Dear Mr. Armstrong:
Attached to this letter is the final NPDES permit for your Cit•'s \Whitemarsh \V\' TP. This permit is issued pursuant to
the requirements of North Carolina General Statute 143-215.1 and the Memorandum of .Agreement between North Carolina and
the U.S. Environmental Protection Agency dated May 9, 1994.
Based on the agreement between EPA Region IV and the Division of Water Quality, the Division is required under certain
circumstances to reopen a permit and insert a limit for zinc. The \Whitemarsh \V1\TP has had sporadic chronic toxicity failures in
the past two years. In response, the City acknowledged that zinc is likely a causative factor in those toxicity failures (demonstrated
by extremely high effluent zinc values). A daily maximum limit of 222 µg/1 total zinc has been inserted into this permit, to be
monitored once per week. No other requirements from the previous permit have been changed (other than specifying total
metals).
Review of the most recent few months of data indicates that zinc levels are decreasing. This permit expires August 31,
2004 in accordance with the basin schedule for the Lumber River Basin. During the permit renewal, the zinc data will again be
evaluated to determine if there is a reasonable potential to exceed the allowable level of 222 µg/l; toxicity testing results will also
be reviewed. Should the data indicate no reasonable potential to exceed the allowable level, the Division may reduce the
monitoring frequency and/or eliminate the limit. The City should make every effort to reduce the zinc levels.
This permit is not transferable except after notice to the Division. The Division may require modification or revocation
and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by
the Division of Water Quality, the Division of Land Resources, the Coastal Area Management Act, or any other federal or local
governmental permit.

City of Whiteville
is hereby authorized to discharge wastewater from a facility located at the
Whitemarsh WWTP

Whiteville
Columbus County
to receiving waters designated as White Marsh Swamp in the Lumber River Basin in
accordance with effluent limitations, monitoring requirements, and other conditions set forth
in Parts I, II, III, and IV hereof.
The permit shall become effective October 1, 2003.
This, permit and the authorization to discharge shall expire at midnight on August 31, 2004.

All previous NPDES Permits issued to this facility, whether for operation or discharge. are
hereby revoked. (The exclusive authority to operate this facility arises under this permit.
The authority to operate the facility under previously issued permits bearing this number is
no longer effective.] The conditions. requirements, terms and provisions of this permit
authorizing discharge under the NPDES govern discharges from this facility.
The City of Whiteville is hereby authorized to:
1. Continue to operate an existing 3.0 MGD wastewater treatment system that
includes the following components:

> Post aeration basin

This facility is located at the Whitemarsh WWTP in Whiteville off Nolan Avenue in
Columbus County.
2. Discharge from said treatment works (via Outfall 001) into White Marsh Swamp, a
Class C-Swamp stream in the Lumber River Basin, at the location specified on the
attached map.

2. The monthly average effluent BODS and TSS concentrations shall not exceed 15% of the respective influent value (i.e., 85%
removal).
3. The daily average dissolved oxygen effluent concentration shall not be less than 5.0 mg/L.
4. The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units.
5. The lab quantitation level (QL) for mercury is 0.2 µg/L. Measured levels of mercury below the QL should be reported as <0.2
µg/L and are considered to be zero for compliance evaluation.

SUPPLEMENT TO EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS
SPECIAL CONDITIONS
A. (2) TOTAL MERCURY MASS LOADING CALCULATION
The daily maximum mass loading limit for mercury is 0.004 grams/day, which is based on a mercury
wasteload allocation derived from the Lumber River Basin Mercury TMDL. Both the effluent mercury
concentration and mass loading should be reported on the monthly discharge monitoring reports (DMRs).
Calculation of the mass daily loading is as follows:
Effluent Concentration (ug/l) x Daily Flow (MGD) x 3.785 (conversion factor) = grams mercury/day
Note: If the mercury effluent concentration is reported by the lab as <0.2 ug/l, report <0.2 ug/1 as
the concentration, and report <0.004 g/d as the mass mercury loading.
A. (3) CHRONIC TOXICITY PERMIT LIMIT (Quarterly)
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant
mortality to Ceriodaphnia dubia at an effluent concentration of 50%.
The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the
"North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or
subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure"
(Revised -February 1998) or subsequent versions. The tests will be performed during the months of
January, April, July, and October. Effluent sampling for this testing shall be performed at the NPDES
permitted final effluent discharge below all treatment processes.
If the test procedure performed as the first test of any single quarter results in a failure or ChV below the
permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two
following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test
Procedure" (Revised -February 1998) or subsequent versions.
The chronic value for multiple concentration tests will be determined using the geometric mean of the
highest concentration having no detectable impairment of reproduction or survival and the lowest
concentration that does have a detectable impairment of reproduction or survival. The definition of
"detectable impairment," collection methods, exposure regimes, and further statistical methods are
specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -
February 1998) or subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter
code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally, DWQ Form AT-3
(original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later
than 30 days after the end of the reporting period for which the report is made.

Test data shall be complete, accurate, include all supporting chemical/physical measurements and all
concentration/response data, and be certified by laboratory supervisor and ORC or approved designate
signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if
chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is
required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test
form indicating the facility name, permit number, pipe number, county, and the month/year of the report
with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the
Environmental Sciences Branch at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring
will be required during the following month. Should any test data from this monitoring requirement or
tests performed by the North Carolina Division of Water Quality indicate potential impacts to the
receiving stream, this permit may be re -opened and modified to include alternate monitoring
requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival, minimum control organism reproduction, and appropriate environmental controls,
shall constitute an invalid test and will require immediate follow-up testing to be completed no later than
the last day of the month following the month of the initial monitoring.

March 12, 2003 - Draft permit (reopener), inserted Zinc limit of 222 ug/1.
4/9/03 - Whiteville submitted comments on draft. Acknowledge that zinc has
been discharged in high levels and understand why limit is being proposed.
** Request SOC or 2 year compliance schedule for zinc limit. Have $4.2 million
WWTP Improvement plan in the works.
8/8/03 - (had been trying to discuss with the region periodically since May;
discussed with Jim B. and wanted confirmation from Rick S.). WiRO will not
offer Whiteville an SOC and are not inclined to give them a schedule of
compliance. Says this has been an ongoing problem with Whiteville and it's
due to a specific industry. The improvements that Whiteville states in their
letter are structural in nature and are not specific to addressing the zinc issue.
RECOMMENDATION: Issue permit with zinc limit and no compliance
schedule.
Notes (not related to zinc)
Whiteville has some specific mercury language (which also references the <0.2
ug/1 detection language). Spoke with Tom B. about possibly changing this.
Tom stated that Whiteville received the general letter and are aware of the new
detect level. Since the permit is up for renewal next year - will make any
corrections at that time.

Draft NPDES Permit Reopener — zinc limit
Dear Ms. Wilson:
The City has reviewed the above referenced information sent by your office on March 12,
2003. We understand your agency proposes to insert into the City's permit, a daily
maximum discharge limit for zinc (222 ug/1) to be monitored once per week.
The City has had several chronic toxicity failures over the last two years due to high
levels of zinc in our WWTP effluent. The source of this excess zinc was an Industrial
User that was in violation of their pretreatment permit.
The City is in the design phase of a $4.2 million WWTP Improvement Plan that will
allow our plant to operate more efficiently. The Improvement Plan includes upgrades to
the Aeration Process, Sludge Holding and Digestion Process and Secondary Clarifiers.
After these improvements have been implemented, the City feels we will be better able to
meet the proposed zinc discharge limit. The estimated completion time for these
improvements is approximately 24 months. The City is requesting that our WWTP be
placed under a Special Order of Consent (SOC) for the proposed zinc limit for a 24-
month period. This SOC period would allow us time to construct the improvements that
will make it possible to consistently meet the proposed zinc limit.

hello susan,
i got a copy of whiteville's 4-9-03 letter. they want an soc, but did
not appear to know how to ask for one. i'll send them an application if
rick wants me to. they have a real problem at their wastewater plant
that is kind of related to zinc. the earthen berm between their aeration
basin and what used to be their other aeration basin (was being used as
an EQ basin until they got alot of zinc in their sludge, now it is a
sludge holding tank) is structurally unstable. they piled rip rap over
the bad area and then filled the basin full of water. the rip rap was a
good idea, but i don't think that the water was such a good idea. i
think they planned to slowly reduce the zinc -contaminated sludge by
running it back through the plant. they followed the plans of their
consultant (leo greene) and chose not to follow my recommendations.
anyway, they understood at that time that they would be responsible for
NPDES effluent limitations. if i can find anything to attach to this
that provides more info, i'll attach it later,,,,jb

NPDES Permit Number NC0021920. The Division of Water Quality is reopening the NPDES permit for the Town of
Whiteville's wastewater treatment plant [P.O. Box 607, Whiteville, NC 28472]. The permit is being reopened to
include a limit for total zinc. The municipal wastewater treatment plant is permitted to discharge up to 3.0 MGD of
treated domestic and industrial wastewater from an outfall into White Marsh Swamp, a class C-Swamp water in the
Lumber River Basin. BOD, ammonia, dissolved oxygen, some metals, including zinc, are water quality limited. This
discharge may affect future water quality based effluent limits for additional discharges within this portion of the
watershed.

The Aquatic Toxicology Unit has requested that the Town of Whiteville's permit
be reopened to include a limit for zinc. The Town has had multiple toxicity
failures for the past two years. Although no Toxicity Identification Evaluation
(TIE) has been performed, the Town, the Wilmington Regional Office, and ATU
suspect that zinc is the causative factor in the toxicity failures.
The Town has a Significant Industrial User (SIU) which has contributed
extremely high zinc values to the plant (resulting in up to 9 mg/1 effluent values
as recently as November 2002). At this point, it is likely that residuals in the
plant have a significant amount of zinc, which may be contributing to the
elevated effluent levels.
In accordance with the agreement between the Environmental Protection
Agency and the North Carolina Division of Water Qualityl, the NPDES Unit
requests permission to reopen the NPDES permit for the Town of Whiteville's
Wastewater Treatment Plant.
With your concurrence, the NPDES Unit will reopen the permit and implement
an effluent daily maximum limit of 222 ug/1 for total zinc.

This office has completed a review of the facility's efforts to rule out copper and zinc as
potential causative effluent toxicants. Prior to discussing the City's efforts, it is helpful to review
evidence that supports the recommendation by ATU and WiRO to reopen the NPDES Permit and
include a final permit lirnit for zinc.
The City was issued "Reasonable Potential" NOVs for the January and February 2001
effluent toxicity permit limit failures. An evaluation of reasonable potential to violate instream
action levelsT0,at for these parameters was conducted by the NPDES Unit. The analysis indicated
that reasonable potential existed for both parameters and the facility was sent NOVs dated 4/2/01
and 4/24/01 containing prospective copper and zinc permit limits of 28 ug/L and 223 ug/L,
respectively.
On 5/21/01 representatives from the City and the Wilmington Regional Office met to
discuss the City's assertion that zinc was the primary effluent toxicant. The City felt certain that
Conflandey, Inc., (manufactures galvanized metal products) was responsible for extremely high
effluent zinc concentrations noted in the City's effluent and for NPDES toxicity permit limit
violations that occurred from July 2000 through April 2001. The City was informed of their
responsibility to locate and eliminate/reduce effluent toxicants such that compliance with the
final chronic toxicity permit limit of 50% would be consistently maintained.
In response to the 5/21/01 meeting, the WiRO sent a letter dated 6/19/01 to the City
indicating that ATU and WiRO had discussed the issue and that a zinc limit "should not be
imposed at this time." Monthly multiple concentration toxicity testing was suggested along with
close scrutiny of the IU responsible for the increased zinc concentrations. The letter also stated,
"Please be advised that if effluent toxicity either persists or reoccurs, this Office may recommend
that the permit be reopened and modified to include zinc effluent limits." The facility was aware
that continuing violations would result in a recommendation to reopen the NPDES permit to
include a permit limit for zinc.
A review of the facility's toxicity self -monitoring data reveals recent effluent toxicity
failures for January 2002 and April 2002 (verbal). The monthly average effluent zinc
concentration in January 2002 measured 247 ug/L. The chronic value for January measured
35.4%. Mr. Asure Spivey (ORC for Whiteville) verbally reported a chronic value of <25% for

April 2002. Monthly average effluent zinc concentrations in October, November and December
2000 measured 821 ug/L, 724.5 ug/L and 654.5 ug/L.
We understand the City met with Conflandey representatives on several occasions to
discuss toxicity issues and the City issued NOVs and civil penalty assessments to Conflandey.
To our knowledge, no 11E testing was performed using the 1/7/02 toxic effluent sample;
however, the City indicated that TIE testing was initiated with the toxic effluent sample obtained
during April 2002. The City was requested to forward TIE test results to our office and the
Wilmington Regional Office upon completion. Mr. Spivey was informed that our office would
recommend the NPDES Permit be reopened and a zinc permit limit be applied.
Although it appeared that the City was making progress in eliminating pass -through
toxicity beginning in May 2001, additional effluent toxicity permit limit violations occurred
(January and April 2002). While the City claims that Conflandey is the contributing source of
elevated effluent zinc concentrations, we have not reviewed confirmatory data to support or deny
this claim. The City is aware of its responsibility to reduce/eliminate pass -through toxicity.
Our Unit recommends that the City's NPDES Permit be reopened and an appropriate
permit limit for zinc be applied. At this time, we do not recommend a copper limit be included
in the NPDES Permit based on effluent copper concentrations which were below the prospective
permit limit of 28 ug/L. We also support, at minimum, weekly monitoring for zinc. It may be
appropriate to include a schedule in the NPDES permit to meet the prospective zinc permit limit.
Staff from the Wilmington Regional Office concur with these recommendations.•

This office has completed a review of the facility's efforts to rule out copper and zinc as
potential causative effluent toxicants. Prior to discussing the City's efforts, it is helpful to review
evidence that supports the recommendation by ATU and WiRO to reopen the NPDES Permit and
include a final permit limit for zinc.
The City was issued "Reasonable Potential" NOVs for the January and February 2001
effluent toxicity permit limit failures. An evaluation of reasonable potential to violate instream
action levelsTotal for these parameters was conducted by the NPDES Unit. The analysis indicated
that reasonable potential existed for both parameters and the facility was sent NOVs dated 4/2/01
and 4/24/01 containing prospective copper and zinc permit limits of 28 ug/L and 223 ug/L,
respectively.
On 5/21/01 representatives from the City and the Wilmington Regional Office met to
discuss the City's assertion that zinc was the primary effluent toxicant. The City felt certain that
Conflandey, Inc., (manufactures galvanized metal products) was responsible for extremely high
effluent zinc concentrations noted in the City's effluent and for NPDES toxicity permit limit
violations that occurred from July 2000 through April 2001. The City was informed of their
responsibility to locate and eliminate/reduce effluent toxicants such that compliance with the
final chronic toxicity permit limit of 50% would be consistently maintained.
In response to the 5/21/01 meeting, the WiRO sent a letter dated 6/19/01 to the City
indicating that ATU and WiRO had discussed the issue and that a zinc limit "should not be
imposed at this time." Monthly multiple concentration toxicity testing was suggested along with
close scrutiny of the IU responsible for the increased zinc concentrations. The letter also stated,
"Please be advised that if effluent toxicity either persists or reoccurs, this Office may recommend
that the permit be reopened and modified to include zinc effluent limits." The facility was aware
that continuing violations would result in a recommendation to reopen the NPDES permit to
include a permit limit for zinc.
A review of the facility's toxicity self -monitoring data reveals recent effluent toxicity
failures for January 2002 and April 2002 (verbal). The monthly average effluent zinc
concentration in January 2002 measured 247 ug/L. The chronic value for January measured
35.4%. Mr. Asure Spivey (ORC for Whiteville) verbally reported a chronic value of <25% for

April 2002. Monthly average effluent zinc concentrations in October, November and December
2000 measured 821 ug/L, 724.5 ug/L and 654.5 ug/L.
We understand the City met with Conflandey representatives on several occasions to
discuss toxicity issues and the City issued NOVs and civil penalty assessments to Conflandey.
To our knowledge, no TIE testing was performed using the 1/7/02 toxic effluent sample;
however, the City indicated that TIE testing was initiated with the toxic effluent sample obtained
during April 2002. The City was requested to forward TIE test results to our office and the
Wilmington Regional Office upon completion. Mr. Spivey was informed that our office would
recommend the NPDES Permit be reopened and a zinc permit limit be applied.
Although it appeared that the City was making progress in eliminating pass -through
toxicity beginning in May 2001, additional effluent toxicity permit limit violations occurred
(January and April 2002). While the City claims that Conflandey is the contributing source of
elevated effluent zinc concentrations, we have not reviewed confirmatory data to support or deny
this claim. The City is aware of its responsibility to reduce/eliminate pass -through toxicity.
Our Unit recommends that the City's NPDES Permit be reopened and an appropriate
permit limit for zinc be applied. At this time, we do not recommend a copper limit be included
in the NPDES Permit based on effluent copper concentrations which were below the prospective
permit limit of 28 ug/L. We also support, at minimum, weekly monitoring for zinc. It may be
appropriate to include a schedule in the NPDES permit to meet the prospective zinc permit limit.
Staff from the Wilmington Regional Office concur with these recommendations.

A Notice of Violation was issued to Conflandey on November 22, 2002 for limit violations
discovered in the manhole directly downstream from Conflandey's pretreatment unit. City
personnel and Conflandey representatives met on December 5, 2002 to discuss the problems
the Wastewater Treatment Plant was encountering as a direct effect of the slug of zinc
released to the plant daring the last of October. The City stated that it would recover all cost
from Conflandey for sludge disposal and failed toxicity due to the slugiof zinc received by the
plant from Conflandey. A piping diagram of Conflandey was requested so City personnel
could determine where the zinc could be entering .the sewer due to the fact that the
pretreatment unit was always meeting its daily limit of 261 mg/1 and the manhole
downstream was always higher. City personnel met again with Conflandey representatives on
January 30, 2003 to discuss discoveries made on Conflandey's piping system. Conflandey has
a large acid container Iocated at the facility. The container has a dike around it to contain any
spills that might occur. The diked area contained a valve and pipe kmciing into the sewer to
drain any storm water that might collect in the diked area. Conflandey had pumped a batch
of lubricant rich with zinc to the diked area for temporary storage when an accidental spill had
occurred in the plant. It was discovered that a disgruntled employee had released the
lubricant contained in the dared area into the sewer. 'This is when the large zinc spike was
discovered in the manhole. The reason the numbers in the manhole had not coincided with
the numbers from the pretreatment unit was due to a faulty valve in the diked containment
area leaking. The pipe leading from this area was disconnected completely the last week of
January and the numbers correlate closer between pretzeatment and the manhole since the
disconnection.

Your application for permit renewal was received by the POTW on January 2, 2003. As
you are aware the Industrial User Permit 110008 for Conflandey, Inc. expired on January
1, 2003. The City of Whiteville is extending the expiration date for 90 days from January
1, 2003. The City Staff would like this additional time to develop and review appropriate
modifications, as discussed in a previous letter on October 16, 2002, to the Industrial
User Permit which should help to eliminate any non-compliance issues and fines in the
future. A permit renewal fee of two hundred and fifty dollars($250.00) must be submitted
to this office no later than two weeks of receipt of this letter. Please make your check
payable to the City of Whiteville.

Susan, Whiteville still has intermittent problems with Conflandey, Inc.
and they still have sludge with high zinc levels in the plant. They
have taken all necessary steps to resolve the pretreatment issues
outside of shutting the industry down. So I would say go ahead and send
them notice of the change,a nd if they want to negotiate an SOC we can
do it at that time.
It was nice working with you. I am going to Public Water Supply later
this week.
Ed,
Can you or someone else give me an update on Whiteville? I've had a
reopener request from ATU (which I've had for some time) to reopen the
permit and put in a zinc limit. Is the industry still causing them
problems? or is the problem that their sludge has a significant amount
of zinc now (or both)? The effluent data has had significantly high
values (even toward the latter part of 2002). We'll likely move forward
with the Zn limit if ya'll concur. However - this will likely
immediately put them in noncompliance - should we give them a schedule?
(or do you guys want us to just give them a limit and you'll then
develop an SOC for them?)
Thanks - hope all is well for you. Just pass this on to whomever can
best answer these (and I'll likely need to discuss over the phone). I'm
going to talk to ATU about this on Thursday.

This is to inform you that a review of your toxicity self -monitoring report form for the month of
February 2001 indicates a violation of the toxicity limitation specified in your NPDES Permit. You
should undertake necessary actions to eliminate or reduce effluent toxicity to acceptable levels.
Previous correspondence was sent to you concerning implementation of the Division's Copper
and Zinc Action Level Policy. The correspondence included prospective permit limits for copper and/or
zinc and stated that the trigger for implementing the policy would be two or more WET limit violations
which occur during a toxicity testing calendar quarter. Please note that the second WET limit violation
has occurred and you must provide:
a) Written notification indicating acceptance of the prospective copper and/or
zinc permit limit. Notification is due by May 24, 2001.
OR
b) Written notification indicating your choice of option(s) 1-4 below. Notification is due by
May 24, 2001.
1. Instream measurements of dissolved metal during low flow conditions that demonstrate
compliance with the Action Level standard
2. A revision of the prospective permit limit using improved inputs that in concert with
existing or additional monitoring data demonstrates compliance with the Action Level
standard
3. Toxicity Identification Evaluation (TIE) results that definitively rule out copper and/or
zinc as causes of effluent toxicity
4. Demonstration by an alternative method approved by the Division and EPA that copper
and/or zinc is not the cause of toxicity

This is to inform you that a review of your toxicity self -monitoring report form for the month of
January 2001 indicates a violation of the toxicity limitation specified in your NPDES Permit. You should
undertake necessary actions to eliminate or reduce effluent toxicity to acceptable levels.
In addition, this correspondence contains important information on the Division's Copper and
Zinc Action Level Policy which is triggered by failure of two or more toxicity limit violations during
the toxicity testing calendar quarter specified by the toxicity testing special condition of your NPDES
Permit. Attachments addressing policy implementation and a copy of the Division's Toxicity Reduction
Guidance have been included with this Notice of Violation.
You should initiate follow-up toxicity testing upon a single WET test failure which occurs
during the toxicity testing calendar quarter.
Your facility is currently monitoring for copper and/or zinc and is exceeding the action level for
these parameters. The policy states that whenever a facility experiences two .or more toxicity limit
violations during a toxicity testing calendar quarter, the NPDES Permit will be modified to include
numeric limits for copper and/or zinc UNLESS the permittee provides one or more of the following:
1. Instream measurements of dissolved metal during low flow conditions that demonstrate
compliance with the Action Level standard
2. A revision of the prospective permit limit using improved inputs that in concert with
existing or additional monitoring data demonstrates compliance with the Action Level
standard
3. Toxicity Identification Evaluation (TIE) results that definitively rule out copper and/or zinc
as causes of effluent toxicity
4. Demonstration by an alternative method approved by the Division and EPA that copper
and/or zinc is not the cause of toxicity

The Division has evaluated your copper and/or zinc monitoring data. The Division has also
developed a prospective NPDES permit limit based on your facility's instream waste concentration, the
copper and/or zinc action level criterion and a translator procedure. Based on this data your prospective
copper permit limit is 28 µg/L and prospective zinc permit limit is 223 µg/L.
The permittee, upon experiencing two or more toxicity limit violations during a toxicity
testing calendar quarter must either provide DWQ with:
a) Written notification indicating acceptance of the prospective copper
and/or zinc permit limit. Notification is due within 30 days after the date of
the second WET Notice of . Violation.
OR
b) Written notification indicating your choice of option(s) as noted on page
one of this correspondence. Notification is due within 30 days after the date
of the second WET Notice of Violation.
Written notification (a or b above) shall be sent to:

Failure to notify DWQ of your acceptance of a copper and/or zinc limit, failure to notify
DWQ of your option selection or failure to make acceptable demonstration to DWQ that copper
and/or zinc are not causative effluent toxicants within the stated time frames will result in
reopening of the NPDES Permit to include copper and/or zinc numeric limitations, as appropriate.
Please note that your actions to notify DWQ of prospective limit acceptance or to notify DWQ
of plan option(s) and subsequent submission of a plan are contingent upon two or more toxicity NPDES
permit limit violations occurring during a toxicity testing calendar quarter.

Also note that the WET limit will remain in your NPDES permit regardless of whether metals
are the source of effluent toxicity. The data resulting from your actions to disprove copper and/or zinc as
sources of effluent toxicity will determine whether NPDES Permit limits will be assigned for these
parameters. You are responsible for initiating actions to address these issues.
, You may consider entering into a Special Order by Consent (SOC) with DWQ. A SOC provides
regulatory relief for specific NPDES permit limit violations and, if signed, will contain a requirement to
conduct a Toxicity Reduction Evaluation. The SOC will contain a compliance schedule, stipulated
penalties for failing to meet milestone activity dates and may contain upfront penalties to settle past
permit limit violations.
