Clayton has three industries of the three,Novo DFP has a Significant Non-Compliance. Failing to
report fourth quarter sampling. Novo DAPI is still in the testing and certification process. We
continue to work toward compliance with the Dental Amalgam Rule.

I certify under penalty of law that this document and all attachments were prepared under
my direction or supervision in accordance with a system designed to assure that qualified
personnel properly gather and evaluate the information submitted. Based upon my
inquiry of the person or persons who manage the system, or those persons directly
responsible for gathering the information, the information submitted is, to the best of my

The Town of Clayton and has received and reviewed the Application for the Authorization to
Construct (ATC) for Phase II of the Wastewater pretreatment system upgrades at Grifols
Therapeutics LLC(Grifols)facility in Clayton, North Carolina. This ATC covers the following major
project elements as a part of expanding the treatment capabilities of the facility to 2.0 MGD:
• Modification and addition of basket Strainers to the Headworks facility
• Replacement of the MBBR Media Screens for the discharge of both existing
MBBRs
• Replacement of MBBR media
• Replacement of MBBR blowers
• New MBR system including Anoxic and Aerobic Biological Reactors, MBR
filtration cassettes, and the associated process- mechanical equipment, electrical
equipment, and instrumentation and controls for a fully functional system
• New chemical storage and feed systems
• New sludge Management systems to include Aerated sludge Storage Tanks,
Rotary Drum Thickener and Dewatering Centrifuge
• New building to house the process- mechanical equipment and the Electrical
equipment
• Site improvements
This Authorization to Construct is issued based on 90% design information submitted and
reviewed and in accordance with Part II, Paragraph 26 of the Town of Clayton, Categorical
Industrial User Permit No.0001-02, and shall be subject to revocation unless the are
constructed in accordance with the conditions and Limitations specified in the permit. A copy
of the authorized plans and specifications shall be maintained on file at the pretreatment
facility.

Upon Completion of Construction and Prior to operation of these permitted Industrial
Pretreatment facility improvements a certification Statement must be received by the Town
of Clayton from the Engineer of Record Certifying that all the permitted improvements have
been installed in accordance with the pretreatment permit, this Authorization to Construct,
and the approved plans and specification.
Grifols must notify the Town of Clayton five (5) business days in advance of operation of
installed facilities so that an in- place inspection can be made. This notification will be made
during normal office hours of 8:00am until 5:00pm Monday to Friday excluding Town Holidays.
The Town of Clayton and its contractors assume no responsibility for the Performance or
construction of said facility.
The Issuance of this Authorization to Construct does not preclude the Permittee from
complying with all statues, Rules, regulations, or ordinances of the Town of Clayton, State of
North Carolina, or Federal Government. Failure to abide by the requirements contained in this
Authorization to Construct may be subject to an enforcement action by the Town, State or
federal government in accordance with the Town's Sewer Use Ordinance, North Carolina
General Statue's 143-215.6A to 143-215.6C, and Federal Regulations.
In the Event that the facility fails to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate corrective action and notify the Town.
Construction of Additional or replacement pretreatment Facilities will require another
Authorization to Construct.
