Upon further review of the applicable statutes and after consulting with our legal counsel, the Division has revised our
stance on the scope of the applicability of post-construction stormwater requirements within the South Fork New and
New Rivers ORW Area per 15A NCAC 02B .0225(d)(4)(a) from that of our previous stance (indicated in the attached email
and the basis for accepting this project for post-construction stormwater review).
Since this project is not located within one mile of and draining to the South Fork New and New Rivers ORW Area and
there are no other applicable post-construction programs that this property is subject to, this project is not required to
receive post-construction permitting under 15A NCAC 02H .1000 (the "stormwater rules").
An original signed hard copy of the return letter (attached) will be mailed to the applicant, Jason Kent Brown, at the
