The Division of Water Quality (the Division) hereby issues this permit modification for the subject
facility. This permit is issued pursuant to the requirements of North Carolina General Statute 143-
215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental
Protection Agency dated May 9, 1994, or as subsequently amended.
Attached, please find permit change pages. Insert these pages into your existing permit and discard the
old pages.
Per your written request of October 12, 2006, the Division has included in this permit your
conjunctive use Spray Irrigation Disposal System Permit (WQ0022384). The Division has also
extended the permit's expiration date from May 31, 2008 to January 31, 2010. We provide this
extension so that Contentnea MSD may initiate and complete planning, scheduling, funding and
construction of treatment -system upgrades needed to comply with the existing permit.
Please notice that this remains a "phased" permit (two effluent pages) with different permit limits for
each phase, and that the significant changes in limits and monitoring requirements key on the date,
November 1, 2009. On that date, Contentnea must meet more stringent requirements for discharge
under receiving -stream zero -flow conditions [permit Section A. (2.)], or shall have extended its outfall
to the mainstem of Contentnea Creek where more dilution is available [permit Section A. (1.) b.)].
Reminder: Compliance with your effluent chlorine limit of 28 µg/L begins on June 1, 2007, as required by your
permit issued/effective in January 2006. Facilities capable of limit compliance and monitoring to this level must
be operational and in use by June 1, 2007 to prevent permit limit violations and subsequent enforcement actions.

If any parts, measurement frequencies or sampling requirements contained in this permit modification
are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be a written petition conforming to Chapter
150B of the North Carolina General Statutes, filed with the Office of Administrative Hearings (6714
Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision
shall be final and binding.
This permit is not transferable except after notifying the Division of Water Quality. The Division may
require modification, or revocation and re -issuance of this permit. Please notice that this permit does
not affect your legal obligation to obtain other permits required by the Division of Water Quality, the
Division of Land Resources, the Coastal Area Management Act, or other federal or local
governments.

In compliance with the provisions of North Carolina General Statute 143-215.1, other lawful standards
and regulations promulgated and adopted by the North Carolina Environmental Management
Commission, and the Federal Water Pollution Control Act, as amended,
Contentnea Metropolitan Sewerage District
is hereby authorized to discharge wastewater from a facility located at the
Contentnea MSD WWTP
NCSR 1910, Grifton
Pitt County
to receiving waters designated as an unnamed tributary of Contentnea Creek within the Neuse River
Basin in accordance with effluent limitations, monitoring requirements, and other conditions set forth in
Parts I,II,DI, and IVhereof.
The permit shall become effective on March 1, 2007.
This permit and the authorization to discharge shall expire at midnight on January 31, 2010.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked, and as of this issuance, any previously issued permit bearing this number is no longer effective.
Therefore, the exclusive authority to operate and discharge from this facility arises under the permit
conditions, requirements, terms, and provisions described herein.
Contentnea Metropolitan Sewerage District
is hereby authorized to:
1. continue to operate an existing 2.85 MGD wastewater treatment facility consisting of
• grit removal
• two (2) activated sludge units
• clarifiers
• chemical phosphorus removal system
• methanol storage and feed system for enhanced denitrification
• chlorine contact chamber
• post -aeration basin
• aerobic sludge digester and sludge drying beds,
located at the Contentnea MSD WWTP on NCSR 1910 in Grifton, Pitt County, and
2. construct and operate a wastewater conjunctive reuse Spray Irrigation Disposal System under
Permit WQ0022384, and
3. discharge from said treatment works, at the location specified on the attached map, to an
unnamed tributary of Contentnea Creek, a class C-Swamp NSW waterbody within the Neuse
River Basin, and
4. upon receiving an Authorization to Construct (ATC) permit, construct a new outfall into
Contentnea Creek, and
5. discharge treated wastewater from said treatment works to Contentnea Creek, a class C-
Swamp, NSW waterbody within the Neuse River Basin.

according to the effluent limitations and monitoring conditions in Part A. (1.) a.) above.

1. Sample Locations: I — Influent; E — Effluent; U — Upstream at NCSR 1800; D- Downstream at Jolly's Old
Field Landing. Upstream and downstream samples shall be grab samples.
2. Monthly average effluent BOD5 and total suspended solids (TSS) concentrations shall not exceed 15% of
their respective influent value (i.e., 85% removal is required).
3. Total Residual Chlorine shall be monitored only if the facility uses chlorine. The chlorine limit shall
become effective June 1, 2007.
4. Quarterly average for Total Phosphorus shall constitute the average of composite samples collected weekly
during each calendar quarter (January -March, April -June, July -September, October -December).
5. For a given wastewater sample, TN = TKN + NO3 N+NO2 N, where TN is Total Nitrogen, TKN is Total
Kjeldahl Nitrogen, and NO3 N+NO2-N are nitrate and nitrite nitrogen, respectively.
6. TN Load is the mass quantity of Total Nitrogen discharged in a given period of time. See Special Condition
A. (3.), Calculation of TN Loads.
7. Compliance with this limit shall be determined in accordance with Special Condition A. (4.) of this permit,
Annual Limits for Total Nitrogen.
8. Cyanide — The Division shall consider all cyanide values reported below 10 µg/L to be "zero" for compliance
purposes only. However, the Permittee shall record on DMRs all values reported by a North Carolina -certified
laboratory (even if these values fall below 10 µg/L), and the Permittee shall use these reported values to
calculate averages, if any, as required by the permit.
9. Mercury Monitoring — the Permittee shall monitor Total Mercury in accordance with field and laboratory
procedures specified in EPA Analytical Method 1631E.
10. Chronic Toxicity (Ceriodaphnia) P/F @ 11 %, January, April, July, and October [see A. (6.)].
11. Variable Stream Sampling — Stream samples shall be taken three times per week during the months of .
June, July, August and September, and weekly during the remainder of the year. As a participant in the
Lower Neuse Basin Association, Inc. (LNBA), the subject facility is not responsible to conduct instream
monitoring. Should the Permittee terminate its membership in the Association for any reason, the Permittee
shall immediately notify the Division in writing and immediately assume stream sampling requirements as
described herein.

The Permittee applied for modification in April 2006, and the Division complied in June
with draft documents for the Permittee's review. However, the Permittee failed to submit
the required fee ($860) for a major permit MOD. A fee must be submitted before the
Division may accept the application and submit changes for Public Notice.
On October 12, 2006 the Permittee submitted a check for $860.00 and in addition,
requested the Division to consider their conjunctive reuse of wastewater under Permit
WQ0022384. The Division complied by adding reference to this permit under the
NPDES permit Supplement to Cover Sheet.
On 01Nov06, I submitted revised draft documents for processing and Public Notice on
08Nov06. I also sent copies to the Washington Regional Office. The Division has added a
note to the cover letter reminding the Permittee that its chlorine limit of 28 µg /L
becomes effective on June 1, 2007.
Considering that the Division has received no public comments on the permit
modification, as drafted, the NPDES Program hereby issues this permit modification.

The Permittee applied for modification in April 2006, and the Division complied in June
with draft documents for the Permittee's review. However, the Permittee failed to submit
the required fee ($860) for a major permit MOD. A fee must be submitted before the
Division may accept the application and submit changes for Public Notice.
On October 12, 2006 the Permittee submitted a check for $860.00 and in addition,
requested the Division to consider their conjunctive reuse of wastewater under Permit
WQ0022384. The Division complied by adding reference to this permit under the
NPDES permit Supplement to Cover Sheet.
On 01Nov06, Joe submitted revised draft documents for processing and Public Notice on
08Nov06. He also sent copies to the Washington Regional Office. Since there are only
minor changes to the previous draft of June 7, 2006, the Division will not forwarded
these drafts to EPA Region 4, but will provided a copy of the permit final when issued.

Background
Receiving -Stream Zero -flow Conditions. During previous permit cycles, the Permittee has
discharged with the understanding that they controlled a designated effluent channel and considered this
channel part of their treatment system. However, the Division determined that this discharge feature
does not qualify as an "effluent channel" under state rule 15A NCAC 02B.0227 (see DWQ's letter to
the Permittee dated 28Nov05). The Division therefore determined that the Permittee discharges to
waters of the state under "zero -flow" conditions.
The Division altered the permit to meet stricter limits for BOD5 and ammonia considering zero -flow
conditions and the potential need for advanced treatment (see Existing Phased Permit below).
Furthermore, zero -flow conditions forbid flow expansion at the current outfall location. Compliance to
`zero -flow' conditions is mandatory, except that the Permittee may relocate the outfall to the main -
stem of Contentnea Creek to achieve better dilution. The Permittee was warned of this eventual
determination in the 2001 permit issuance cover letter.
Considering the above, the Division revised the permitted outfall description to read: an unnamed
tributary of Contentnea Creek, and relocated Outfall 001 to: Lat. 35° 21' 20" N; Long. 77° 24' 58" W
(Previous Outfall: Lat. 35° 21' 06" N; Long. 77° 24' 58" W).
Existing Phased Permit. The Division "phased" this permit (two effluent pages) to provide a
compliance schedule wherein the Permittee may install advanced treatment or move the outfall [see
permit section A.(1) a. and b. and section A.(2)]. Phase I permit limits reflect conditions to be met
following expiration on November 1, 2006 of Special Order by Consent, EMC SOC WQ SO4-005.
According to the active permit, if "zero -flow" issues are not resolved by November 1, 2006, the permit
shall revert to stricter limits under phase II [Permit Section, A. (2)].
Permit Modification
Rationale. This modification extends the compliance date of November 1, 2006 to November 1,
2009. This modification intends to provide sufficient time for funding, Authorization to Construct
(ATC) permitting, project bidding and awarding, scheduling, constructing, testing; and finally DWQ
inspection and approval of new facilities.
New Dates. Because the new key compliance date of November 1, 2009 exceeds the expiration date of
the current permit (May 31, 2008), the Division will extend expiration to January 31, 2010. At
expiration, the subsequent permit renewal will revert to the Division's five-year cycle Basinwide
Schedule for the Neuse River. Permits in this subbasin will; expire May 31, 2013 (for this facility, a
three-year permit).
The Permittee's current compliance is also governed by Special Order by Consent (SOC WQ04-005
Ad.1) including a milestone of December 1, 2006 whereby Contentnea shall comply, by this
date, with all permit limits and monitoring requirement set forth in active permit Section A.

Dear Mr. Vinzani::
Since the year 1975 the Contentnea Metropolitan Sewer District (CMSD) operated its
2.85 mgd plant and discharged its effluent into Contentnea Creek through an effluent
canal, designed to carry the plant effluent and storm drainage from the plant site.
On November 28, 2005, the Division of Water Quality (DWQ) has determined under the
Rule 15 A NCAC 02B.0227 that the CMSD's current effluent channel, as built, is not a
treatment system component isolated from the natural environment and therefore it is
considered as waters of the state classified C-SW; NSW, with zero flows (7 Q10 and 30
Q2 = 0.0 cfs) conditions. This determination resulted in issuance of the subject NPDES
Permit with modified permit limits and monitoring requirements that are phased to
provide a compliance schedule for CMSD to either 1) upgrade the plant, or 2) extend the
outfall to Contentnea Creek's mainstream to achieve better dilution.
CMSD is currently operating under Special Order by Consent (EMC SOC WQ SO4-005).
As per item no. 2 (c) 8 of the SOC, the CMSD is required to prepare and submit an
engineering evaluation of future wastewater treatment needs with a plan and schedule to
address those needs on or before August 1, 2006. The CMSD has engaged the services of
The Wooten Company to prepare the Engineering Report for evaluating the current and
future wastewater treatment needs and submit the report to the NCDWQ on or before the
SOC scheduled date of August 1, 2006. Considering the projected growth in the CMSD
service area, it is anticipated that the plant upgrading and expansion, including providing
denitrification filter system and effluent outfall, will be necessary. The CMSD plans to
finance the needed plant upgrading and expansion using the low interest SRF loan from
the Construction Grants and Loans Section of DWQ.
CMSD is committed to extend the effluent outfall to Contentnea Creek's mainstream, as
suggested by the DWQ. However, considering the factors such as: (1) ongoing
engineering evaluation for plant upgrading and expansion, including denitrification filter
needs, (2) integration of the required effluent outfall design with anticipated proposed
plant upgrading and expansion, (3) obtaining low interest SRF loan from the
Construction Grants and Loans Section of DWQ for financing proposed plant upgrading
and expansion, and (4) time involved in getting approval of Engineering Report and Plans
and Specifications and construction of proposed plant upgrading and expansion with
denitrification filtration system and new effluent outfall to Contentnea Creek, it will be
impossible for CMSD to comply with the Effluent Limitations and Monitoring
Requirements listed in Table A (2) of the NPDES Permit. In order for us to determine a
more realistic schedule, we sought the input from Mr. Dan Blaisdell with Construction
Grants and Loans Section and following compliance schedule was determined to be
appropriate for CMSD.
1. On or before August 1, 2006, prepare and submit an Engineering Report
evaluating future wastewater treatment and effluent outfall needs with a plan
and schedule to address those needs (required by the current EMC SOC WQ
SO4 005).
2. On or before July 31, 2007, obtain approval of the Engineering Report and
subsequently file an NPDES Permit modification application for expanded
flow.
3. On or before April 30, 2008, prepare and submit plans and specifications for
approved wastewater treatment system and effluent disposal outfall
improvements.
4. On or before January 31, 2009, obtain an Authorization to Construct Permit
for approved wastewater treatment system and effluent disposal outfall
improvements.
5. On or before May 15, 2009, begin construction of the approved wastewater
treatment system and effluent outfall improvements.
6. On or before November 15, 2010, complete construction of the approved
wastewater treatment system and effluent outfall improvements.
7. On or before May 15, 2011, achieve compliance with the effluent limitations
included in new NPDES Permit for expanded flows.
Recognizing the above compliance schedule and CMSD's commitment of extending the
effluent outfall to Contentnea Creek's mainstream as a part of providing the needed plant
upgrading and expansion improvements, it requested that the current NPDES Permit be
modified for the following:
1. A.(1) Effluent Limitations and Monitoring Requirements
a. Beginning on the effective date of this permit and lasting until
construction of a new effluent outfall to Contentnea Creek or
expiration, the Permittee is authorized to discharge treated
wastewater from Outfall 001 into an unnamed tributary of
Contentnea Creek. Such discharges shall be limited and monitored
by the Permittee as specified below:
2. Delete Table A.(2) Effluent Limitations and Monitoring Requirements.
Considering the CMSD plant has been in operation since 1975 with the effluent channel
discharging into Contentnea Creek and the CMSD commitment of providing new effluent
outfall to Contentnea Creek as a part of the upcoming plant upgrading and expansion,
yours and Mr. Al Hodge's assistance in modification of the current NPDES Permit will

Marshall — this is a "heads up" for a major permit MOD (received DWQ/NPDES in April
2006) soon to be sent to Public Notice. The Permittee has asked us for more time to
accomplish the necessary upgrades required by the current permit on November 1, 2006.
These include extending their outfall. They've sighted as reasons for their duress the
required scheduling, planning, funding, permitting and constructing, and further suggest
a pending request to expand. They've asked for 5 years — we're drawing a line in the sand
at about 2 /2 years, after much negotiating.
You may have record of their permit renewal, affective December 2005. We will supply
the complete MOD review package to you at the time of Public Notice — June 7, 2006.

The Contentnea MSD is in receipt of the final permit for this facility and understand that
this permit goes into effect January 1, 2006 and is effective until midnight on May 31,
2008. I would like to thank you for the meeting between the CMSD and NCDWQ in
October 2005 to discuss this permit and the effluent channel.
I have spoken with engineers from The Wooten Co., Joe Corporon, P.E. (NCDWQ) and
Al Hodge, P.E. (NCDWQ) and I do not believe that the CMSD can meet the effluent
limits that go into effect November 1, 2006. The CMSD is currently under SOC and a
requirement of that agreement is to provide a 201 update for this facility. We are
currently working on that plan and considering our options for upgrade/expansion. Our
board of directors will be making final decisions on this matter in the coming months. I
do not believe that 11 months provides the CMSD sufficient time to design, receive
approval of plans, bid and construct the necessary pipeline to meet compliance with
section A.(2) of the new permit. I would like to arrange a meeting between the CMSD,
our engineering representatives, and NCDWQ to further discuss this matter and construct
a timeline that is feasible.
