Sullins, Director Division of Water Quality DWQ Project # 07-0432v2 New Hanover County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Cert. # 7005 1820 0002 0151 4617 Mason Landing Yacht Club, LLC Attn: Mr. Steve Saieed 3317 Masonboro Loop Road, Suite 150 Wilmington, NC 28409 Subject Property: Mason Landing Yacht Club, LLC Middle Sound -Intracoastal Waterway (Sa, ORW) REQUEST FOR MORE INFORMATION Dear Mr. Saieed: On June 29, 2007, the Division of Water Quality (DWQ) received your application dated June 20, 2007, to impact 1.7 acres sound to excavate the existing boat basin and access channel to original depths. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or waters on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will. place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: This Office has concern with the proposed excavation plans. The canal or boat basin shall be permitted to be dredged only to its original depth and width. Sheet 3 of 4 and Sheet 4 of 4 (Cross Sections A and B) both depict the proposed grade to be -6.0 MLW. The original permits were issued for excavation of the channel to -5.0 MLW, with the exception of the Dec. 20, 1982 map depicting the proposed channel bottom to be -6.0 MLW with a 20-foot wide channel. Please provide a map accurately depicting the "original" depths and widths. 2. Please conduct elutriate testing of the substrate in the existing boat basin for cadmium (Cd), lead (Pb), mercury (Hg), zinc (Zn), copper (Cu), nickel (Ni), chromium (Cr), and arsenic (As). Heavy metals are found in paint particles, metal shavings, engine oils, bilge water, and runoff from maintenance and repair areas. These metals accumulate in the sediments in and around boatyards and marinas and if they are present at elevated levels, dredging and disposing of the dredged material must be handled in such a way as to prevent water quality degradation. This is especially important since Middle Sound is designated as an Outstanding Resource Water (ORW).
