As we are working through this and considering the low density option. I wanted to clarify the rule. 3:1 swale side slopes are not feasible on this because of the steepness of the site. In the rule it appears that you can approve 2:1 swale side slopes if we provide engineering calculations as to the stability of the swale and a letter confirming soil suitability/stability by a geotechnical engineer. I just wanted to know if this is something you can approve with those 2 additional pieces of information before pursuing the low density option? Thanks On Mon, Jun 29, 2020 at 4:30 PM Lucas, Annette <annette.lucas@ncdenr.gov> wrote: Justin and Derek, Thank you for discussing this project with me on the phone just now. To follow up, if you look at the classification for the South Fork New River that the other portion of the project drains to on the DWR classifications it says it is classified as C+. From the Division of Water Resource’s classifications requirements, the “+” is assigned ORW status in the New River Basin: 1 Then, 15A NCAC 02B .0225(c) states: We have interpreted this rule as a requirement for development projects within the New River basin with the C+ designation to adhere to the ORW Stormwater requirements in 15A NCAC 02H .1021. This rule sets a high density threshold of greater than or equal to 12 percent built-upon area, and the 15A NCAC 02H .1000 rules section overall requires treatment of the 1” storm with one or more Primary SCMs. I hope that provides you with the information you need to move forward with this project. Please feel free to contact me if you have further questions.
