On January 1, 2006, we received your application for Department of the Army (DA)
authorization to impact approximately 8,200 linear feet of waters of the United States and
approximately 5.64 acres of high quality swamp forest wetlands associated with the
reconstruction of Riders Creek Canal and "Lateral A" off of Riders Creek Canal in Tyrrell
County, North Carolina.
After review of your proposal, the United States Environmental Protection Agency, and the
U.S. Fish and Wildlife Service recommended denial of your application and plans by letters
dated March 3, 2006, and February 28, 2006 respectively (copies enclosed). These
recommendations are due to anticipated adverse environmental impacts.
Our administrative process provides you the opportunity to propose a resolution and/or rebut
any and all objections before a final decision is made. In this regard, I would appreciate being
made aware of your intentions, in writing, on or before 03 April; 2006.
Mr. Tom Steffens of the Washington Regulatory Field Office staff, telephone
