Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statutes 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). This revised permit includes the following changes from the City's current permit: Weekly average limit for arsenic has been deleted from this permit because this parameter presented no reasonable potential to exceed the water quality standard based on a statistical analysis of the effluent data. The City should continue to monitor arsenic through the LTMP in the pretreatment program. Please note that the weekly average and daily maximum limits for cyanide remain in the permit because cyanide presented reasonable potential to exceed water quality standards based on the statistical analysis of the effluent data. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. CHRONIC TOXICITY PERMIT LIMIT (QUARTERLY) — 5.0 MGD The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 56 %. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedures" Revised February 1998, or subsequent versions or `North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised - February 1998) or subsequent versions. The tests will be performed during the Months of March, June, September and December. Effluent sampling for this testing shall be. performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure, performed as the first test of any single quarter, results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months, as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. • The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions.All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent to the following address: Attention: NC DENR / DWQ / Environmental Sciences Section 1621 Mail Service Center Raleigh, North Carolina 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirementor tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. The annual effluent pollutant scan samples shall represent seasonal (summer, winter, fall, spring) variations over the 5-year permit cycle. Unless otherwise indicated, metals shall be analyzed as "total recoverable." DENR / DWQ / NPDES Unit AMENDED FACT SHEET FOR NPDES PERMIT DEVELOPMENT NPDES Permit NC0036196 INTRODUCTION The City of Newton Treatment Plant (WWTP), herein called Newton or the permittee, requires a National Pollutant Discharge Elimination System (NPDES) permit to discharge treated wastewater to the waters of the state. The permittee's 5-year NPDES permit expires at midnight on July 31, 2010, and Newton has requested permit limits modification from the Division of Water Quality. This Fact Sheet summarizes background information and rationale used by the Division's NPDES Unit to determine permit limits and monitoring frequencies revision. FACILITY DESCRIPTION Newton is a publicly owned treatment works (POTW) utilizing a Grade IV wastewater treatment facility to treat domestic and industrial wastewater. The treatment system utilizes a mechanical bar screen, two aerated grit chambers, two primary clarifiers, four aeration basins, three secondary clarifiers, dual media filters, dual chlorination units, four gravity sludge thickeners and post aeration. Newton has active pre-treatment program with a Long Term Monitoring Plan and has seven non -categorical significant industrial users and two categorical industrial users. The facility has a existing 5.0 MGD wastewater treatment facility, with expansion phase to 7.5 MGD. BASINWIDE PLAN The City of Newton — Clark Creek WWTP discharges into Clark Creek in the Catawba River Basin. The stream classification of this segment of the Clark Creek is C. Clark Creek is listed on North Carolina's 2006-303(d) list of impaired streams. That stream segment is impaired for biological integrity. (North Carolina 303(d) List, 2006). TOTAL RESIDUAL CHLORINE (TRC) The permittee currently uses chlorine for disinfection. The Division has implemented TRC policy to protect aquatic life in the waters of the State and has adopted aquatic life standard for TRC. A TRC limit of 28 ug/1 and 26 ug/L should be continued in the permit for 5.0 MGD and 7.5 MGD respectively. REASONABLE POTENTIAL ANALYSIS (RPA) To establish a list of pollutants of concern (POCs), the Division examined Newton's two years of pretreatment data, Discharge Monitoring Reports, and the basin plan. The Division then applied the reasonable potential analysis to calculate a maximum predicted concentration for each POC. Each maximum predicted concentration was then compared to the POC's freshwater standard/criterion or allowable concentration considering dilution. If by this method, a POC showed reasonable potential to exceed its standard or criterion, the Division included a limit in the permit as a weekly average to protect the receiving stream against chronic toxicity impact, and as a daily maximum against acute toxicity impact. A reasonable potential analysis was performed on the following parameters: copper, cyanide, and zinc. Results and data analysis are attached. RPA RESULTS: Based on the results of the Reasonable Potential Analysis: • Limit and monitoring for arsenic should be deleted. Arsenic results had fifty-five (55) reported values and all were below detection. No RPA was performed on arsenic parameters. • Limit and monitoring for cyanide should be continued in this permit. RPA results showed the maximum predicted concentrations exceeding the allowable concentration. Some of the testing results from Pace Analytical used in the RPA are documented as flawed. The Division has recognized these results as unreliable. I also have a copy of a client letter that attempts to explain the cyanide testing problems. These extremely high results as documented by split sampling have to be removed from the RPA calculation. Therefore the City requests that 10 of the 57 Pace Analytical results be stricken from RPA consideration and all of the Meritech (72) results that happen to be below detection level be used in this determination. I have attached a summary of all of the cyanide testing for your consideration. As directed by the Division (March 16, 2006) the City of Newton staff has collected the required twelve months of effluent total copper samples to request a permit modification to remove copper monitoring from permit NC0036196. Because the City requested for limit modification, I had to review all the pollutant of concern at the facility and when the review was completed, zinc had to be added because it showed reasonable potential to exceed action level standards. I reviewed the data for cyanide and it also showed reasonable potential to exceed water quality standards so I could not take it out as requested. I apologize that it was not clear in the July 18 letter. Please review the attached documents and let me know if you have any comments. As you can see the influent cyanide results ranged from <5 ug/L to a high of 168 ug/L on 5 / 1 / 07 by Meritech and the corresponding effluent levels remained at below detection limits. The daily effluent cyanide tests (67) performed by Meritech were all below detection limits proving beyond any doubt there is no reason for weekly cyanide monitoring or limitations in the NC0036196 permit.
