Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Summary of Changes in Renewal Permit from Existing Permit 1) Total Zinc Daily Limit has been reduced and a Monthly Average Limit added. Total Zinc has a chronic WQS, 50 pg/I, and an acute WQS, 67 pg/I. The applicable compliance limit was calculated and applied. 2) Total Copper monitoring has been reduced to quarterly. Total Copper is an action level toxicant and as such its measurement only needs to coincide with the chronic toxicity test sample. 3) Total Silver monitoring has been reduced to quarterly. Total Silver is an action level toxicant and bs such its measurement only needs to coincide with the chronic toxicity test sample. 4) A Toluene Monthly Average and Daily Limit with 2/monthly monitoring has been added. Toluene was detected and could potentially exceed chronic WQS. To be consistent with EPA guidelines a daily limit was defined. 5) A footnote narrative for TRC has been added. A narrative to clarify application and -measurement/reporting protocols was added to be consistent with Division standards. 6) A nitrite/nitrate nitrogen reporting has been added. To calculate the Total Nitrogen pollutant a nitrite/nitrate nitrogen measurement is required. Reporting was added to be consistent with Division standards. 7) A total kjeldah/ nitrogen reporting has been added. To calculate the Total Nitrogen pollutant a total Kjeldahl nitrogen measurement is required. Reporting was added to be consistent with Division standards. (1) EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS) Footnotes: 1. I = Influent. E = Effluent. U = Upstream at U.S. 74/76. D = Downstream at railroad crossing. 2. The monthly average effluent BOD5 and TSS concentrations shall not exceed 15% of the respective influent value (i.e., 85% removal). 3. Total Residual Chlorine compliance is required for chlorine or chlorine derivative used for disinfection. The Division shall consider all effluent TRC values reported below 50 ug/I to be in compliance with the permit. However, the Permittee shall continue to record and submit all values reported by a North Carolina certified laboratory (including field certified), even if these values fall below 50 ug/I. 4. Chronic toxicity (Ceriodaphnia) at 50%; January, April, July, and October[ see Special Condition A. (3)]. 5. See Special Condition A. (4), Effluent Pollutant Scan. There shall be no discharge of floating solids or visible foam in other than trace amounts. A. (2) MERCURY REOPENER The Division may re -open this permit to require mercury load limitation changes, mercury minimization plans, and/or source water characterization following completion of the Phase 2 Mercury TMDLs for the Lumber and Waccamaw River watersheds. , Permit NC0021920 A. (3) CHRONIC TOXICITY PERMIT LIMIT (QRTRLY) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 50 %. The permit holder shall perform at a minimum, Quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of January, Apri/, July, and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in`which tests were performed. If reporting pass/fail results using the parameter code TGP3B, DWQ Form AT-1 (original) is sent to the below address. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. If the Permittee monitors any pollutant more frequently then required by this permit, the results of such monitoring shall be included in the calculation & reporting of the data submitted on the DMR & all AT Forms submitted. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. Permit NC0021920 A. (5) HOLDING POND AND SULDGE HANDLING BASINS EVALUATION During the previous treatment plant upgrade two operational functions were removed from service. These removed functions, have contributed to permit violations and continue to be potential sources of surface water contamination. A holding pond was isolated from the treatment flow and is partially filled with sludge material and is separated by means of a wooden batter board dam reinforced with gravel from the post aeration basin. Four sludge handling basins are no longer used to collect sludge waste as all wasted sludge is diverted to the sludge digester and final sludge disposal. Some sludge residual remains in the basins and support piping is still available. Requirements: 1. The wastewater from these removed functions must be recycled to the appropriate point in the active treatment process. 2. Material from the holding pond cannot be allowed to enter the post aeration pond or otherwise overflow. A better designed isolation method is strongly recommended that: a. at a minimum equals the height of the bank separating the pond from the aeration basin and b. is impermeable to liquid seepage. 3. The sludge handling basins are abandoned and cannot be allowed to overflow to the surrounding area. It is strongly recommended that a documented method/practice be developed and utilized that mitigates an overflow event. 4. The overflow and/or release of material from the confines of the holding pond or sludge handling basins containment must be reported to the Wilmington Regional office the next business day during holidays/week ends or no later than 24 hours after an event during normal business hours Monday through Friday. 5. Develop and submit to: DENR/Division of Water Quality Surface Water Protection 127 Cardinal Drive Extension Wilmington, NC 28405 a. an action plan with defined action items, no later than 18 months from the effective date of this permit, for the removal of contaminated sludge from the holding pond and sludge handling basins and b. an action plan with defined action items, no later than 24 months from the effective date of this permit, for the permanent closure and decommissioning of the holding pond and sludge holding basins and c. a status report every 6 months, after the effective date of this permit and continuing until the holding pond and sludge holding basins are decommissioned. The report should include, but is not limited to, all completed actions, on going activities, and planned actions involving the holding pond and sludge holding basins. The action plans goal should be to complete decommissioning of the holding pond and sludge holding basin prior to the next permit renewal. The Water Reclamation facility discharges treated 100% domestic wastewater to White Marsh Swamp, a class C, Sw water in the Lumber River Basin. Currently, the Columbus Regional Healthcare System is the only potential industrial source discharging influent to the treatment plant. Untreated domestic/industrial waste is introduced to the plant headworks via a forced sewer main. The headworks consist of a bar screen, grit removal, an influent composite sampler, an influent wet well, and influent transfer pumps. The transfer pumps feed the BNR anarobic cell. Flow gates are used to establish the flow from the anarobic to the two (2) treatment trains anoxic zones. From the zones the flow continues to the two trains aeration basins. An adjustable overflow weir diverts flow from each basin to a collection box that then flows to flow distribution boxes. Automatic controls monitor the DO level and operate the basins air and mechanical inputs. The two distribution boxes are used to establish flow by means of adjustable weirs to the three (3) clarifiers. The clarified liquid continues to a dual tertiary disc filter system. Filter backwash is recycled. The filtered liquid enters the post aeration basin. From the post aeration basin the liquid continues to the chlorination basin, the effluent flow meter, and effluent channel. Immediately downstream from the meter dechlorination is applied followed by collection of the effluent composite sample. A pipe conveys the treated waste water a short distance to White Marsh Swamp adjacent to the facility property. The transferred WAS from the clarifiers collects in a distribution box where adjustable weirs are used to divert the solids to either the headworks wet well for recycling or to the aerobic sludge digester or sludge holding tank. Blowers are available to provide aeration to both the sludge digester and sludge holding tank. Liquid is decanted from either sludge tank to thicken the sludge. A transfer pump provides sludge to the sludge load out station. Currently, there are four drying beds which are not used and are considered surplus. A. retention pond that was part of the previous treatment process, has been isolated from its Fact Sheet NPDES NCO()21920 Page 1 of 5 service function, but is full of sludge, and has a wooden batter board scheme isolating it from the existing post aeration pond. Future plans for removal of the drying beds and elimination of the retention pond are unknown. The regional office is very concern about how well the existing isolation structure will keep material from the retention pond out of the effluent discharge. HISTORY A TMDL was completed in 2000 for mercury. A mercury mass limit was imposed and a reopener special condition added to the previous permit. These actions were consistent with the TMDL. An Authorization to Construct an upgraded treatment facility with no increase in capacity was approved in July 2006, a modification was approved in February 2007. The construction was completed and the upgraded treatment system in service 2008. The permittee initially filled the new facility oxidation basins with the sludge from the old retired plant. Unfortunately, significant concentration levels of contaminates and toxicants such as mercury were in the sludge and continue to cause compliance issues. On February 2009 the EPA sent a Notice of Violation to the City of Whiteville for effluent violations of BOD, TSS, TRC, mercury, and total zinc limits during the period from November 2005 through June 2009. In September 2009 the EPA issued a Section 308/309 letter, administrative order CWA-04-2009-4810, to the City of Whiteville for required actions for total mercury evaluation and compliance obtainment. COMPLIANCE VIOLAT)ONS The facility has a total of 26 compliance violations for TSS, BOD and Fecal Coliform beginning in 2004. In addition the facility has a total of 79 mercury compliance violations and 10 zinc compliance violations. Since the last zinc compliance issue in September 2007 the monitoring data indicates a significant shift to maintain zinc concentrations below the compliance limit. Fines of $25,880 were accessed. PERMITTING STRATEGY Reasonable Potential Analysis (RPA) The Division conducted EPA -recommended analyses to determine the reasonable potential for toxicants to be discharged by this facility, based on DMR data (effluent and PERCS) from January 2007 to February 2009 and from the 3 PPA submitted with the renewal application. Evaluations were conducted for arsenic, beryllium, cadmium, chromium, copper, cyanide, chloroform, lead, mercury, molybdenum, nickel, thallium, selenium, silver, zinc, bromodichloromethane, and toluene. Results suggest reasonable potential for the facility to discharge copper, silver, and zinc in excess of prevailing WQS. However, copper, silver, and zinc are action level toxicants. The facility has only two toxicity test failures out of the twenty five tests conducted since October 2004. Copper and silver are currently not limited and will have their monitoring frequency reduced to quarterly to coincide with the required chronic toxicity test. The Division may reopen the permit to address any future toxicity issues and impose the appropriate limits. The current permit has a zinc limit based on pre-2004 WQS. The current zinc WQS is more stringent and will be applied in this permit including the addition of a daily (acute) limit for zinc. Mercury under the current permit has both a mass based and concentration based limit. Mercury compliance has been an issue. Because this portion of the Lumber River continues to be impaired for total mercury, no IWC is applicable. The source of the mercury is most likely the sludge in the aeration basins. The permittee is adjusting the plant operation to maximize sludge removal and is also addressing the EPA administrative order. The current . It has been determined that the daily mercury mass -based limit is not supported by the most recent. Division basin evaluation, and is considered Incorrect. As a technical correction and to be consistent with EPA policy a mercury daily concentration - based daily limit of 12 ng/L will replace the Incorrect limit. The existing concentration -based mercury monthly average limit will remain. Fact Sheet NPDES NC002I92() Page 2 of 5 With only three data points, one above the detection limit, a RPA for toluene indicates. a reasonable potential for the facility to discharge toluene above its WQS. Consequently, toluene limits and monitoring were added to this permit. The dual limits were incorporated to comply with EPA guidelines. Twice a month monitoring was applied, BPJ. Data review DMRs were reviewed for the period of May 2006 to April 2008. The facility passed 23 out of the 25 toxicity tests submitted since October 2004 (including second species tests. Will continue quarterly chronic toxicity testing. Priority Pollutant Analysis The results of 3 PPA were submitted with the permit renewal application. See RPA Analysis for results. Will continue to required submittal of PPA annually. Instream Impact Temperarture, conductivity, dissolved oxygen , and fecal coliform are measured routinely at designated points upstream and downstream from the discharge into White Marsh Swamp Creek. The January 2007 through February 2009 monthly averages were reviewed and also compared to any matching monthly average effluent data. The stream data indicates that the conductivity, dissolved oxygen, and fecal coliform levels increased downstream from the outfall while temperature decreased. Will continue instream monitoring program. Effluent Limitations and Monitoring Requirements BOD BOD is a primary pollutant parameter for domestic waste effluent. BOD limits are WQS based, BOD monitoring/limits and minimum 85% removal criteria will continue. TSS TSS is a primary pollutant parameter for domestic waste effluent. TSS limits are based on secondary treatment standards. TSS monitoring/limits and minimum 85% removal criteria will continue. The pH is a primary pollutant parameter for domestic waste effluent. The pH limit range is based on secondary treatment standards. The pH monitoring/limit range will continue. Dissolved oxygen DO is a parameter of concern and its limit based on WQS. The DO monitoring/limit will continue. Seasonal upstream and downstream monitoring will continue. Fecal coliform Fecal coliform is a primary pollutant parameter for domestic waste effluent. Fecal coliform limits are based on secondary treatment standards. Fecal coliform monitoring/limits will continue. Seasonal upstream and downstream monitoring will continue. Fact Sheet NPDES NC002I920 Page 3of5 Ammonia as nitrogen • The Division had determined that seasonal ammonia as nitrogen limits were required. An IWC calculation was conducted and the seasonal limits will be revised to match current guidelines. Total Mercury The Division had determined that total mercury was a metal toxicant of concern in this facility effluent. Evaluation of reported mercury values shows historical EaRtintied compliance violations. To comply with the Lumber River impairment TA'1"e DL and WQS the concentration -based and maw limits will be applied as a daily maximum and monthly average maximum continuo. The concentration -based daily limit will replace the mass - based daily limit. Currently the facility is under an Administrative Order from the EPA. Total Zinc The Division had determined that total zinc was a metal toxicant of concern in this facility effluent. The current WQS standard was applied and new compliance limits calculated. Total zinc monitoring with revised limits will continue. Toluene The Division has determined that toluene has the potential to be present in the effluent and exceed the chronic WQS. A monthly average limit was calculated and imposed. To be consistent with EPA guidelines a daily limit equal to the calculated limit was also imposed. Monitoring 2/monthly will be required. Oil & 'Grease The Division had determined that oil & grease limits were required. Oil & grease monitoring/limits will continue. TRC TRC is a primary toxicant in effluents with chlorine based disinfection and is limited by WQS. The IWC calculation confirmed the compliance limit, monitoring/limit will continue. The Division recognizes the measurement concerns with the available TRC test method and has added narrative to define measurement and data reporting protocols. Chronic Toxicity To stay in compliance with Division standards quarterly toxicity monitoring/limit will continue. Effluent Monitoring Requirements Total Copper Total copper is a toxicant of interest, action level parameter, but does not indicate an immediate concern. Will continue to monitor to assist in quarterly chronic toxicity test evaluation. Total Silver Total silver is a toxicant of interest, action level parameter, but does not indicate an immediate concern. Will continue monitor to assist in quarterly chronic toxicity test evaluation. Total Nitrogen, Nitrite/Nitrate Nitrogen, Total Kieldahl Nitrogen Total Nitrogen, TN = (NO2-N + NO3-N) + TKN, is a calculated nutrient of interest and meets the Lumber River nutrient strategy, reporting will continue. The TN measured components, (NO2-N + NO3-N) and TKN, monitoring/reporting will be added. SUMMARY OF PROPOSED CHANGES In keeping with Division policies the following will be incorporated into the permit: • Effluent limits were revised (more stringent) for total zinc. A monthly average limit was added. • Effluent monitoring for total copper was reduced to quarterly to coincide with chronic toxicity test. • Effluent monitoring for total silver was reduced to quarterly to coincide with chronic toxicity test. • Effluent limits and monitoring for toluene were added. • A footnote narrative was added for TRC. • Reporting of nitrite/nitrate as nitrogen measured values used in the TN calculation was added. • Reporting of total kjeldahl nitrogen measured values used in the TN calculation was added. • A Special Condition requiring the permittee to conduct a study and action plan for elimination of surface water issues from the isolated holding pond and sludge beds was added. • Effluent daily maximum limit for mercury was corrected. One of the concerns I have is regarding the Mercury Mass Loading Limit of 0.004g/d. As you are aware, the Whiteville Water Reclamation Plant has not been able to meet the limit of 0.004g/d since analyzing the effluent by Method 1631. The only way the treatment plant can meet that limit is to have non detection for the entire month. The City of Whiteville was under the assumption that the limit of 0.004g/d would be adjusted according to the Phase 2 Mercury TMDLs for the Lumber and Waccamaw River watersheds. Whiteville's Hg TMDL. The current permit has a concentration and a mass limit for mercury. The facility usually (not always but usually) meets the concentration limit. However, they cannot meet the mass Hg limit. Even at less than %Z permitted flow any detect of Hg is a mass limit violation. Talk with Tom Belnick about this issue. He has a better historical perspective on the Lumber TMDL for Hg than I do. 2. Whiteville needs to work on decommissioning their old polishing pond. It is no longer used. It has sludge that may contain metal such as Hg, Cu, Zn, and Pb. Occasionally it overflows into the effluent and has caused limit violations. I would like to see something requiring Whiteville to develop a plan to properly dispose of the water and sludge in the pond and decommission it before the expiration date of the new permit. A special condition with a schedule of compliance may be a good way to accomplish this, Evaluate options by date, develop a plan by date, implement plan by date, and complete disposal and decommissioning by date. The schedule should requires periodic progress reports to WIRO, every 6 months or so. I could see this taking 3 to 5 years. 3. Whiteville needs to decommission their old "sludge storage tanks". These tanks are old drying beds that were converted to sludge holding tanks. The tanks are at ground level and subject to overflowing into White Marsh. A special condition with a schedule of compliance may be a good way to accomplish this. A Jones& Attwood grit chamber, grit pump & Classifier and a conveyer put all the waste into a 4 yard container and the hauled to the landfill. (EIMCo Water Technologies has bought out Jones & Attwood) The influent pumps consist of three 60 Hp Twelve inch Flygt pumps with VFD's controlled by a SCADA System installed by Dorsett Technologies and this system usually maintains a water level of about 5 feet in the wet well. The aeration basins are designed for and use the aerators from EIMCO Water Technologies with their BNR process. Four 100 HP Motors and gear boxes with VFD controlled by the SCADA system monitoring the DO from a DO Probe in each basin. The flow going over the weirs from the aeration basins go to distribution box # 1 and is split to the Three clarifiers. The return sludge from the clarifiers go to distribution box # 2 where sludge can be wasted to the Digester/Holding tanks or returned back to the Influent wet Well. (Headworks Facility) Clarifier equipment by EIMCo Water Technologies. The effluent from the Clarifiers go on through the Kruger Disk Filters and is chlorinated on the way to the post aeration basin. Post aeration has one twenty HP floating aerator with the flow going on into the Contact Chambers. The weir is at the end of the contact Chamber with flow measuring , PH, Do and Temp. measuring devises being recorded by the SCADA system with flow also on a chart recorder. The Effluent goes on over into the effluent channel where it is dechlorinated using Calcium thiosulfate . (Captor) The Chlorination and Dechlorination units are controlled by the SCADA system monitoring the flow meter. The Effluent flow from the channel through a pipe into the Whitemarsh, pipe 001. The Motor Control Center for all the WWRF is in the Maintenance Building , except the Headworks Facility. The Sludge digester has two (2) each forty Hp blowers and the Sludge Holding tank has two (2) two Hundred HP Blowers with diaphragm fine bubble defuses. These units are not on the Standby Generator when the Electrical Power goes out. Feburary 26, 2009 Sludge Handling (1.030Mg Capacity) The sludge holding tank and the digester tank are.both fine bubble defused aerated and when the MLSS concentrations in the treatment basin exceeds the normal operating levels the sludge levels are built up in the clarifiers and then wasted to either one or both of the sludge tanks. Both of the tanks can be decanted to thicken up the sludge before being hauled for land application. Transfer pumps can pump from one tank to the other and also to the sludge loading station for loading the trucks. The sludge is tested and applied as required by land application permit # WQ0000048. The Division shall consider all effluent TRC values reported below 50 ug/I to be in compliance with the permit. However, the Permittee shall continue to record and submit all values reported by a North Carolina certified laboratory (including field certified), even if these values fall below 50 ug/I. 4. See Special Condition A. (2) for calculation of mercury mass loading. 5. Chronic toxicity (Ceriodaphnia) at 50%; January, April, July, and October[ see Special Condition.A. (4)]. 6. See Special Condition A. (5), Effluent Pollutant Scan. g/day = grams per day There shall be no discharge of floating solids or visible foam in other than trace amounts. A. (2) TOTAL MERCURY MASS LOADING CALCULATION - DRAFT The daily maximum mass loading limit for mercury is 0.004 grams/day, which is based on a mercury wasteload allocation derived from the Lumber River Basin Mercury TMDL. Both the effluent mercury concentration and mass loading should be reported on the monthly discharge monitoring reports (DMRs). Calculation of the mass daily loading is as follows: Effluent Concentration (ug/l) x Daily Flow (MGD) x 3.785 (conversion factor) = grams mercury/day A. (3) MERCURY REOPENER - DRAFT The Division may re -open this permit to require mercury load limitation changes, mercury minimization plans, and/or source water characterization following completion of the Phase 2 Mercury 'TMDLs for the Lumber and Waccamaw River watersheds. Permit NC0021920 • A. (4) CHRONIC TOXICITY PERMIT LIMIT (QRTRLY) - DRAFT •. The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphn/a dubia at an effluent concentration of 50 %. The permit holder -shall perform at a minimum, Quarter/v monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II. Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of January, April, July, and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed. Total residual chlorine of the effluent toxicity sample must bemeasured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee Will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. If the Permittee monitors any pollutant more frequently then required by this permit; the results of such monitoring. shall be included in the calculation & reporting of the data submitted on the DMR & all AT Forms submitted. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival., minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. Permit NC0021920 A. (6) HOLDING POND AND SULDGE HANDLING BASINS EVALUATION - DRAFT During the previous treatment plant upgrade two operational functions were removed from service. These removed functions have contributed to permit violations and continue to be potential sources of surface water contamination. - A holding pond was isolated from the treatment flow and is partially filled with sludge material and is separated by means of a wooden -batter board dam reinforced with gravel from the post aeration basin. - Four sludge handling basins are no longer used to collect sludge waste as all wasted sludge is diverted to the sludge digester and final sludge disposal. Some sludge residual remains in the basins and support piping is still available. Requirements: 1. The wastewater from these removed functions. must be recycled to the appropriate point in the active treatment process. 2. Material from the holding pond cannot be allowed to enter the post aeration pond or otherwise overflow. A better designed isolation method is strongly recommended that: a. at a minimum equals the height of the bank separating the pond from the aeration basin and b. is impermeable to liquid seepage. 3. The sludge handling basins are abandoned and cannot be allowed to overflow to the surrounding area. It is strongly recommended that a documented method/practice be developed and utilized that mitigates an overflow event. - 4. The overflow and/or release of material from the confines of the holding pond or sludge handling basins containment must be reported to the Wilmington Regional office the next business day during holidays/week ends or no later than 24 hours after an event during normal business hours Monday through Friday. 5. Develop and submit to: DENR/Division of Water Quality Surface Water Protection 127 Cardinal Drive Extension Wilmington, NC 28405 a. an action plan with defined action items, no later than 18 months from the effective date of this permit, for the removal of contaminated sludge from the holding pond and sludge handling basins and - b. an action plan with defined action items, no later than 24 months from the effective date of this permit, for the permanent closure and decommissioning of the holding pond and sludge holding basins and c. a status report every 6 months, after the effective date of this permit and continuing until the holding pond and sludge holding basins are decommissioned. The report should include, but is not limited to, all completed actions, on going activities, and planned actions involving the holding pond and sludge holding basins. The action plans goal should be to complete decommissioning of the holding pond and sludge holding basin prior to the next permit renewal. -
