Summary and Recommendations
Technical Support has reviewed the request for an instream assessment for the
Town of Newland. The Town has requested an SOC because their facility is out of
compliance with its flow limit due to inflow and infiltration (I&I) problems.
The Town would like to relax its limits for flow. With the addition of 0.02 MGD
to the existing 0.1604 average MGD, the plant will reach a flow of 0.1804 MGD
which exceeds the permitted flow by 0.0204 MGD.
A Level-B analysis was not performed since permit violations are due to I & I
and the facility is meeting all permitted limits except flow. The facility must
return to its design flow (0.16 MGD) at the end of the SOC period, or obtain an
NPDES permit modification for a higher wasteflow.
Background Information
The Town of Newland WWTP discharges into the North Toe River, a class "C-Trout"
river. North Toe River drains approximately 10 square miles at the discharge
site. The USGS estimates the following flows at the discharge site: summer 7Q10
= 3.3 cfs, winter 7Q10 = 4.8 cfs, and average flow = 22 cfs. The creek is swift
moving with a stream bed gradient ranging from 35 to 188 feet per mile.
The Newland facility compliance record is excellent with the exception of flow.
The facility has secondary limits but is operating at BOD5 < 5 mg/1, NH3-N < 1
mg/1, and TP < 1 mg/1. The region should check the accuracy of the compliance
records.

It is as long as the current monthly average waste flow remains
close to the reported value in item B.1. above. Significant
deviation from that value will significantly alter the total
plant flow.

facility has been under. SOC for more than a year.
