Stevens, Director Division of Water Quality May 4, 2001 Subject: Speculative Limits Town of Newland NC0021857 Avery County This letter is in response to your request (dated January 18, 2001) for speculative effluent limits for a proposed expansion to 0.8 MGD for the Town of Newland wastewater treatment plant in Avery County. Please note that there have been several speculative limit requests by the town over the past year (for 0.4 MGD, 0.6 MGD, and now 0.8 MGD). Since staff resources are limited, we urge that the town perform sufficient planning efforts to determine appropriate expansion needs prior to any future speculative limits requests. Please note that requests for additional flow will ultimately need to be justified according to 15A NCAC 2H.0219. This facility is currently permitted to discharge up to 0.32 MGD of treated wastewater to the North Toe River, a Class C-Trout water in the French Broad River Basin (Subbasin 040306). The proposed expansion is for a design capacity of 0.8 MGD. The proposed discharge location would remain the same, with a drainage area of approximately 10 square miles and an estimated summer 7Q10 flow of 3.3 cfs. According to the 2000 French Broad River Basinwide Plan, no dissolved oxygen (DO) problems have been documented in the subject subbasin, and the receiving stream is not listed as impaired in the Draft 303(d) list. No interaction with the other NPDES permitted domestic wastewater discharger to the North Toe River (Town of Spruce Pine) is anticipated. Based on the available information, speculative limits for the proposed expansion are presented in Table 1 (attached). The only changes between the current permit limits and the speculative limits are: • Increase in monthly effluent flow from 0.32 MGD to 0.8 MGD • Change in monthly effluent ammonia limits from 6.0 mg/1 to 3.1 mg/1 in summer, and from 17 mg/1 to 7.9 mg/1 in winter. • Addition of a 5.0 mg/1 effluent limit for dissolved oxygen. • Increase in monitoring frequencies appropriate for a Grade III facility. The speculative limits presented here are based on our understanding of the proposal and of present environmental conditions. These speculative limits are not binding unless they become part of an issued NPDES permit. Response to a speculative limit request does not guarantee that the Division will issue the Town of Newland an NPDES permit modification to expand the discharge of treated wastewater into waters of the State. Nor can we guarantee that the effluent limitations and other requirements included in any permit will be exactly as presented here. In accordance with the North N. C. Non -discharge alternatives, such as spray irrigation or connection to a regional wastewater treatment facility, are considered to be environmentally preferable to a discharge. Therefore, prior to submittal of an NPDES permit modification, a detailed alternatives analysis must be prepared to assure that the environmentally sound alternative was selected from the reasonably cost-effective options. A guidance document to assist you or your consultant in preparing an engineering alternatives analysis (EAA) was previously enclosed with the last speculative limit request. All information pertaining to this request has been sent to our Central Files for storage. If it becomes necessary to request an NPDES permit modification, please submit a complete application package including Short Form D, EAA, and appropriate fee. The proposed activity is considered a major modification, which requires a fee of $215 and is subject to Public Notice. The revised average plant design capacity is 0.4 MGD. New peak design flow will remain 1.0 MGD. This letter revises our April 29, 1999 request for planning limits for an average capacity of 0.6 MGD. The location of the expansion will be at the site of the existing plant. The outfall is located at latitude 36° 05' 20" and longitude 81 ° 56' 57". The discharge is to the North Toe River. A-95 and Env. Assessment have been completed. I think they have or will receive money for this project. I recommend that you run the spec. limits at 0.800 mgd. Call me if you have questions. M. They have submitted 2 applications to the State Grant program. One is for the I/I rehab, and the other is for an expansion from .32 to .6 mgd. However, neither of the applications has garnered enough points in our priority system to receive funding. I do not think funding was "turned down" due to I/I issues. Our inability to fund Newland's proposed project(s) is simply a matter of not having adequate points to fall into the fundable range of the State Grant program. Their consultant indicated that the 0.6 MGD expansion request was submitted to CG&L and turned down due to I&I issues, and now they're seeking funding through USDA Rural Development for the 0.8 MGD upgrade.
