Hi Sue, To follow up to my prior email, I have confirmed that the Ridgemont project meets the requirements listed on GC 4276 and does not trigger any thresholds. Therefore, please accept this email as a statement formally withdrawing the application for an Individual Certification. Does DWR issue a recognition of this withdrawal and will any documentation be provided for GC 4276? Please let me know if any other information is required. I honestly didn't pay attention to what project she was asking about. But with regards to that information, Sam summarized DWR's position on conversion correctly. For this project, you have already submitted an application and fee to DWR for an Individual Certification. You have 2 choices, I can proceed with that review on my regularly timeline which is about 30-45 days from receipt of fee (we 3 can always issue certifications even if a project does not specifically trigger the need for one), or you can formally withdraw your application by sending me an email stating that the project does not trigger any of the thresholds in GC4276 (sorry, we cannot process refunds). DWR does not formally review applications and then tell you that you don't need written approval. We either receive a complete application and fee and review and issue an approval, or it's up to you to determine that the project meets all the requirements of GC4276 and no approval is required. We are happy to answer specific questions about a condition or threshold in the GC though, as in this case where Sam requested confirmation about what is, and isn't, considered a permanent wetland impact. I'm reaching out to you at her recommendation. A NW permit / PCN application for the Ridgemont Subdivision (SAW-2022-00627) was submitted to the DWR via the online NCDEQ laserfiche portal on 4/1/22. Per Sam, your office will be able to issue a general 401 certification for the project vs. an individual certification. My understanding is that when the trenched areas for sewer lines are backfilled within the outfall corridors that cross the mapped wetlands on site, these forested wetlands will be converted to emergent wetlands. There will be open cut temporary installation where stream and wetland and those areas will generally be restored to original contours and elevations; and generally within the same footprint you will have your permanent conversion of wetlands. In total, you will have 0.15 acre of permanent wetland conversion, but no actual permanent fill of material. I'm requesting clarification simply because mitigation for conversion is 1:1 and not 2:1. In short, the applicant will only be required to purchase 0.15 wetland mitigation units. The statement of availability seems to be what they generally have available for the bank (-3 acres). I'm currently seeking clarification from Sue Homewood with DWR on whether or not an individual 401 cert is actually required, and that is dependent on if they consider the permanent conversion an actual permanent impact or not. I will let you know what her response is.
