Hi David, Thank you for reaching out in regards to the PCN submitted for the Reidsville Energy Center's 404 permit. Please see below for detail in response to your questions, and if it is easier to have a quick call, please do not hesitate to let me know and I'm happy to chat with you. 1. Please see the attached acceptance letter from NCDMS confirming acceptance for the in -lieu fee program issued on 3/18/22. This is based on our previous submittal for which we received 404 approval back in 2017. Attached is our prior DMS acceptance letter. Please let me know if anything else is needed. 2. I have reviewed the information and need clarification before proceeding with verifying the use of Nationwide Permit (NWP) 39 (https://saw- reg.usace.army.mil/NWP2021/NWP39.pdf). Please submit the requested information below (via e-mail is fine) within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the Nationwide Permit or consider your application withdrawn and close the file: 1) Please provide an acceptance letter from the NC Division of Mitigation Services (NCDMS) to confirm they have the correct amount (454) and type (warm water stream) of mitigation credits in HUC 03010103 to satisfy your compensatory mitigation proposal. 2) It appears that an Individual 401 Water Quality Certification (WQC) is required from the North Carolina Division of Water Resources (NCDWR) for this project; please note that the Corps cannot verify the use of any NWP without a valid 401 WQC. This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will expire. It is the applicant's responsibility to send copies of the permits to DMS. Once DMS receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized work.
