Division of Water Resources' Central staff has reviewed the application package received
December 7, 2021. However, additional information is required before the review may be completed.
Please address the items on the attached pages no later than the close of business on March 24, 2022.
Please be aware that you are responsible for meeting all requirements set forth in North Carolina
rules and regulations. Any oversights that occurred in the review of the subject application package are
still the Applicant's responsibility. In addition, any omissions made in responding to the outstanding items,
or failure to provide the additional information on or before the above requested date may result in your
application being returned as incomplete.

A. Signature authority delegation:
1. In the case of a municipal, state, or other public entity, the application form must be signed by
either an executive officer or elected official in the highest level of elected office. [15A NCAC 02T
.0106(b)]. Otherwise, a `Delegation of authority' to sign permit applications to other authorized
employees must be provided in writing to the Division [15A NCAC 02T .0106(c)].
A partially filled `Signature authority delegation letter' has been attached for your reference. Please
have this letter signed by the current Town Manager to delegate authority to Mr. Joshua Baird, who
is currently in the position of Town Engineer.
B. Property Ownership Documentation:
1. Pursuant to 15A NCAC 02U .0201(e), the applicant shall provide property ownership
documentation to the Division. In this case the Engineering Plans show the relocation of reclaimed
water distribution line along the Shotwell Rd. NCDOT encroachment agreements need to be
provided if the utility installation is in the NCDOT Right -of -Way. Please also clarify whether this
relocation needs an approval from NCDOT. In other cases, documentation may consist of:
a. legal documentation of ownership, such as a contract, deed, or article of incorporation;
b. an agreement of an intent to purchase the property that is written, notarized, and signed by both
parties, accompanied by a plat or survey map;
c. an easement running with the land indicating the intended use of the property and meeting the
condition of 15A NCAC 02L .0107(f); or
d. an agreement to lease the property that is written, notarized, and signed by both parties,
indicating the intended use of the property, accompanied by a plat or survey map. When this
Subparagraph is utilized to document property ownership, groundwater standards must be met
across the entire site and a compliance boundary need not be provided. Lease agreements shall
adhere to the requirements of 15A NCAC 02L .0107.
C. Application Form RWDL 06-16:
1. Please clarify what will be the separation distance between the relocated reclaimed water
distribution line and other entities like the water line, sanitary sewer and any well, minimum
distances need to be maintained according to 15A NCAC 18C .0906(f) and 15A NCAC 02U
.0403 (h), (i) and (j). Please resubmit page 3 of the Form RWDL 06-16 and clearly state the distances
using numerical figures. It was not clear what the terms `Prop. Rel.' meant.
