Update on 15A NCAC 02N, 02O, and 02P Rules

Overview
Department of Environmental Quality
•Pursuant to G.S. 150B-21.3A, the RRC approved the Periodic Review of Existing Rules Report for Underground Storage Tank rules found in 15A NCAC 02N, 02O, and 02P at the February 15, 2018 meeting, and the report became effective on March 6, 2018 (reports included).

•42 rules in 02N were determined to be necessary with substantive interest
•18 rules in 02O were determined to be necessary with substantive interest
•12 rules in 02P were determined to be necessary with substantive interest
•Therefore, the EMC must readopt these rules by a deadline established by the RRC

•The Division intends to recommend that the RRC
establish a deadline of no later than January 1, 2023 for
the EMC to readopt these 42 rules in 02N, 18 rules in
02O, and 12 rules in 02P.
•This deadline includes a buffer to allow for the
possibility of returning to public comment, or returning
to the EMC with changes should the need arise.
