Hello Mr. Wilson,
On February 22, 2022, the Division of Water Resources (Division) received your application requesting a 401 Water
Quality Certification from the Division for the subject project. An email containing instructions to submit the required
application review fee was sent on February 23, 2022. The Division has determined that your application is incomplete
and cannot be processed. The application is on‐hold until all of the following information is received:
1. A signed and dated copy of the Agent Authorization letter must be submitted if the Agent has signed this
application form. (A form can be downloaded here:

2. The Division has not received the application review fee. The application is not complete until the fee is
received. Please ensure the application review fee is paid. [15A NCAC 02H .0502(a)(10)]
3. Please provide a site plan showing the property boundaries, structures (buildings, docks, impervious surfaces,
etc.), location of the shoreline, location of the impacts to the shoreline and/or lake bottom (excavation,
dredging, rip rap, retaining walls, etc.), and the location and area (sqft) of any vegetated areas that will be
impacted within Zone 1 and Zone 2 of the Catawba Riparian Buffer Rule. [15A NCAC 02H .0502(a)(9)]
4. Please locate all protected riparian buffers as overlays on the site plan, clearly showing Zone 1 and Zone 2. [15A
NCAC 02B .0611(b)(1)(f)]
5. Please provide an elevation plan showing the approximate location of rip rap or fill to be placed above and
below the Full Pond/ Normal Water Level elevation. The template located on pages 4‐5 of the help document
linked below may be used to assist with this requirement. [15A NCAC 02H .0502(a)(9)]

6. Please provide a photograph of the shoreline/ buffer proposed to be stabilized.
7. Indicated in section D.2. of your PCN are impacts of 0.100 acres to wetlands. Impacts typically associated with
shoreline stabilization projects along Lake Rhodhiss would be considered impacts to Open Waters. Please
confirm the type of impacts proposed for this project.

8. Indicated in section D.6. of your PCN are impacts to both Zone 1 and Zone 2 of the Catawba Buffer. Impacts to
Zone 2 of the Catawba Buffer are atypical when work is performed from barge. Please confirm the type of
impacts proposed for this project.
The 50‐foot buffer is split into two zones.
‐Zone 1 extends from full pond level landward a distance of 30 feet, measured horizontally on a line
perpendicular to the lake.
‐Zone 2 begins at the outer edge of Zone 1 and extends landward 20 feet as measured horizontally on a
line perpendicular to the lake
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please respond in writing within 30 calendar days. If all of the requested
information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the
application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division
for approval, including a complete application package and the appropriate fee.
