forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements. of North;Carolina
General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.-Environmental

This permit includes no major changes from the draft permit sent to you on August 3, 2005. If any parts,-.:
measurement frequencies or sampling requirements contained in this permit are unacceptable to you,:you.have the right
to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be
in the form of a written petition, conforming to Chapter 150E of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand
is made, this decision shall be final and binding.
The Division understands that the Town is applying for a permit modification for expansion of design flow. Please be
aware that an Engineering Alternatives Analysis is required and must be reviewed prior to approval of any expansion.
Please note that this permit is not transferable except after notice to the Division. The Division may require modification
or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits
which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the
Coastal Area Management Act or any other Federal or Local governmental permit that may be required. If you have any

This permit shall become effective November 1, 2005.
This permit and authorization to discharge shall expire at midnight on September
30, 2010.

SUPPLEMENT_ TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or
discharge are hereby revoked. As of this permit issuance, any previously issued
permit bearing this number is no longer effective. Therefore, the exclusive authority
to operate . and discharge from this facility arises under the permit conditions,
requirements, terms, and provisions included herein.
The Town of Rosman is hereby authorized to:
1. Continue to operate an existing 0.09 MGD wastewater treatment facility with the
following components:
• Bar screen
• Dual aeration tanks
• Dual clarifiers
• Chlorine disinfection equipment
• Dechlorination
• Flow meter
• Aerobic sludge digester with drying beds
This facility is located at the Rosman WWTP on NCSR 1156 in Transylvania
County.
2. Discharge from said treatment works at the location specified on the attached -
map into the French Broad River, classified C-Trout waters in the French Broad
River Basin.

Thanks, Bob.
If I could, I wanted to ask you another question. Later today I hope to
be able to forward to you an application from the Town for their new /
revised permit at 0.250 MGD. As we are currently in construction
permitting with this project (of which I hope to have all of CG&L's
questions answered shortly), it appears that the NPDES permit will be
the controlling factor on when we are issue a construction permit / when
we can bid the project. Since this appears to be the case, can you give
me a little information regarding the timeframes involved with obtaining
a revised / amended NPDES permit for additional flow? Any help you
could give me would be greatly appreciated. Thanks and have a nice
weekend!

SUMMARY
The Town of Rosman operates a 0.09 MGD wastewater treatment facility that discharges
directly into the French Broad River. The Rosman WWTP is 100% domestic flow with no
Industrial Dischargers. Per Consultant, the City has received funding for the construction of
plant improvements with the ATC to be issued in the near future. These plans call for tertiary
treatment, UV disinfection and auxiliary spray irrigation. This permit is being renewed with no
changes from the existing permit. The Facility must submit a permit modification and an EAA
before any expansion of flow can be approved.
The French Broad Basinwide Water Quality plan has a particular concern of residential and
urban development occurring in Brevard and Rosman. There are no fish consumption
advisories in this Subbasin. In the water supply category, all waters are Supporting on an
evaluated basis based on reports from DEH regional water treatment plant consultants.
TOXICITY TESTING:

COMPLIANCE SUMMARY: BASED ON THE PREVIOUS 2 YEARS
The facility was issued enforcement action LV-2004-0250 on 6-21-04 for fecal coliform
violations and paid the civil penalty on 9-21-04 after requesting and being denied remittance.
Likely, the most pressing issue for this facility is that is approaching design capacity. A DMR
review indicated the facility has a monthly average discharge of .077MGD, which is 86% of
design capacity and a daily max average of .85MGD, which is 95% of design capacity. The
facility violated its monthly average daily flow limit on 9-04 with a reported daily flow of .093
MGD. The facility reported Daily max flows of .176 MGD and .094 MGD on 9-04 and 11-04.

INSTREAM MONITORING:
The existing upstream and downstream sampling for Fecal Coliform will continue during this
permitting cycle.
TOXICANT PARAMETERS
The 28ug/1 Total residual Chlorine limit will remain in this permit.

addressed as the need arises.
