Klimek, P.E., Director ~ Division of Water Quality ~ CERTIFIED MAIL: RETURN RECEIPT REQUESTED ':_ '~~CO3O7 Tyrrell County Board of Commissioners Attn: Mr. Willie Mac Carawan, Jr. Assistant County Administrator PO Box 449 Columbia, North Carolina 27925 Subject Property: Rider's Creek Canal and Lateral A Dear Mr. Carawan: February 2, 2006 Tyrrell County On February 1, 2006 the NC Division of Water Quality (DWQ) received a copy of the Corps of Engineers Public Notice for Rider's Creek Canal and Lateral A project. The comment period ended March 1 2006. An Individual 404 Permit will be required for this project. Please note that the following must be received prior to issuance of a 401 Water Quality Certification: 1. The 401 Certification cannot be processed until five (5) complete sets of the application and associated maps is received at the DWQ Central Office in Raleigh along with the appropriate fee. 2. Please note that beginning January 1, 1999, the N.C. General Assembly passed legislation requiring payment of a fee for all 401 applications. The fee for applications is $200 for projects impacting less than an acre of wetland and less than 150 linear feet of streams. For projects impacting one or more acres of wetland or 150 or more feet of streams, the fee is $475. Please make that check payable to the NC Division of Water Quality in your response. 3. It is our understanding that state funds (through the Division of Water Resources) are being used for this project. If that is the case, then the Division of Water Quality cannot act on the required 401 Water Quality Certification until a final environmental document is circulated and completed under the State Environmental Policy Act (SEPA). Please address whether state funds are. involved and, if so, the status of the SEPA document. 4. The Public Notice discusses impact to 5.64 acres of riparian wetlands but does not discuss compensatory wetland mitigation. Please provide a response as to how compensatory mitigation will be provided by this project. 5. The Public Notice does not address alternatives for this project. If these are addressed in the SEPA document referred to in item 3 above, then the Division can review that discussion in that document. If a SEPA document is not being prepared, then please provide a written discussion of alternatives for this project. Until the information requested in this letter is provided, I will request (by copy of this letter) that the Corps of Engineers place this project on hold. Thank you for your attention.
