You have requested a schedule for making partial payments toward the subjected civil penalties totaling
$5,086.26. The Division is agreeable to a monthly payment schedule beginning on May 1, 2022 and
continuing to April 1, 2023. There is Eleven (11) payment of Four Hundred Twenty -Four Dollars
($424.00) to be made once every month and One payment of Four Hundred Twenty -Two Dollars and
Twenty -Six cents ($422.26) as indicated on the attached schedule.
Please sign the attached payment schedule and send it back with your first payment. Make a copy of the
payment schedule for your records. Please make the payments by check payable to the Department of
Environmental Quality and mail them so they are received by the 1st of each month.
Failure to make the monthly payments in accordance with this schedule will cause the entire unpaid
balance of the civil penalty to be due and payable and subject to collection through a civil action in the
superior court.

CIVIL PENALTY ASSESSMENT PAYMENT SCHEDULE

On September 15, 2021 the Director of the Division of Water Resources (DWR) assessed a civil penalty
against you in the amount of $6086.26 including $586.26 in investigative costs, for various permit
condition violations. On March 4, 2022 DWR considered the information you submitted in support
of your request for remission and remitted $1,000.00 of the $6,086.26 civil penalty assessment.
The revised civil penalty was a total amount of $5,086.26. In order to resolve this matter, DWR and
Raymond C. Marlowe have agreed to enter into a payment schedule.
Raymond C. Marlowe agrees to pay the civil penalty assessments totaling $5,086.26 according to the
schedule below as full settlement of Case No. DV-2021-0032.
Raymond C. Marlowe understands that any default in payment or failure to submit payment by the day of
the month in which payment is due will result in the immediate referral of this case to the Attorney General's
Office for collection through the courts. Raymond C. Marlowe also acknowledges that DWR reserves the
right to take enforcement action for future violations within its authority should they occur.
