THIS DEED, made this ` day of April, 2019, by and between:
COUNTY OF CUMBERLAND, a body corporate and politic and a political subdivision of the
State of North Carolina, with a mailing address at P. O. Box 1829, Fayetteville, NC 28302,
hereinafter referred to as "Grantor";
and
THE TRUSTEES OF FAYETTEVILLE TECHNICAL COMMUNITY COLLEGE, a body
corporate under the laws of the State of North Carolina with a mailing address at P. O. Box 35236,
Fayetteville, NC 28303-0236, hereinafter referred to as "Grantee."
The designation Grantor and Grantee as used herein shall include said parties, their
successors and assigns, and shall include singular, plural, masculine, feminine or neuter as required
by context.

WITNESSETH:
That Grantor, pursuant to North Carolina General Statutes § 160A-274 and § 153A-158.2(b),
has and by these presents does grant, bargain, sell, and convey unto Grantee in fee simple
determinable, for so long as Grantee uses the property for its educational programs, those certain lots
or parcels of land situated in Grays Creek Township, Cumberland County, North Carolina, and more
particularly described as follows:
TRACT l:
BEING all of Lot 37 as shown on a plat entitled "A Revision & Recombination of
Lots 40, 41 Sec. II & 42, 43 Sec. I of Cumberland Industrial Center," which is duly
recorded in Plat Book 91, Page 44, Cumberland County, North Carolina, Registry.
TRACT 11:
BEING all of Lot 43 as shown on a plat entitled "A Revision & Recombination of
Lots 40,41 Sec. II & 42, 43 Sec. I of Cumberland Industrial Center," which is duly
recorded in Plat Book 91, Page 44, Cumberland County, North Carolina, Registry.
The property hereinabove described was acquired by Grantor by instrument recorded
in Book 2927, Page 149.
The above described real estate is conveyed to the Grantee for Grantee's educational use and
such other uses as Grantee determines, but only for so long as Grantee does use the property for its
educational programs. Upon Grantee's failure to use the property for its educational programs for a
period of one year, the property shall revert to Grantor.
The property herein conveyed does not include the primary residence of the Grantor.
And Grantor covenants with Grantee, that Grantor is seized of the premises in fee simple, has
the right to convey the same in fee simple, that title is marketable and free and clear of all
encumbrances other than as stated herein, and that Grantor will warrant and defend the title against
the lawful claims of all persons whomsoever, save and except any easements, rights -of -way,
restrictive covenants, or declarations of record; and any matters disclosed by a current, accurate
survey.
In witness whereof, Grantor has caused this instrument to be duly approved by action of its
governing board, duly executed by its duly elected or appointed officers and its seal affixed thereto as
of the day and year first above written.
