Good morning All,
On February 18, 2022, the Division of Water Resources (DWR) received your 401 permit application
to allow for impacts associated with the construction of a road within wetlands, installation of a
water line, and construction of an amenity pond for stormwater control within a proposed
residential subdivision at 541 McLamb Road NW, near Calabash, Brunswick County, North Carolina
adjacent to Hickmans Branch (C;Sw). The Division of Water Resources (DWR) has additional
questions regarding the proposed development and has determined that additional information will
be necessary to complete the review of your permit application. The application is on hold until all
of the following information has been received by our office.
The submitted ePCN application does include drawings that detail the impacts associated with the
amenity pond construction. The submitted plan drawing (attached) does not show the areas where
the excavation will occur and conversely shows a lot layout that would require fill of the RPWs
onsite. Please clarify.
It appears that additional impacts to streams and/or RPWs are shown on the plan that have not
been accounted for in the application. Please see the comments on the attached plan and respond.
The application lacks the information necessary to verify whether this is a single and complete
project, the application states this is a phased development. No information has been presented on
the proposed impacts associated with the development of the contiguous parcel of land ( South
Carolina tract) where subdivision roads will be extended and impacts can be anticipated. There are
no lot numbers, no stormwater information, no utility information, no identified attendant features,
etc. Based on the absence of project details and the applicant's statement regarding phased
development and the submitted plan drawings, there are reasonably foreseeable future impacts
associated with the development of the project.
These future impacts along with those not accounted for on the submitted application will likely
exceed the threshold for impacts associated with the NW permit 29 and the corresponding water
quality certification, therefore requiring an Individual Permit from both the USACE and the DWR.
Please clarify the inconsistencies in the application and submit a drawing that clearly depicts all of
the impacts proposed with the complete build out of the proposed subdivision. Feel free to call or

David,
I'm coordinating the Permit with Holly on this project, I have a question about the feature that runs
to the east of Pond F and then there's another feature that runs to the west of Pond J.
They show up on Lidar as potential tributaries, but they are not located or called out in the wetland
delineation.
What are these two features?
Based on Lidar it looks like pretty much all of the site is uplands, which is amazing especially for
Brunswick County.
Was the SC portion of this project submitted to the SC district office for their review?
