Union County Dear Mr. Goscicki: This letter provides speculative effluent limits. for 9, 12, and 15 MGD at the Twelve Mile Creek WWTP (currently permitted at 6 MGD). The Division received the speculative limits request in a letter dated June 16, 2010 from James Struve, P.E., of Hazen and Sawyer. The Division also received supplemental information to assist in the speculative limits evaluation, including: a) Scoping Level Assessment of Assimilative Capacity in Twelve Mile Creek below the Union County WWTP (Tetra Tech, April 2010); b) QUAL2E stream water quality model code (received July 7, 2010); c) Expansion Alternatives Development Study (Hazen and Sawyer), received on August 17, 2010; and d) Union County Summer 2009 Stream Reconnaissance of dissolved oxygen. Receiving Stream. Twelve Mile Creek is formed downstream of the convergence of West Fork Twelve Mile Creek and East Fork Twelve Mile Creek and has a stream classification of C. Waters with this classification have a best usage for aquatic life propagation and maintenance of biological integrity, wildlife, secondary recreation and agriculture. Stream flow information was updated in 2002 by the United States Geological Survey (USGS) for a nearby gaging station at Highway 16 just 2500 ft upstream of the Twelve Mile Creek WWTP discharge point. This discharge point has a drainage area of 76.8 square miles and stream flow estimates of 72.7 cfs (annual average flow), 0.1 cfs (summer 7Q10 flow), and 1.5 cfs (winter 7Q10 flow). Previously, Twelve Mile Creek was considered a zero flow stream with 7Q10 flow =0 and 30Q2>0. The current discharge location on Twelve Mile Creek is approximately 2 miles upstream of the NC/SC state line. Twelve Mile Creek from its source to the NC/SC state line is listed on both the Fina1 2008 and Draft 2010 NC 303(d) Impaired Waterbody listing for both copper and turbidity. The stream is not listed as impaired for low dissolved oxygen (DO); however, historical data has shown low DO values both upstream and downstream of the discharge point during low summer flow conditions. Speculative Limits. Based on Division review of receiving stream conditions and water quality modeling results, speculative limits are presented in Table 1 below. These speculative limits maintain the TP load limit originally allocated to Union County/Twelve Mile to comply with the South Carolina TP lake standard of 0.06 mg/1. Likewise, copper and zinc limits originally added to comply with South Carolina standards are maintained, and are based on WER calculations. For listed parameters without limits, effluent monitoring will be required. Monitoring within Twelve Mile Creek will also be required to ensure that the water quality model predictions were accurate, and to ensure the discharge does not create more adverse conditions in the future. Note: At 12 MGD, TP mass limits equate to 0.42 mg/I (Monthly avg) and 0.21 mg/I (Annual avg.) Note: At 15 MGD, TP mass limits equate to 0.33 mg/1 (Monthly avg) and 0.17 mg/I(Annual avg.) Issuance of these speculative limits allows Union County to proceed to SEPA submission for the proposed expansion. If a FONSI is ultimately obtained for the SEPA submission, then Union County will need to apply to the NPDES Unit for a permit modification for expanded flow. However, please note that these speculative limits do not guarantee that an NPDES permit will be issued for the proposed expansion. Likewise, speculative limits are provisional and may change with future changes in water quality standards, TMDLs, policy, etc. Please note the following concerns and/or review requirements that Union County will need to address: 17 ug/1 18.5 ug/1 171 ug/I • QUAL2E Model Review. Division staff from the Modeling Unit reviewed the draft scoping level assessment of Twelve Mile Creek and the modeling files in July 2010 (comments attached). The QUAL2E scoping level model was developed to evaluate assimilative capacity downstream of the WWTP. Staff review determined that the model as a scoping level assessment tool was created based on limited data. The model must be validated with additional data collection and results evaluated byDWQ to provide confidence accepting the model results. Data should be collected duringsummer conditions (low flow, high temperature) at three DO sag points predicted byise 10 miles, and 12.5 miles below the discharge. Please note that the Expansion Alternatives Development Study previously submitted to DWQ will need to be expanded to include flow justification and d alternatives analyses/cost comparisons for a full 15 MGD expansion. If you avea y Branch questions stiat regarding SEPA requirements, please contact Hannah Stallings with the DWQ g (919) 807-6434. • NPDES Permit Modification Requirements.The NPDES Unit will not accept an NPDES perit modification request for expanded flow until the Division has approved the SEPA document and s a Finding of No Significant Impact (FONSI) to the State Clearinghouse for review and comment. In accordance with the North Carolina General Statutes, the practicable wastewater treatment and disposal alternative with the least adverse impact on the environment is required to be implemented. Any NPDES permit modification for expanded flow will be subject to 30-day public comment. this is a Major permit, US EPA must approve any proposed permit changes and South Carolina DHEC will have an opportunity to comment. Documentation will need to address any projected impacts to NC/SC water quality. Rizzuti, EHM I, and Larry Turner, EHM III Water Quality Monitoring and Modeling Section THROUGH: David Graves, Manager Water Quality Monitoring and Modeling Section RE: Proposed expansion of Twelve Mile Creek WWTP (NC0085359) discharge to Twelve Mile Creek (WMU 0301, HUC 03050103-02) in Union County, NC DATE: 7/23/2010 On 7/20/2010, Kathy Stecker of the NC Division of Water Quality (NCDWQ) at NCDENR requested a response from the Bureau of Water concerning a proposed expansion of a North Carolina wastewater facility that may impact South Carolina waters. Twelve Mile Creek WWTP (NC0085359) is permitted to discharge 6 MGD of effluent to Twelve Mile Creek in Union County, NC. The current effluent flow of this WWTP is approximately 3.4 MGD. Union County is proposing an expansion to 15 MGD at the existing outfall location. Downstream of the Union County discharge, Twelve Mile Creek flows into Lancaster County, SC, where it joins the Catawba River (see attached map). According to modeling results presented by NCDWQ, a dissolved oxygen (DO) sag occurs in a segment of Twelve Mile Creek in Lancaster County called "Reach E" (see attached map). The upper end of Reach E is located where US Highway Route 521 crosses Twelve Mile Creek. No ambient stream monitoring has been performed in Reach E. Kathy Stecker inquired whether there were any sources of oxygen demand in Reach E or immediately upstream in SC. In response to her question, there are no permitted NPDES wastewater facilities or SCDHEC permitted agricultural facilities in any part of the Twelve Mile Creek watershed (HUC 03050103-02) that is within South Carolina. However, there are two active NPDES industrial dischargers under the general permit for non-metal mining. They are Robby Steen/Steen Mine (SCG730481) and Boral Bricks/Miller Mine (SCG730641). Their outfalls are both located within the Sixmile Creek watershed (HUC 03050103-02-03), a tributary that joins Twelve Mile Creek approximately 0.27 mi upstream of Reach E (see attached map). The Robby Steen/Steen Mine is approximately 5.1 mi upstream of the beginning of Reach E, and 1 of 2 the Boral Bricks/Miller Mine discharge is approximately 3.1 mi upstream of the beginning of Reach E. In an effort to determine whether the proposed expansion to 15 MGD would impact waters in SC, the Water Quality Monitoring & Modeling Section has several questions and/or concerns. 1. Regarding the section of Twelve Mile Creek upstream of the Twelve Mile Creek WWTP discharge, does the NCDWQ consider this stream segment to be naturally low in DO? Are there any point sources or nonpoint sources of oxygen demand in the watershed upstream of this location? Are there any other ambient monitoring stations in the watershed farther upstream in North Carolina? If so, are any of these monitoring stations listed on the NC 303(d) list or are covered by a TMDL? 2. Please send us the DO model for Twelve Mile Creek and all relevant files for running the model. We are also interested in any extra information about the point sources, rates, constants, flows, and slopes used in the model. 3. In her email to Michael Montebello, Kathy Stecker mentioned that she will be recommending additional monitoring this summer, including in Reach E where the DO sag occurs in all of the modeling scenarios. We agree that additional ambient monitoring is needed to calibrate the model. We recommend as many additional sampling locations in Reach E as would be necessary to provide sufficient sampling information to adequately characterize the DO conditions, BOD5, and ammonia -nitrogen in Reach E. This sampling data should then be used to calibrate the model to the existing conditions in Reach E. In addition to these new sampling location(s), sampling should also take place at all of the stations that underwent daily sampling in 2007. We anticipate that the above information will allow us to adequately address questions concerning the existing and expanded discharge. However, if the additional work does not adequately address concerns and support a conclusion that low DO conditions in Twelve Mile Creek are attributable to natural conditions, then additional work may be needed. DWQ received the modeling files from Tetra Tech on July 7, 2010. 1. The QUAL2E scoping level model was developed by Tetra Tech to evaluate assimilative capacity in Twelve Mile Creek and assess the impact of expanding Union County WWTP to 15 MGD. Note that DWQ did not have input on the modeling plan. This model was created as a scoping level assessment tool based on limited data. If speculative limits are issued, the model should be validated through additional data collection and results_._ evaluated by DWQ before final permit limits are issued to provide confidence accepting the model results. Data collection should begin as soon as possible to capture worst case conditions through the summer months and should include multiple sampling events. Data should be collected at the sites of the scoping level calibration points as well as through the reaches of the three DO sag points predicted by the model (located 2 miles, about 10 miles, and about 12.5 miles downstream of the discharge, as shown in the figure below). Data collection efforts should also include measurement of BOD-5 at upstream and Six Mile Creek sites to confirm model estimates. Of particular concern is the second sag point 7-10 miles downstream of the discharge when DO dramatically decreases to well below the standard ("Reach E" on Figure 5 of the model report, included below). Slope approximations were estimated from 10-meter LIDAR contour data measured along the top of the bank for the entire length of the channel. The slope through this area is very low relative to the rest of the system. The model results indicate that this sag is not caused by the discharge, but there is no data available to confirm conditions through this area. Data collection through this area will provide additional confidence accepting model predictions. 2. Summary of scoping level QUAL2E model predictions (keeping in mind the uncertainty involved, as discussed above): a. The model indicates that the increase in discharge does not worsen existing conditions, see the figure included below. b. As requested by NPDES, MTU ran the model with an effluent DO concentration of 9.0 mg/L. The model indicates that increasing effluent DO to 9 mg/L from 6 mg/L does not improve downstream DO. c. The future expansion to 15 MGD scenario was run with effluent concentrations of 6.0 mg/L for DO, 1.0 mg/L for ammonia, and 5.0 mg/L for BOD-5. Per Don Laton's guidance and Tom Belnick's letter, this permit became effective on July 1, 2010. Had this permit been in effect prior the facility would have been out of compliance with the following parameters: 1. Total residual chlorine -there is no dechlorination at the facility because there was no chlorine limit under the old permit 2. Ammonia -monthly average 3. Flow Permit non compliance: Operation and Maintenance : The following are inoperable... • both clarifiers, • tertiary filters, • bar screen, • cat walks, • aeration header pipes • blowers, • influent pumps (only one) WWTP exterior wall structural integrity is questionable, and parts of those walls are convexly curved c,0 The plant was abandoned in Sept/Oct 2009 by the ORC, Clayton Oaks. The facility is currently under a NOV/NRE on the last inspection. We were waiting the outcome of the recent activity prior to sending the enforcement to Bob Sledge (our enforcement contact). And as you know, we are awaiting with the pending injunction. I think this morning's call covered most of the history you would need to know, so I won't bother to repeat that conversation. As discussed in the draft report for the Expansion Alternatives Development Study that we left with you for your review, the County has been pursuing several options for disposal and/or diversion of projected future wastewater flows in the Twelve Mile Creek WWTP service area. These options range from diverting raw sewage to other wastewater treatment plants operated by neighboring utilities to pumping treated effluent directly to the Catawba River. The County has also been diligent over the past three years in collecting dissolved oxygen data in the creek both upstream and downstream of the current discharge. Using this data, a scoping level model of additional treated effluent discharge into the creek was completed as part of our alternatives analysis. Since the results were favorable, we would like to request I eGo Is de a c r of increasing discharge flows into Twe!ve 11 /l i!e Greek Based on the above and your recommendation for continuing this discussion, we are hereby requesting speculative NPDES discharge limits for an expansion of the WWTP's current permitted capacity of 6.0 mgd to future expanded total capacities of 9.0, 12.0, and 15.0 mgd (i.e., increasing discharge by 3, 6, and 9 mgd) to account for near -term and long-term wastewater needs. Since expansion of the current discharge represents one of the most favorable options in terms of capital costs, O&M costs, and overall sustainability, the County is willing to discuss a range of options for improvements and control within the watershed to ensure long-term environmental protection of the creek. Alternative 5: Discharge Additional Plant Effluent Directly into the Catawba River The Twelve Mile Creek WWTP would be expanded to 9 MGD with the flows above 6 MGD conveyed and „discharged directly to the Catawba River near the Catawba River Water Treatment Plant. Speculative limits to discharge directly to the Catawba River were issued by SC DHEC in January 2008 for additional flows of 3, 6, and 9 MGD. To convey treated effluent to the Catawba River, the County would consider'converting the smaller of the two parallel high -service pipelines (1-24" diameter, 1-42" diameter), that currently carry drinking water from the WTP to Union County, to a wastewater forcemain. I have attached the updated spreadsheet that Mark Tye usually sends as well as added a few pages with our info. Below is the brief synopsis of our findings. General observations: 1. Sampling locations are on the downstream side of the bridge for continuity. 2. Some sampling locations are not in the thalwag of the stream. 3. The DO probe was not oscillated while sampling unmoving pools of water. 4. The DO probe sometimes rested on the bottom of the stream as opposed to being suspended in the water column. 5. Turbidity was analyzed by a lab in the beginning; however, now the results are estimated by sight only. 6. The downstream site for this study (1/4 mile downstream of the discharge) may or may not be at the effluent d.o. sag point. 7. Not all sampling points are for the main stem of 12 mile, some data points are from unnamed tribs. 8. Most sampling stations had slow moving water. Once again, I'd like to get confirmation that the DO monitoring data is being collected appropriately, and whether there are any indications of smoking guns (poultry operations, cattle in stream, etc) at low instream DO segments upstream of the WWTP discharge. If low upstream DOs appears natural, there is a possibility that DWQ would consider an expansion, provided certain conditions are met. But if low upstream DOs appear due to some upstream activities, then this would need to be resolved before an expansion would be considered. So there is a lot riding on the DO sampling. However, where appropriate, samples shall be collected within the mixing zone in order to ensure compliance with in -zone water quality requirements as outlined in Paragraph (b) of this Rule. (b) Mixing Zones: a mixing zone may be established in the area of a discharge in order to provide reasonable opportunity for the mixture of the wastewater with the receiving waters. Water quality standards shall not apply within regions defined as mixing zones, except that such zones shall be subject to the conditions established in accordance with this Rule. The limits of such mixing zones shall be defined by the division on a case -by -case basis after consideration of the magnitude and character of the waste discharge and the size and character of the receiving waters. There are some low gradient streams out there that are not in the coastal plain that may be subject to low DO issues. Beavers are another confounding factor. Flows are a big piece of the puzzle...if any more monitoring will be taking place, it would be good to collect flow data if at all possible. We would be happy to take a look at it if you need us to, just let me know. Short story- they want to expand at their WWTP, but DWQ said not at this time due to low instream DOs. It now appears the low DOs might be due to upstream sources (no point sources upstream, but we wondered about any poultry farms, etc). So we requested Union County to conduct an instream DO recon- which they committed to run through July. Initial results for May/June show DO values already down to 3 mg/I at some upstream sites, but no smoking guns have been identified. Question- could this be naturally low instream DOs? This is not eastern swamp territory. This is just an fyi at this point- but we might request your Unit or MRO to accompany Union County on one of their recon surveys, to ensure DO values are being measured correctly, and observing field conditions. On May 8, 2009 representatives from UCPW, Hazen & Saywer and DWQ had a very productive meeting concerning the Twelve Mile Creek, Hunley Creek and Fairfield Plantation WWTP's. In summary : • DWQ expects the permits for the Hunely Creek and Fairfield Plantation WWTP's to rescended by request. • Due to severe capacity limitations at the Twelve Mile Creek WWTP, Union County is not in the position to request Hunley Creek permit recission at this time. By contractual agreement the Fairfield permit will soon be assigned to Union County. Due to the same capacity issues Union County will not be in the position to request recission of that permit. • It was suggested that if the cause of suppressed DO levels upstream of the Twelve Mile discharge could be identified there is the real potential for increased discharge to Twelve Mile Creek. If additional discharge was permitted to Twelve Mile Creek, serious consideration could be given to requesting recission of the two permits mention above. In an effort to get discussions as they relate to the DO levies in Twelve Mile started, UCPW initiated some preliminary sample collection. 13 sampling points along Twelve Mile Creek and/or tributaries were monitored for DO, Temp and Turbidity 14 times between 5-14-09 and 6-12-09. Following rain events (or periods of higher flow, the tree across the stream at Upstream 4 appears to enhance D.O. levels assumed due to the turbulence induced by the vertical fall. As flow subsides, the tree is like a dam impeding flow (no turbulence) with lower D.O. downstream. Though it may be hard to distinguish from the photo provided, the two culverts beneath roadway at Upstream 7 sample site both have debris blocking over halfway across and halfway up the left side of each. Upstream 12 site of field adjacent to sample site was quite odiferous from recent application of poultry litter. Heavy equipment passage over the stream has reduced stream width on upstream side of roadway. Cattle guard (gate) across culvert under roadway has trapped significant quantities of debris retarding stream flow. A huge beaver dam near Hawfield (approximately 8 feet high with respect to the level of the lower water level below blocks a primary tributary to Twelve Mile Creek. Debris against bridge provides damming effect at Downstream 1 sampling location just upstream of sample site. Though I have no real guess of the impact of paint contents from NC DOT operations (June 1, 2009) in/on the surface waters at bridge at Upstream 7 location, this appearance was "unsettling". Basic correlations are as follows: When stream(s) are free flowing (through or over obstacles), D.O. is above 5.0 mg/I When flows subside, waters pool upstream of debris, trees, etc. and D.O. drops in identified areas There is at least one (poultry litter-ed field) run-off that could impact stream quality There are some other factors (NC DOT bridge painting) that could potentially impact stream quality Please advise if you need further supportive information to the attachments. We would like to discuss the Union County/12 Mile Creek WWTP expansion issue, as well as some other Union County/Goose Creek permitting issues: • Union County/12 Mile Creek WWTP (NC0085359)- I don't think that DWQ would be amenable to considering an expansion until causes of low upstream DO are identified (appears to be non -point sources), and potential corrections are evaluated. Does Union County have additional information on potential upstream sources, or would this need to be a new study. Also, DWQ will be evaluating the 2004-2008 dataset to identify 303(d) impaired waters for the 2010 report, and these findings might impact 12 Mile Creek status. • Union County/Hunley Creek WWTP (NC0072508)- Union County removed this discharge to Goose Creek in 2006, but the permit is still active. The plant was in chronic noncompliance prior to diversion. The Goose Creek Rules became effective 2/1/2009, and the EMC has adopted the Hearing Officer recommendations which includes elimination of this permit. • Goose Creek Utility/Fairfield Plantation WWTP (NC0034762)- Union County has a 2006 MOA with facility to take over discharge (which goes to Goose Creek) and divert wastewater flow to 12 Mile Creek WWTP. It was a pleasure meeting you Monday, November 3`d and discussing with you our situation in Union County — specifically the Twelve Mile Creek service area. The following bulleted items summarize the highlights of our meeting: • Within the past 10-years, the southwestern portion of Union County has experienced double digit growth rate, thereby necessitating expansion of the 12-Mile Creek WWTP from its original capacity of 2.5 mgd to 6 mgd. This expansion project was recently completed in August 2007. Currently, the plant is treating a little over 3 mgd on average.' Since issuance of the revised permit to discharge up to 6 mgd, the facility has reliably met its NPDES permit limits including its TMDL for phosphorus (both on a monthly and an annual average basis). • Although residential development has slowed considerably with the nationwide economic downturn, wastewater flow permits have already been allocated for 6.0 mgd of the plant's 6.0 mgd permitted flow. As a result, the County is not capable of allocating any additional flow permits to allow for future growth needs. • In December 2006, Union County requested speculative limits from NC DWQ to expand the County's 12-Mile Creek WWTP beyond its current rated capacity of 6 mgd. In May 2007, DWQ responded that they could not issue speculative limits since dissolved oxygen (DO) levels both upstream and downstream of the WWTP discharge were below North Carolina's water quality standard of 5 mg/L. DWQ recommended that the County explore alternative disposal options. • In May 2007, Union County requested speculative limits from SC DHEC to remotely discharge final effluent into South Carolina's section of Twelve Mile Creek. In December 2007, DHEC responded that they would not allow a remote discharge into South Carolina waters of Twelve Mile Creek due to low DO levels. • A subsequent speculative limits request was made by Union County to discharge up to 9 mgd directly into the Catawba River. In January 2008, DHEC formally issued conditional speculative limits for this scenario. As we discussed, even with the economic downturn and no more flow capacity in the County's 12-Mile Creek WWTP, builders are still trying to develop within the Twelve Mile Creek service area. Treatment options being considered include individual septic tanks with leach fields. Development will continue in the Twelve Mile Creek service area. Therefore, the challenge that faces the County and the State is how to balance safeguarding public health and the environment with providing reliable and sustainable wastewater treatment. 500 North Main St., Suite 500 • Monroe, NC 28112-4730 • Phone: (704)296-4210 • Fax: (704)296-4232 One alternative that the County would like to present for consideration by the State is to use the final effluent from the 12-Mile Creek WWTP to improve dissolved oxygen levels throughout Twelve Mile Creek. This alternative would entail pumping a portion of 12-Mile Creek WWTP's final effluent upstream of low DO stream segments in an effort to increase dissolved oxygen levels. Compliance monitoring indicates that the 12-Mile Creek WWTP discharge has a positive effect on in -stream DO levels. Union County is of the opinion that this option is highly preferred to the option of totally removing the discharge from Twelve Mile Creek and pumping directly to the Catawba River. If the plant's discharge were redirected to the Catawba River, it is likely that sections of Twelve Mile Creek, at and below the NDPES discharge point, would fall below water quality standards for dissolved oxygen and potentially other parameters as well. With State concurrence, the County is willing to make a substantial investment to demonstrate this alternative's viability or non -viability. Please accept this letter as an official request to combine resources in an effort to develop a joint approach to protect Twelve Mile Creek and its beneficiaries while meeting the needs of Union County and its residents.
