REGAN Secretary BRIAN WRENN Acting Director Stuart Woodard, PE 3430 Toringdon Way, Suite 110 Charlotte, NC 28277 NORTH CAROLINA Environmental Quality July 24, 2020 Subject: Request for Additional Information Stormwater Permit No. SW3200202 Heritage Subdivision Union County Dear Mr. Woodard: The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater Management Permit Application for the subject project on June 22, 2020. A review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: Original Comment 3 - "Please ensure that all surface waters are accounted for. Surface waters refer to `blue line' streams as shown on USGS topographic maps (Section IV, 6). Please refer to 1 SA NCAC 02H .1017(10). " Prince Mill Creek borders the project site on the eastern side of the property and Davis Mine Creek cuts through the southern portion of the property. These are both surface waters (Since they appear on the most recent USGS topographic map of the area). The surface water area of streams is taken to be any portion of the stream below the top of bank elevation on each side of stream. 2. Original Comment 6 - "Please complete the entire Supplement EZ form. For this project, the form should contain 3 pages, Cover Page, Drainage Areas Page, and Wet Pond Page. (Section V & Section VI, 3)."Please complete the "Entire Site" column on the Drainage Areas page. The Entire Site column is an accounting of all of the BUA that will exist within the project area post -construction. Lines 4, 8, 9, & 17 - 19 do not need to be completed for this column. The total amount of BUA in this column should be slightly higher than Drainage Area 1 since all of the new BUA is not being captured in the proposed SCM. 3. Original Comment 8 - "Please provide an original and 1 copy of the original deed restriction document limiting the amount of BUA per lot (Section VI, 2 & Section VII). " The provided deed restriction document was not completely filled out nor was it signed. Please make sure to provide a copy of the signed document with the resubmittal. Original Comment 9 — "Please fold the plan set (Section VI, 8). " Please provide a second plan set. We require 2 plan sets be submitted so that one may be returned to the Applicant as part of the permit and one is kept for our records. The reduced plan set provided is acceptable, just provide a second copy. If plan sheets need to be updated to address these comments, you may provide just the updated plan sheets or provide entire updated plan sets, which ever is easiest for you. 5. Original Comment 10 — "Please show and identify the surface waters (including acreage) on the plans (Section VI, 8h) as well as the associated required buffers (Section VI, 8p). " Since there are surface waters located on -site (See earlier comment), they need to be identified on the plans, the associated vegetated buffer needs to be shown, and the application needs to be updated to include this information. 6. Original Comment 12 — "Please delineate the wetlands on the plans or provide a note stating that no wetlands exist. Provide documentation of the qualifications and identity of the individual who made this determination (Section VI, 8m). " Please place a note in the plans reiterating the information you provided in the response to comments. This note must be included in the main plan set (It is possible that I may have overlooked this note in the plans, if that is the case, please let me know which page this note appears on). 7. Original Comment 14 — "Please provided documentation showing that Mr. Johnson has signatory authority for The Kolter Group, LLC (Section VI, I]). " The provided documents show that Mr. Johnson can sign on behalf of VK Heritage, LLC and that Travis Manning and Mike Kissel are authorized signatories for VK Heritage, LLC. Signatory information has been provided for neither the Applicant (Kolter Land Partners, LLC) nor the parent company (The Kolter Group, LLC). Since the last submission, the person signing the Application has changed to James P. Harvey. I do not have any documentation on Mr. Harvey and his relationship to The Kolter Group, LLC. Since both the Applicant (Kolter Land Partners, LLC) and the Property Owner (VK Heritage, LLC) are managed by The Kolter Group, LLC, you need to provide the one of the following: a. Proof Mr. Harvey is an authorized signatory for either The Kolter Group, LLC or both Kolter Land Partners, LLC & VK Heritage, LLC (Using the new Application). b. Proof that Mr. Johnson is an authorized signatory for either Kolter Land Partners, LLC or The Kolter Group, LLC and that Mr. Manning is an authorized signatory for either Kolter Land Partners, LLC or The Kolter Group, LLC (Using the original Application). 8. The stormwater calculations need to be updated to account for the design changes to the proposed wet pond. For example, the provided calculations show the top of the sediment storage area for the main pond to be at elevation 593 whereas the plans indicate that the top of the sediment storage area is at elevation 592 There is a similar situation in the forebay). 9. The provided deed restriction document does not coincide with the plans. For example, the deed restriction document indicates that there are 54 larger (4,840 sf BUA/lot) lots (120-127, 133-159, 167-178, & 196-202) and 74 smaller (4,040 sf BUA/lot) lots (91-119, 128-132, 160-166, 179-195, 203-214, & 282-285). Plan sheet C2.00 shows 44 larger (4,240 sf buildable area) lots and 84 smaller (3,440 sf buildable area) lots (54 + 30). Please revise either as needed for consistency. 10. Please correct the following issues with the Supplement-EZ Form: a. Wet Pond Page: i. Line 27 — Recalculate this value (See earlier comment). ii. Line 28 — Recalculate this value (See earlier comment). iii. Line 32 — Recalculate this value (See earlier comment). iv. Line 34 — The cleanout depth of the forebay is the distance from the permanent pool elevation (597 ft) to the top elevation of the sediment storage area of the forebay (593 ft). 11. Please correct the following issues with the O&M Agreement Form: a. Wet Pond Design Summary: i. Has Veg. Filter? — This item should be "No". The vegetated shelf is not the same thing as a vegetated filter. ii. The temporary pool elevation should be corrected. 12. NOTE: Per Division policy, the next review of this application will be the final review. Failure to provide the requested information will result in the project being returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. 13. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, and 1 hardcopy of other documents. Pdfs must be uploaded using the form at: https://edocs.deq.nc.gov/Forms/SW Project Submittal Please note that this request for additional information is in response to a preliminary review. The requested information should be received by this Office prior to August 23, 2020, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. Please reference the State assigned project number SW3200202 on all correspondence. If you need additional time to submit the information, please submit your request for a time extension to the Division at the contact below. The request must indicate the date by which you expect to submit the required information. The Division is allowed 90 days from the receipt of a completed application to issue the permit. The construction of any impervious surfaces, other than a construction entrance under an approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement action pursuant to NCGS 143-215.6A.
