DANIEL SMITH Interim Director Joseph P Powell etux Dawn S. 132 Powell Road Beaufort, NC 28516 NORTH CAROLINA Environmental Quality April 14, 2022 Subject: Compliance Evaluation Inspection NPDES General Stormwater Permit NCG190000 Certificate of Coverage NCG190095 NOV#: NOV-2019-PC-0475 Powell Brothers Maintenance Carteret County Dear Mr. and Ms. Powell: On April 14, 2022, Brian Lambe from the Wilmington Regional Office of the Division of Energy, Mineral, and Land Resources (DEMLR), conducted a compliance evaluation inspection for Powell Brothers Maintence located in Sensation Weigh, Carteret County, North Carolina. The site drains to Core Creek (Intracoastal Waterway Adams Creek Canal), which is currently classified as Class SA, HOW Waters in the White Oak River Basin. The following observations and violations and permit condition violations were noted during the DEMLR inspection and file review: 1. Continue to develop and update the SPPP. Ensure that the SPPP requirements are documented yearly, quarterly, and weekly. 2. Bilge water is not allowed to be discharged under this permit. Failure to contain wastewater may result in water quality violations. 3. The facility has implemented analytical sampling requirements. Please review the electronic submittal requirements. 4. The facility is in the process of establishment of best management practices, including: • secondary storage for all liquids • use of tarps and drop cloths to contain sanding, blasting, and scraping debris • solvent management Please be advised that violations of the NPDES Stormwater General Permit may be subject to a civil penalty assessment of up to $25,000.00 per day for each violation. There was an owner/operator grinding bottom work including bottom paint while onsite.Tarping was witnessed on another boat. You cannot discharge any bilge water without first obtaining a wastewater permit. You may be in violation of water quality standards with the discharge of bilge water from any of the ships onsite.
