Dear Ms. Bednarcik:
On August 31, 2020, Duke Energy Progress, LLC (Duke Energy) submitted a Seep Management Plan
Amendment to the proposed Corrective Action Plan(CAP) for the Asheville Steam Electric Plant to
satisfy the terms of Section 2(b)(3)of Special Order by Consent(SOC) S17-010. The Department of
Environmental Quality(DEQ)has reviewed this submittal and hereby provides its conditional approval
of the Seep Management Plan as an amendment to initial groundwater Corrective Action Plan(CAP)
documents prepared for the site and submitted in November 2015 and February 2016. This approval
has been provided as conditional because it is anticipated that an updated, comprehensive CAP will be
submitted for this site.
This conditional approval shall remain effective until an updated CAP for the Asheville Steam Electric
Plant is approved, at which time the management of seeps will be regulated by its terms. Until the
monitoring of seeps is modified by the terms of an approved,updated CAP, Duke Energy shall
continue to conduct quarterly monitoring of sampling locations A-01, C-01, E-01 F-01, F-02 and N-01
Downstream. Reporting of the results of testing should continue to be submitted to DEQ via the email
address used for the reporting of SOC data(desocdata@ncdenr.gov). This conditional approval is also
cognizant of the potential for changes in the circumstances of the seeps at the site while it is in effect,
and DEQ reserves its rights to require additional or modified monitoring of seeps should circumstances
warrant.
This conditional approval is sufficient to activate the SOC termination provision for the Asheville
Steam Electric Plant found in Section 2(b)(4) of SOC S 17-010. As a result, the SOC shall terminate on
May 18, 2022 (30 days following the date of this letter).
