This firm serves as environmental counsel to Terramor Homes with regard to their
application to the Division of Water Resources ("DWR") for a Section 401 water quality
certification for the Westpoint Residential Development currently under review by the agency.
Based on our review of the record, we understand that: (i) DWR issued a request for additional
information on November 16, 2021, to which Terramor's consultant, Soil & Environmental
Consultants, responded on December 16, 2021; (ii) DWR issued its public notice on December 21,
2021, setting the public hearing for January 20, 2022 and the close of the public comment period
as February 21, 2022; and (iii) in response to DWR's request for extension, the U.S. Army Corps
of Engineers provided a substantial extension to April 15, 2022 of the reasonable period of time
for DWR's certification decision.
We are not aware of any outstanding DWR requests for information, nor any existing
information gaps or other concerns identified by DWR regarding the application, other than those
that have been addressed by Terramor. If DWR, in the course of its application review, the public
hearing, its review of public comments, or otherwise, identifies any issues or questions that have
not already been resolved by Terramor we ask DWR to promptly notify Terramor of all such
matters in order to avoid delay and enable Terramor to provide timely responses.
