Dear Mr. Gaster:
Division personnel have reviewed and approved your application for modification of the subject
permit. The Division concurs that you do meet all the requirements for monitoring frequency
reduction for BOD, and it will be implemented in this permit. Be aware your permit may be re-
opened and monitoring increased if non-compliance with Exceptional Performance criterion
occurs or if impairments to the surface waters occurred that are the result of your plant operation.
Please insert the enclosed EFFLUENT LIMITATIONS AND MONITORING page into your
permit. You may discard the old page. The changes in this permit modification are effective
June 1, 2013.
This permit modification is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
Please note that this permit is not transferable except after notice to the Division. The Division
may require modification or revocation and reissuance of the permit. This permit does not affect
the legal requirements to obtain other permits which may be required by the Division of Water
Quality or permits required by the Division of Land Resources, the Coastal Area Management
Act or any other federal or local governmental permits that may be required.

During the period beginning on the effective date of the permit and lasting until expiration, the Permittee is

• NOTES:
1• Upstream = at NC Highway 217. Downstream = approximately 1400 feet below discharge.
2. The monthly average effluent BOD and Total Suspended Solids concentrations shall not exceed 15% of the respective
influent value (85% removal).
3. Limit and monitoring requirements apply only if chlorine is added for disinfection. The Division shall consider all effluent
TRC values reported below 50 µg/L to be in compliance with the permit. However, the Permittee shall continue to record
and submit all values reported by a North Carolina certified laboratory (including field certified), even if these values fall
below 50 µg/L.
4. TN = TKN + NO3-N + NO2-N, where IN is Total Nitrogen, TKN is Total Kjeldahl Nitrogen, and NO3-N and NO2-N
are Nitrate and Nitrite Nitrogen, respectively.
5. Chronic Toxicity (Ceriodaphnia) limit at 1% with testing in March, June, September, and December (see A. (2)).
6. Instream monitoring shall be waived as long as the permittee maintains membership in the Middle Cape Fear River Basin
Association (MCFRBA), which conducts comprehensive instream monitoring. If the permittee cancels membership in the
MCFRBA, the facility shall begin collecting the listed instream samples immediately at a frequency of 3/week (June -
September) and weekly (October -May).
7. Facility shall employ method 1631E for mercury analysis.
There shall be no discharge of floating solids or visible foam in other than trace amounts.

Based on DWQ's reduced monitoring guidelines, the City of Dunn would like to request
a reduction in BOD monitoring from five (5) times per week to two (2) times per week at
its Black River Wastewater Treatment Plant. This is the only parameter we are seeking a
reduction in monitoring for. The Black River WWTP currently outsources BOD testing,
so this would result in a reduction in operational costs as well. This reduction in BOD
monitoring will not affect our continued commitment to preserve our natural resources
and protect our environment.

The City of Dunn would like to request a modification of NPDES permit #NC0043176 issued for the
Black River Wastewater Treatment Plant. We would like to be considered for reduced monitoring,
specifically the BOD parameter. The following criteria have been met by this facility.
• This facility has not had any civil penalty assessments within the past 5 years.
• The Permittee, nor any of its employees, has ever been convicted of criminal violations of the
Clean Water Act.
• This facility is not under an SOC
• This facility is not on EPA'S Quarterly Noncompliance Report
• For the BOD5 parameter, the three year arithmetic mean of effluent data have met the criteria
of being less than fifty percent of the monthly average permit limit. Documentation supporting
this fact has been included.
• This facility does not have a period where it has been over 200% of the monthly average limit for
BOD5.
• This facility does not have any non -monthly average limit violations.
