REQUEST FOR MORE INFORMATION
Dear Mr. Hardee:
On August 7, 2006, the Division of Water Quality (DWQ) received your application dated September 9,
2004, and on August 26, 2006, the DWQ received your Public Notice dated August 22, 2006, to impact
1.78 acres of wetland, and an undisclosed linear footage of linear feet of stream (the Public Notice states
200 square feet of stream impact, and does not state whether the stream is intermittent or perennial) and
an undisclosed square footage of 0.00 square feet of Zone 1Tar-Pamlico River basin protected riparian
buffer, and 0.00 square feet of Zone 2Tar-Pamlico River basin protected riparian buffer to construct the
proposed pond at the subject property. The DWQ has determined that your application was incomplete
and/or provided inaccurate information as discussed below. The DWQ will require additional
information in order to process your application to impact protected wetlands and/or streams on the
subject property. Therefore, unless we receive five copies of the additional information requested below,
we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will
place this project on hold as incomplete until we receive this additional information. Please provide the
following information so that we may continue to review your project.
Additional Information Requested:
1. Please provide copies of a USGS topographic map with the project boundaries clearly shown, and
a Moore County Soil Survey aerial map with the project boundaries clearly shown.
2. Please provide the proposed linear footage of stream impact for your project, including headwalls
and dissipater pads. Additionally, you have not provided documentation as to whether the stream
is subject to the Tar-Pamlico River basin buffer rules, or whether the stream is intermittent or
perennial. Please contact Kyle Barnes of the DWQ Washington Regional Office to schedule a
site visit to make these determinations.
3. Please clearly indicate Zone 1 and Zone 2 buffers, and impacts to these, on the site plan and in a
table in a narrative discussion of the proposed project.

4. Please clearly locate all isolated or non-isolated wetland, stream, and other waters of the State as
overlays on the site plan.
5. Please provide cross section details showing the provisions for aquatic life passage.
You state in Section 18, Nature of Activity, of your application that, "Project proposes to install
a pond on site to improve stormwater handling capabilities, add aesthetic value to the property
and improve overall drainage of the site." Please be advised that since your project is located in
the Tar-Pamlico River basin you will need to provide detail regarding the drainage area for the
proposed pond and the imperviousness of the residential community (Please provide an inventory
of all impervious surfaces (building footprints, roads, driveways, decks, sidewalks, gravel-
covered areas, etc.). Once the DWQ has these details we can advise you of the stormwater BMPs
that will be required as a component of your project. These required stormwater BMPs may be
constructed wetlands, or some combination of wet ponds, diffuse flow provisions such as level
spreaders, and a forested filter strip, and all applicable worksheets and an Operations &
Maintenance Agreement. We will advise you once we have reviewed the requested information.
Additionally, please note that if the stream proposed for impoundment is determined to be subject
to the Tar-Pamlico River basin buffer rules, a 50-foot, undisturbed, vegetated buffer (possibly
forested) will need to be maintained in perpetuity around the proposed pond. Therefore, we will
also a riparian buffer restoration plan from you.
Please contact the DWQ within three weeks of the date of this letter to verify that you have received this
letter and that you remain interested in continuing to pursue permitting of your project and will be
providing the DWQ the requested information at a later date. Please contact me in writing and Kyle
Barnes of the DWQ Washington Regional Office. If we do not hear from you within three weeks, we will
assume that you no longer want to pursue this project and we will consider the project as withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not
authorized (at this time) by the DWQ. Please call Ms. Cyndi Karoly or Mr. Ian McMillan at 919-733-
