The Division received your application for a wastewater discharge permit on July 8, 1997. Division
personnel have reviewed and approved your application. Accordingly, we are forwarding the attached NPDES
discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215
.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency
dated December 6, 1983, and as subsequently amended.
One major change appears in this permit. Flow monitoring has been changed from continuous to daily
instantaneous monitoring based on the recommendation of Mark Starr from the NC DENR Washington Regional
Office.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days
following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B
of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer
27447, Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and
binding.
Please note that this permit is not transferable except after notice to the Division. Complete and submit
the enclosed Permit Name / Ownership Change Form if a change in ownership or control of this discharge
occurs. The Division may require modification or revocation and reissuance of the permit.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management
Act or any other Federal or Local governmental permit that may be required.

Town of Creswell has applied to renew their permit to discharge 0.064 MGD treated
wastewater to the Scuppernong River (C-Swamp) in the Pasquotank River basin (030153).
The treatment system consists of flow measurement by staff gage and V-notch weir and
three lagoons in series. Wastewater source is individual septic tanks.Sludge from septic (3,41,4r,,
tanks is disposed of in first lagoon. Chlorine is not used - region please confirmved

Compliance Summary
Effluent data reviewed from January 1995 through July 1997 indicated the following
violations: BOD5 (2/97, 1/97, 4/96, 3/96, 2/96, 1/96, 12/95), flow (10/96, 9/96, 6/95)
and pH (12/95-9/96, 3-9/95). Flow violations are a result of precipitation, not wastewater
effluent. Instream monitoring is not conducted at this facility.
WLA Summary
BOD and TSS are effluent limited and will remain unchanged in the proposed permit. The
facility uses a lagoon system for treatment and thus 90.0 mg/1 limit for TSS is appropriate
(WLA 5/30/91 - S. Bevington).
Other
M. Starr (WaRO) requested on behalf of permittee that flow measurement requirement be
changed from continuous recording to daily instantaneous. It is Division policy to require
continuous flow recording for any facilities with flows greater than or equal to 10,000
GPD. Town of Creswell's permitted flow (64,000 GPD) exceeds minimum for
instantaneous measurement. Currently, Town of Creswell's WWTP does not have any
electric power. Power of some type is needed at the facility to meet the continuous
monitoring requirement. j,,+

NOTIFICATION OF INTENT TO ISSUE A STATE NPDES PERMIT
On the basis of thorough staff review and application of Article 21 of Chapter 143, General Statutes of
North Carolina, Public Law 92-500 and other lawful standards and regulations, the North Carolina
Environmental Management Commission proposes to issue a permit to discharge to the persons listed
below effective 5/25/98 and subject to special conditions.
Persons wishing to comment upon or object to the proposed determinations are invited to submit same in
writing to the above address no later than 5/8/98 . All comments received prior to that date will be
considered in the formulation of final determinations regarding the proposed permit. A public meeting may
be held where the Director of the Division of Environmental Management finds a significant degree of
public interest in a proposed permit.

permit renewal for a facility located at the Town of Creswell on Palmetto Street, Creswell, Washington
County. The facility is permitted to discharge treated filter backwash from one outfall into an unnamed .
tributary to Scuppernong River, a Class C-Swamp stream in the Pasquotank River Basin. No parameters
are water quality limited, but this discharge may affect future allocations.

The Scuppernong is one of the blackwater rivers of the eastern coastal plain of North
Carolina. The sources of the Scuppernong are the swamps of eastern Washington county and Lake
Phelps. The river ends at Bull Bay on Albemarle Sound. Riverine swamps line almost the entire
length, and approximately half the river is tidal. The Scuppernong and Bull Bay are used for
aquatic life propagation and survival, fishing, wildlife, secondary recreation, and agriculture.
Albemarle Sound has all of the preceding uses, and in addition, is intended to be used for primary
(contact) recreation.

PART IV - EVALUATION AND RECOMMENDATIONS
During the inspection the lagoons, effluent and receiving waters were examined. Lagoon operations,
maintenance, sampling practices, records, and self -monitoring data were reviewed. In general, the plant and
grounds appear well maintained. The lagoons had over two feet of freeboard, as required. The effluent
appeared clear and free of visible solids. Although continuous monitoring of flow is required in the permit,
the lack of electricity at the lagoon site does not make this feasible. Flow is measured daily by staff gauge
and V - notch weir. Perhaps the permit can be modified to allow daily flow measurements, since the
town cannot afford to upgrade the facility. Self -monitoring data for the past four years revealed numerous
instances of noncompliance with permit limits. It is the nature of sewage lagoons in our climate to exhibit
excessive algae growth which cause the effluent to occasionally exceed pH and BOD limits. Due to these
violations of permit limits, the plant was found to be marginally compliant in the 1997 inspection, and non -
compliant in 1996. The facility was, however, compliant in 1995, 1994 and 1993.
It is the recommendation of the Washington Regional Office that the permit be renewed.

- The Town of Creswell has applied for a permit renewal for
their 0.064 MGD facility. Over the past year, Creswell has
been out of compliance for BOD and pH. Monthly averages for
BOD exceeded 30 mg/1 five of theast twelve months and
monthly pH averages exceeded 9.0pnine times.
- The discharge is to the Scuppernong River, C-Swamp. A
conservative estimate of drainage area at the discharge is
10 square miles. The river is tidally influenced. The
previous assumption, that the river will have more than
adequate assimilative capacity for such a small facility,
seems valid. I believe that existing limits will protect
water quality in the Scuppernong River.
- The region is aware of the compliance problems. Roger
Thorpe of the WaRO stated that many lagoon systems have
similar BOD and pH compliance problems. He feels that the
region may need to get Creswell on an SOC.
- No chlorine is showing up in the effluent monitoring. It
is unclear if Chlorine is used at this facility. This issue
should be resolved to be sure that chlorine in the effluent
is not going undetected.
- I recommend that the permit be reissued with the existing
BOD limit and that compliance issues be addressed.
