Hi Colleen,
Thank you for your review comments and requests for additional information. Below are your comments along with our
responses:
1) It appears that the impacts occur on the next parcel over, 500 Creekside Drive. According to Wake County
GIS, 500 Creekside Drive is owned by Seven Properties BDM LLC/JAD Industrial LLC. Permission from the
property owner must be obtained. Please provide evidence of permission. [15A NCAC 02B.0611(b)(1)(B)]
Response: We have obtained permission from the owner of the abutting parcel for the performance of the
proposed work. A copy of a letter documenting permission is attached.
2) The requested impacts do not appear to meet dispersed flow requirements for stormwater runoff through
the buffer. It is unclear if these impacts fall under one of the Deemed Allowable or Allowable Upon
Authorization stormwater conveyances defined in the Neuse Riparian Buffer Rules Item 9 [15A NCAC 02B
.0714(9)]. I've attached a copy of the Neuse Riparian Buffer Rules to this email. Please provide more details
to support which entry under Item 9 this work would fall under. [15A NCAC 02B.0714]
Response: The proposed activity and impact is Allowable Upon Authorization. The proposed impact falls into
the category described in Neuse Riparian Buffer Rules Item 9 [15A NCAC 02B .0714(9)(ix), "New drainage
conveyances where the drainage area to the conveyance has no new built -upon area as defined in 15A NCAC
02H .1002 and the conveyance is necessary for bypass of existing drainage only." The proposed piping and
structures serve the sole purpose of correcting an existing drainage problem by collecting surface runoff from
existing built -upon areas and routing it to the receiving armored channel, bypassing areas of higher ground
occupied by existing utilities that obstruct the natural surface flow.
3) Please provide additional details regarding avoidance and minimization of buffer impacts for this project and
why it cannot be practically reconfigured or redesigned to better minimized or avoid disturbance to the
buffer. [15A NCAC 02B .0611(b)(2)(B)]
Response: The area of the ponding problem that the proposed piping and structures is proposed to alleviate is
separated from the receiving armored channel by an existing City of Raleigh sanitary sewer outfall and
associated easement. The route of the proposed bypass pipe must cross the sewer easement. Our initial
design proposed an acute angle crossing of the sewer easement in order to minimize the area of the riparian
buffer and overlapping greenway easement that would be impacted. The City of Raleigh, upon review of the
proposed plans, stated "Longitudinal runs of private storm pipe & associated easements are not allowed
across CORSSEs. Realign new storm pipe with SDMHs just outside north & south CORSSE lines such that a
(near) perpendicular crossing can be achieved, then turn storm drain parallel to sanitary sewer to discharge
into stone basin on south side of CORSSE." We revised the plan as required by the City taking care to route
the piping and structure as close as practicable to the existing sanitary sewer easement —thereby minimizing
the area of the riparian buffer to be impacted. The plan as currently proposed reflects our efforts of
minimization and avoidance.

the review, some additional information is required:
