PROJECT SUMMARY: This project involves the construction of seven, 6-feet wide wooden elevated walkways that will provide access across wetland areas and to the Pamlico Sound. One walkway will include a kayak/canoe launch platform. FIELD INVESTIGATION REPORT Kinnakeet Shores, LLC, Dare County Page 2 Project Setting The application site is located west of NC 12 on a combined 106+ acre area in Kinnakeet Shores Subdivision in the Village of Avon in Dare County. The project area is located along the Pamlico Sound and Askin's Creek, and is part of the `open space' section of the subdivision. Currently, the Subdivision has one public access kayak platform and water access area for use by the property owners. These `open space' areas consist mostly of coastal marsh and are located between the existing subdivision residential lots and the Pamlico Sound, or Askin's Creek. These marsh areas are vegetated primarily with Juncus roemerianus, Spartina patens, Distichlis spicata, and Spartina alterniflora, as well as Smilax spp., Borrichia frutescens, Myrica cerifera, Iva frutescens and Baccharis halimifolia, and Toxicodendron radicans. Some small isolated high ground clumps exist in these areas and are vegetated with some of the above species as well as Quercus virginiana, Juniperus virginiana, and Magnolia virginiana. Askin's Creek is a coastal creek bordered with coastal and `404' wetland fringes. The Creek water depths are shallow and average approximately 2.5 feet below the Normal Water Level (NWL). Although the creek mouth is almost silted up, upper portions of the creek are approximately 30 feet in width while the lower portions of the creek are over 200 feet in width. Askin's Creek provides an array of estuarine waters and small watercraft public trust area resources (i.e., habitat for fish, crustaceans, wildlife, and good kayak/canoe venue). The waters of the Askin's Creek carry the same water classification as the Pamlico Sound. The North Carolina Environmental Management Commission has designated these waters as `SA' waters (suitable for shellfish propagation and harvesting); however, the waters in this vicinity are closed to the commercial harvest of shellfish. The North Carolina Marine Fisheries and Wildlife Resources Commissions classify the waters of the Pamlico Sound as Coastal Waters. During the site investigation, no shellfish or finfish were observed along the water bottom. The Coastal Resources Commission (CRC) has also designated these waters as Estuarine Waters and Public Trust Areas of Environmental Concern (AEC). Also under the designation of the CRC, a Coastal Shoreline AEC extends in a contour of 75 feet landward of the NWL. The CRC has also designated coastal wetland vegetated areas, like those described above, as Coastal Wetland AEC. Project Description The applicant proposes to provide additional water access for the residents, property owners and guests of the Kinnakeet Shores Subdivision. The proposed improvements include seven wooden elevated walkways. One of these, located on Askin's Creek, will include a kayak platform access. Three of these structures will not be located directly along a shoreline but will provide access across interior wetland areas to high ground paths that will eventually re-connect to another proposed walkway structure that will directly access the waters of the Pamlico Sound. ' FIELD INVESTIGATION REPORT Kinnakeet Shores, LLC, Dare County Page 3 The proposed walkway structures will be 6 feet wide and elevated a minimum of 3 feet above the wetland ground elevation surface. The structures will also include steps either where . applicable to provide, the necessary elevation or access over wetland areas, or to the proposed water access sites.. Proposed walkways are numbered from one through seven. A dimension breakdown of these structures are given in the bullets below: (1) 245 feet x 6 feet = 1,470 square feet (2) 50 feet x 6 feet = 300 square feet (3) 210 feet x 6 feet = 1,260 square feet (4) 265 feet x 6 feet = 1,590 square feet (5) 200 feet x 6 feet = 1,200 square feet (6) 635 feet x 6 feet = 3,810 square feet (7) 12 feet x 6 feet = 72 square feet This structure will also have a 20-feet x 6-feet `T' platform to serve as a kayak canoe launch. Total Area of Wetlands Shaded is approximately 9,702 square feet. Structure (7), as referenced above, will include a platform that will extend 6 feet into Askin's Creek and will not extend beyond the one-fourth water-body width rule restriction. As referenced above, where applicable, high ground pathways to these walkways will be mulched with woodchips and be 8 feet in width. Anticipated Impacts The anticipated impacts from this project are mostly associated with the shading of coastal and other wetlands from the proposed elevated walkways. The total of area of wetland shaded is given in the above section. The proposed kayak launch platform will also shade 120 square feet of Estuarine Waters and Public Trust Area. Page 4 The proposed work will not result in any excavation of waters or wetlands and will not interfere with any adjacent riparian access. The proposed project will result in some temporary turbidity in adjacent wetlands and waters associated with the site work and placement of support pilings for the proposed structure. The proposed structure will provide riparian access to the waters of the Pamlico Sound and Askin's Creek. The type of watercraft proposed in this project will also increase the opportunity for the public to enjoy the coastal resources of the area while minimizing impacts to the adjacent waters that could be expected from motorized watercraft. The proposed improvements include seven (7) wooden elevated walkways with three (3) sets of steps; a kayak platform to access an interior creek within the southern portion of Kinnakeet Shores Resort (see attached plat, kayak platform area labeled number 7). The proposed seven (7) wooden elevated walkways are 6 foot wide and elevated a minimum of three (3') feet from the wetland surface. Three sets of steps are proposed over existing areas of rock rip rap along the shoreline to access the Pamlico Sound. Steps continue from the elevated boardwalk over the existing rip rap five feet waterward of the NWL. Water depth is approximately 0.5" Total disturbance within 75'AEC = 2,517 s.f. (elevated walkways and wood chip path); Total disturbance within 30' Buffer = 730 s.f. (elevated walkways). This project does not propose any wetland fill (Section "404" or coastal). Section "404" wetlands were delineated for Kinnakeet Shores Resort by Budd Needham and confirmed by US Army Corp of Engineers, Tom Walker (signed wetland plat 4-27-01). AU proposed elevated walkways are accessing from and to highground through coastal wetlands. Since coastal wetlands are prevalent along the soundfront portion of Kinnakeet Shores Resort, all current and previous projects within Section "404" and coastal wetlands are confirmed by the Division of Coastal Management, Dennis Hawthorne during pre-application and consistency meetings with AEC. Therefore, coastal wetlands have not been delineated at this time, however, coastal wetland alignment will be confirmed by DCM before (Page 2 of 2) construction takes place. This project does not proposed any disturbance within coastal wetlands other than temporary disturbance during construction of the walkways. The proposed project will allow Kinnakeet Shores Resort landowners to access areas of the Pamlico Sound and an interior portion of estuarine shoreline by kayak and foot paths (walkways) to enjoy the natural surroundings and wildlife abundant in this subdivision and shoreline. It is the interest to Kinnakeet Shores Resort, LLC to create passive accesses within Kinnakeet Shores Resort to preserve natural settings that exist within this residential subdivision.
