State Permit#82-20 was originally issued to Preservation Point Partners, LLC on July 29, 2020 to construct a 133 unit subdivision,amenity area,boardwalks,a 98-slip community marina on the Northeast Cape Fear River, and 2 kayak launches along Smith Creek and an unnamed tributary, in Wilmington. State Permit#82-20 is due to expire on December 31, 2023. The actions proposed include a reduction in size of the floating finger piers from 6' wide to 4' wide, creating an overall reduction in the square footage of component M-2. Component M-4 and M-5 would also be slightly reduced in length to accommodate a longer access ramp to achieve a slope that is ADA accessible (see sheet D- 1 and D-2 received on 3/3/2022). Additional changes include shifting and expanding the 15' by 15' gazebo from its authorized location on the northern landward (mainland)side of the 10'boardwalk. The proposed new location would be on the southern side of the 10' boardwalk, approximately 53.2' east from the landward terminus. The structure would be utilized as an emergency fire vehicle storage and expanded to approximately 18' by 14'with a 5' wide slatted deck walkway on three (3) sides. The roofed structure and 5' wide walkway would be positioned outside of mapped§404 wetland, however an additional boardwalk approximately 23'in length needed to connect the structure to the 10'wide boardwalk would be elevated over§404 wetland (see sheet SP-02). The applicant has submifted a check (check No. 10575) in the amount of $100 for the modification request. As proposed,this office has no objection to the proposed project modification as long as there are no objections from other the agencies to this proposal. It appears that the project continues to be CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(5). As discussed, I am emailing you the plan sheets that illustrate the modifications to the marina proper and to the area where the EMS storage building is to be located. As you will see, on Sheets D-1 and 2, the finger piers have been reduced to 4' wide, rather than 6', which reduced the length of Component M-2 by 1000 LF. They also adjusted the length of some of the finger piers. Overall, these changes reduced the footprint of marina. Additionally, during the construction process, it was determined that M-4 was too steep to meet ADA requirements, thus M-4 was reduced by 100 LF. Lastly, on Sheet SP-2, which shows the EMS storage building, which was originally submitted on Sheet A-1, you will see the EMS building has been relocated, to the south side of B-1A. This was due to the Fire Chief requesting the building be enlarged, which required relocating the structure, to avoid shading Section 404 wetlands. A 5' wide boardwalk, which is to be at least 3' above the substrate where crossing Section 404 wetlands, provides access to the building, from B-1A. I don't think this should be an issue, since elevated, pile supported structures, less than 6' wide, are exempt from USACE permitting. Could these changes be processed through a letter of refinement? For the mod. we would need a written request detailing the proposed changes, neighbor notifications indicating no objection to the changes, a copy of the permit (which I can get if needed), and a check for$100 to NC DEQ. These do not cover all variety of modifications though. Typically, if the proposed changes expand the footprint or number of slips then it would be a major modification. If the applicant wants to expand the width of the finger piers from 4'to 6' wide and the extra width could occur within the existing permitted footprint (no expansion)then I think it could be done as a minor modification.
