Dear Mr. Brown:
The Division of Energy, Mineral and Land Resources received and accepted a State Stormwater
Management Permit Application for the subject project on April 22, 2021 and requested
additional information on May 25, 2021. A further review of Title 15A NCAC
02B .0225(d)(4)(a) shows that this project is not subject to post -construction stormwater
management requirements under Title 15A NCAC 02H .1000 amended on January 1, 2017 (2017
Rules) (the "stormwater rules") since this project is not located within one mile of and draining
to the South Fork New and New Rivers ORW Area and is not subject to any other applicable
post -construction program. Per the requirements of Title 15A NCAC 02H .1042(3)(a)(ii) of the
Stormwater Management Rules, this Office is hereby returning the subject application. The
$505.00 application fee is nonrefundable per the requirements of Title 15A NCAC 02H .1042(2)
and has been forfeited.
