently amended. For outfall 001, a Fecal Coliform (Fecal) limit has been added to this permit. Because you may need time to make modifications to your plant in order to comply with this new condition, the Fecal limit will not take effect until April 1, 2007. In addition, a Total Residual Chlorine (TRC) limit has also been added to this permit. Because you may need time to make modifications to your plant in order to comply with this new condition, the TRC limit will not take effect until April 1, 2007. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. We have reviewed the draft and have the following comments: 1) NH3-N testing is specified for outfall 001 but has no limits. Limits are set for outfall 002 so we need to clarify if this was an omission. 2) The plant description for outfall 002 does not include a flowmeter. Also, the flow monitoring requirement for this plant should be changed from "instantaneous" to "recorder". Flow frequency from "weekly" to "continuous". 3) Total Phosphorus and Total Nitrogen is required for outfall 001 but not outfall 002. Is this because of size? 4) The facility discharge location map for outfall 001 is not correct. The discharge is actually at latitude 35° 11' 15" and longitude is 82° 44' 05". Quad 67NE (Brevard). A copy of the quadrangle map is enclosed. 5) The description for outfall 001 may need to be modified. While the plant does have a baffled chlorine contact chamber, no other equipment is currently present. Disinfection was only done and required for a brief period in the late 1970s. Disinfection was originally done with chlorine gas, which is no longer an option because of safety and liability issues. All the disinfection equipment has long since been removed. Therefore, the new fecal limit will cause us problems until we can install a liquid sodium hypochlorite (bleach) system and make other disinfection provisions. We would request that the fecal limit be delayed for 18 months after the permit is issued to give us time to install chlorination — and dechlorination — to meet both the fecal and ultra low level chlorine limits. I far as I know, the only thing they would need would be the equipment installed. I can't imagine 18 months for that. I talked with Carolina Water Services a couple of years ago about the upcoming Fecal Coliform limit that would most likely be imposed. They do not need much for the installation of chlorination/dechlorination as the tanks are already in place.. What they do need is a new plant but then that's not the issue here. To answer your question, we have no concerns regarding issuance of this permit. The memo explained the receiving waters extensive recreation use and the recommendation for a classification change to "B" waters. The two facilities listed above, NC0024295 and NC0020460 should have been included in the permit modification but were not. Please re -open these permits and modify them to meet Fecal Coliform limits and monitoring. These two facilities also discharge to "trout" waters therefore we are also requesting dechlorination.
