From the impact maps, it appears these impacts are for riprap. Is this correct? 2) It looks like there should be Mitigation SOAs and/or Completed Compensatory Mitigation Responsibility Transfer Forms in Appendix D of the PCN attachments, but I'm not seeing them. Can you please submit the Mitigation forms? 3) The Buffer Determination for this project was performed in 2016, which is more than 5 years ago. The Impacts Maps attached show the revisions made in June 2020 at the request of the United States Fish and Wildlife Service (USFWS) and the USACE. The revisions included adding "Permanent No Loss" stream impacts for riprap added to Impacts 1, 2A, 3A, and 6. The impact maps were approved by the USACE and DWR in June 2020. In addition, the impact maps have been revised to show directional boring at former Impact 10A per request from the USFWS on December 21, 2021. This response was sent to the USFWS and USACE on January 26, 2022. Other than the removal of impact 10A, all impact amounts remain the same as reported in the Pre -Construction Notification (PCN) application dated 11/15/2021. Additionally, the Stream and Buffer Mitigation Statements of Availability (SOA's) and payment invoices have been included in this response. The comments are outlined below in italics and are grouped by impact, with DWR comments in green. Our response is below each comment. 1. It looks like Stream Impacts 10-13 were not included on the previous application. From the impact maps, it appears these impacts are for riprap. Is this correct? Impacts 10-13 in the PCN (portions of impacts 1, 2A, 3A, and 6 on the Impact Maps) were included in a revision requested by the USFWS and USACE received on June 3, 2020 in order to better protect the associated streams from potential erosion. These impacts are "Permanent No Loss" stream impacts for proposed riprap velocity dissipator pads to be embedded within the stream channel. Both the USACE and DWR were consulted via phone and email regarding the revision and no formal revision was required as velocity dissipator pads do not count as a loss. The impact maps were updated and sent to the USACE and DWR via email on June 23, 2020. A copy of this email is included in the attachments. ENGINEERING I DESIGN I TECHNOLOGY 2. Total permanent impacts have not changed, but an additional 88-ft of permanent, no loss stream impact associated with dissipator pads has been added. Updated Impact Plans reflecting the adjustments are attached. The USFWS reviewed my concurrence request and provided the following comments: 1. Two of the culverted crossings areas sloped at a very high grade. The plan drawings do not appear to show any velocity dissipation devices. The Service recommends that the applicant be required to slow the velocity of flow through the culverted crossings through minimally-impactful methods, such as baffles inside the culverts. Drop boxes may also be appropriate, depending on the location and function of the stream. 2. In order to avoid and minimize erosion on the project site, the Service recommends that the applicant leave individual lots vegetated until construction on that particular lot is ready to occur. I do ask that you provide this information to the design engineer and/or applicant. Please note that I plan to issue the permit here in just a bit, but considering her comment/request to use velocity dissipation devises, I will put a sentence in the verification that allows for this type of activity (simply because it is not considered a loss). If there are any changes to the design drawings/impact lengths, please provide those so I can add the information to our database (it will not require a new permit submittal). 2 Please let me know if you have any questions.
