Dear Mr. Dyer:
Division personnel have reviewed and approved your application for renewal of
the subject permit. Accordingly, we are forwarding the attached NPDES discharge
permit. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and
the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently
amended).
A minor error was corrected from the draft permit sent to you on March
17, 2004. Sections A(1.) and A (2.) Effluent Limitations and Monitoring
Requirements were corrected. Section A (1.) now reads "lasting until expansion
above 0.45 MGD capacity or expiration, whichever is sooner, the Permittee is
authorized to discharge treated wastewater from Outfall 001." Section A (2.) now
reads "Beginning upon expansion above 0.45 MGD and lasting until expiration,
the Permittee is authorized to discharge treated wastewater from Outfall 001."
If any parts, measurement frequencies or sampling requirements contained in
this permit are unacceptable to you, you have the right to an adjudicatory hearing
upon written request within thirty (30) days following receipt of this letter. This
request must be in the form of a written petition, conforming to Chapter 150B of the
North Carolina General Statutes, and filed with the Office of Administrative Hearings
(6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such
demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the
Division. The Division may require modification or revocation and reissuance of the
permit. This permit does not affect the legal requirements to obtain other permits
which may be required by the Division of Water Quality or permits required by the
Division of Land Resources, the Coastal Area Management Act or any other Federal or
Local governmental permit that may be required.

The permit shall become effective July 1, 2004.
This permit and the authorization to discharge shall expire at midnight on May 31, 2007.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are
hereby revoked. As of this permit issuance, any previously issued permit bearing this number
is no longer effective. Therefore, the exclusive authority to operate and discharge from this
facility arises under the permit conditions, requirements, terms, and provisions included
herein.
Town of Yanceyville
is hereby authorized to:
1. Continue to operate an existing 0.45 MGD wastewater treatment facility located at NCSR
1743, Caswell County, discharging through outfall 001 and consisting of the following
wastewater treatment components:
• Mechanical Bar Screen
• Manual Grit Chamber
• Influent Pump Station
• Dual Sequencing Batch Reactors
• Post Flow Equalization Chamber
• Effluent Flow Meter
• Chlorine Contact Chamber
• Dechlorination Tank
• Aerated Sludge Lagoon
2. After obtaining an Authorization to Construct from the Division of Water Quality, expand
the existing Wastewater Treatment facility to 0.60 MGD, and
3. Discharge from said treatment works, through outfall 001, into Country Line Creek, a
Class C water in the Roanoke River Basin, at the location specified on the attached map.

A (4.) CHRONIC TOXICITY PERMIT LIMIT (QRTRLY)
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to
Ceriodaphnia dubia at an effluent concentration of 37 % at the effluent limit of 0.45 MGD.
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to
Ceriodaphnia dubia at an effluent concentration of 44 % at the effluent limit of 0.6 MGD.
The permit holder shall perform at a minimum, quarterlu monitoring using test procedures outlined in the "North
Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or
"North Carolina Phase 1I Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent
versions. The tests will be performed during the months of January, April, July and October. Effluent sampling for
this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes.
If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit
limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as
described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or
subsequent versions.
The chronic value for multiple concentration tests will be determined using the geometric mean of the highest
concentration having no detectable impairment of reproduction or survival and the lowest concentration that does
have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection
methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic
Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the
pass/fail results and THP3B for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent to the
following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later than 30
days after the end of the reporting period for which the report is made.

Test data shall be complete, accurate, include all supporting chemical/physical measurements and all
concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature.
Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for
disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the
permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility
name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the
comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address
cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be
required during the following month.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water
Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include
alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism
survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an
invalid test and will require immediate follow-up testing to be completed no later than the last day of the month
following the month of the initial monitoring.

Teresa,
The Town does not need a permit from NC to haul residuals and
dispose of them in VA. I do not know what VA's requirements about
this might be. One would presume that the City of Danville ensures
that it is compliant with all local regulations. If I were you, I
would still have the Town submit the demonstration because it is a
good reminder that the it should be thinking about removing solids
from the plant and, if they aren't, there are other permits that are
needed.

I talked to Jennie Freeman in the W-S Regional Office and she
told me that when she was there for the last inspection they told
her that they dispose of the sludge every few months. A sludge
hauler takes it to the City of Danville in Virginia. So, does
this means that they don't need a permit or to submitt the
demonstration?

The Town is actively making improvements to its efforts in sludge removal from
the aerated sludge lagoon on site. Currently, sludge from the plant is stored in the
lagoon, and then Agri -South Biosolid Services transports the sludge to City of Danville,
Virginia treatment plant for final treatment and disposal. However, Steve Smith, Town
Manager, is awaiting a proposal from Al King, GARCO, Inc. for a new sludge removal
program at this plant as well as the water plant in Yanceyville. Mr. Smith will keep our
office posted on this progress. I have no further comments on the draft permit at this
time.

• Monitoring for Conductivity was eliminated from the permit. The facility treats domestic waste only,
monitoring for Conductivity is not necessary.

Facility Description: The Yanceyville WWTP has a capacity of 0.45 MGD and consists of mechanical bar
screen, manual grit chamber, influent pump station, sequencing batch reactor, chlorine contact chamber,
dechlorination, and aerated sludge lagoon. The permit includes limits for two flow scenarios, 0.45 MGD and
0.6 MGD. The permit includes limits for BOD, TSS, ammonia, fecal coliform, DO, pH, TRC, Cadmium, Lead,
Cyanide, Mercury, and Chronic Toxicity, and monitoring for temperature, conductivity, TN, TP, Cadmium,
Chromium, Copper, and Silver. The town has not upgraded to 0.6 MGD. They are not planning to do the
upgrade in the near future as average flow is well below the permitted flow.
Basin Plan: Due to low flow in the stream in 1999 the stream was not sampled for benthics, therefore the
stream is currently not rated. In the previous basin plan County Line Creek had a bioclassification of Good -
Fair. Since the watershed is experiencing some development, the basin plan recommends implementation of
BMPs for sediment control.
Pre -Treatment: The town has no Significant Industrial Users.
DMR Review: DMRs for the period of January 2002 to September 2003 were reviewed. The average flow
was 0.252 MGD, Average BOD was 8.5 mg/I, TSS averaged < 5 mg/I, Ammonia averaged 1.06 mg/I, Residual
Chlorine averaged < 10 mg/I.
They received NOVs for exceedance of Fecal Coliform on July 2002, Residual Chlorine in July 2002, BOD and
TSS on September 2002, and Fecal Coliform in January 2003.
Priority Pollutant Scan: The requirement to do the priority pollutant analysis does not apply to this facility.

SUMMARY OF PROPOSED CHANGES
• Weekly average limits for ammonia were added to the permit as per the Ammonia Implementation
Policy of December 2002. A weekly limit of 6.9 mg/l was implemented for the summer months and 35
mg/I for the winter months.
• The monitoring frequency for Chromium and Silver was reduced to quarterly based on the results of
the reasonable potential analysis.
• The limits for Cadmium and Lead were eliminated and the frequency reduced to quarterly based on
the results of the reasonable potential analysis.

Per our telephone conversation a little while ago, please find following the language that we have been
adding as a footnote to Attachment A of several residuals land application programs that operate
long-term storage facilities. We have only been adding this as a permit condition recently, so we haven't
received any demonstrations to review yet. So, at this point, I am not so sure how we would review one
and what, if any, action we would take. I hope that this helps!

b The storage lagoon is designed such that the residuals will
remain in storage for a period of greater than two years. Therefore, the storage lagoon may be
considered to be an active surface disposal unit under Part C of 40 CFR Part 503 and require a
separate permit from the Division for continued operation. In order to be exempt from this permitting
requirement, a demonstration that the storage lagoon is not an active surface disposal unit shall be
submitted to and kept on file by the Division as well as kept on file by the Permittee. This demonstration
shall be updated at the time of permit renewal and include the following information:
(i) The name and address of the entity who prepares the residuals.
(ii) The name and address of the entity who owns/leases the land on which the storage lagoon is
located.
(iii) An explanation of why residuals need to be stored for longer than two years prior to final
use/disposal.
(iv) The approximate time when residuals will be used/disposed.
Submit three copies of the demonstration within 90 calendar days of this permit's issuance to the
NCDENR-DWQ, Non -Discharge Permitting Unit, c/o Residuals Program Coordinator, 1617 Mail
Service Center, Raleigh, NC 27699-1617.

0.25 MGD stabilization lagoon (-3 acres) when they completed a 0.45 MGD
sequence batch reactor. Unfortunately, the SBR was designed without a
digester. The waste activated sludge is being sent to the old lagoon.
Septage pumpers also dump into the lagoon (stinking mess).
In 1999 and 2002 Agri -South pumped some solids from the lagoon which
they hauled to the City of Danville. Now the town has a drag line

parked on the dam trying to remove some of the weed mats from the
lagoon surface (they just swing them over the side of the dam).

I heard back from George Smith in the WSRO. He said that the only SIU
in town was a textile mill that closed down in 1996 or 1997. There have
been no other SIUs move in.

I am responding to the request for information on sludge handling and disposal at the
Town's water treatment facility.
Approximately two years ago the Town contracted with Armco of Clemmons to remove
sludge from the lagoons at the water treatment plant. This was transported to the wastewater
treatment plant for processing. In September 2000, the Town began operation of the new
1.0-MPG water treatment plant. This facility processes sludge through drying beds. Sludge
material has been removed on 2 occasions since September 2000.
The two lagoons are presently used for backwash from the new plant.
