Department of Transportation, P.O. Box 1587, Greenville,NC 27835 Authorizing development in Craven County at Neuse River and nearby overflow, Bridge No. 138 and Bridge No. 139 on SR 1470, as requested in the permittee's application dated 1/27/22, including the attached workplan drawings (3): 2 dated 1/25/22; and 1 dated 1/20/22. This permit, issued on March 17, 2022 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action;or may cause the permit to be null and void. 1) Unless specifically altered herein, this Minor Modification authorizes the following: (1) Replace two existing 84"x 62' culverts on the Maple Cypress Road causeway with two 90" x 70' culverts with headwalls instead of extending the existing culverts with the addition of a collar as previously authorized; (2) and eliminate the channel relocation adjacent to the culverts that was previously authorized; all as depicted on the attached workplan drawings. 2) In accordance with commitments made by the permittee, in order to protect anadromous fisheries resources in the Neuse River, no in-water work shall be conducted between February 15 through September 30 of any year without prior approval of the N.C. Division of Coastal Management(DCM), in consultation with the appropriate resource agencies. 3) All fill material shall be clean and free of any pollutants except in trace quantities. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DEQ and the Chair other qualified persons within twenty (20) days of the issuing of the Coastal Resou s Commission. date. /411444. 111. Department of Transportation Permit No.,45-20 Page 2.of'2, ADDITIONAL CONDITIONS 4) No excavation or filling shall take place at any time in any vegetated wetlands or surrounding waters outside of the alignment of the areas indicated on the attached workplan drawings,without permit modification. ' 5) Material excavated at the project site may be used in fill areas associated with the project once properly dewatered or shall be removed from the site and taken to a high ground location. 6) The placement materiahchall be shall chean and free from loose dirt or depictede on the.attached workplan drawings. . Division of Energy,Mineral and Land.Resources. 8) If it is determined that additional permanent and/or temporary impacts are necessary that are not shown on the attached workplan drawings or described in the authorized permit application, a permit modification and/or additional authorization from DCM may be required. In addition,,any changes in the approved plan may also require a permit modification and/or additional authorization from D.CM. The permittee shall'contact a representative of DCM prior to commencement of any such activity for this determination and any permit modification. 9) Development authorized by this minor modification shall only be conducted on lands owned by NCDOT,appropriate utility entities, and/or its Right-of-Ways and/or easements. 1.0) Thus Minor Modification does not eliminate the need to obtain any additional permits,approvals or authorizations that may be required. This includes approval, if required,from the U.S. Army Corps.of Engineers (USACE). 11) 'This Minor Modification shall be attached to the original of Permit No. 45-20,which was issued on 4/14/20;as well as the Letter of Authorization issued on 6/30/21, and the Minor Modification issued on '8/19/21,.and.copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. 12) All conditions and stipulations of the active permit remain in force under this Minor Modification unless specifically altered'herein. NOTE: A minor modification application processing fee of$100 was received by DCM for this project., NOTE: The authorized activities will result in a decrease of 0.09 acres of excavation in 404 Wetlands,a decrease of 0.27 acres of temporary fill in 404 Wetlands, and an increase of 0.36 acres of hand clearing in 404 Wetlands. eeveceeeeegeooceeennoeeoc¢goeeeeevooeo11111 .
