REQUEST FOR MORE INFORMATION
Dear Mr. Hill:
On August 14, 2006, the Division of Water Quality received correspondence dated August 11,
2006, from your agent, Soil & Environmental Consultants, P.A., regarding the request of a "plan
refinement" to the original plans upon which a 401 WQC and Authorization Certificate per the
Neuse River Buffer Protection Rules was written on September 8, 2004. The original plan
proposed the use of a 140 linear foot level spreader to achieve diffuse flow per the Neuse Buffer
Rules at the area as shown on Sheet 5-13. According to your agent's correspondence, "the
topography of this area now precludes a level spreader of that length being used (i. e. it will not
fit between the two existing ephemeral "draws" noted on the plans) in order to achieve an
appropriate "non-erosive "discharge rate." You have proposed, as an alternative design, a pre-
formed scour hole in combination with an earthen level spreader, 801inear feet in length. This
Office will need the following additional information do make a decision regarding approval of
your "plan refinement", or modification request.
1. Please provide the data you used to support your determination and re-design decisions.
2. Please provide working documents of your plans.
3. Please provide calculations for your proposed BMPs.
4. Please be aware that the State is moving away from approval of earthen level spreaders.
This Office recommends specifying an appropriate alternative material for your level
spreader in the interest of placement of a structure that will succeed over the long term.

existing 401 WQC and Authorization Certificate per the Neuse River Buffer Protection Rules
and does not authorize any impacts to wetlands, waters or protected buffers. Please call Ms.
