MY2 Monitoring Report Memo
Hollowell Buffer Mitigation and Nutrient Offset Plan:
DWR #2018-0180v2

This memo addresses comments from Katie Merritt with DWR regarding the Hollowell MY2 Monitoring
Report submittal. Comments were received via email on February 22nd, 2022. DWR's comments are in
black and WLS's response is in blue text.
All CVS data sheets in the report show "last year's data". No current data for 2021 is provided (see
attached data sheet for Plot 16 as an example). No dates showing the date the data was collected
is shown on the form either. Action Required: Provide current vegetative data for monitoring year
2 collected in 2021.
Response: CVS data sheets provided in the MY2 report are for the current monitoring year, are
correct, and contain height and species for trees in MY2. The data sheets that CVS provides are
used for the following year's data collection, which is why the column reads, "last year's data". The
data sheets have been manually edited to read "Oct 2021". Data collection dates were added to
the data sheets as well.
Vigor data is supposed to be included in the reports but was not provided in the Year 2 report (see
Plot 16 data sheet attached). Include vigor in all future monitoring report data.
Response: CVS does not provide vigor data on the data sheets for the current monitoring year.
Vigor is collected during field work and entered into CVS, but it does not show on what CVS prints.
The data has been added to the MY2 sheets manually. CVS does provide the total number of stems
within each vigor category and vigor by species across the project, those tables are attached. Please
let WLS know if the vigor report that CVS provides can be used in future years in lieu of manually
inputting vigor into the data sheets.
3. 3 encroachments were documented and added up to 0.61 acres in size (see two figures attached).
However, only one encroachment of 0.05 acres was located in areas generating buffer/nutrient
offset credits (see maps attached to this email). As part of the noted adaptive management plan
in the report, WLS indicated that replanting will occur in all encroachment areas and easement
boundaries will be better marked. Action Required:
a. Provide a timeline when WLS will be replanting the encroachment area and marking the
boundaries.
Indicate how the easement will be marked since the original markers did not adequately
denote the CE boundary.

Response: WLS completed the adaptive management plan tasks in December 2021. WLS marked
the encroachments with additional t-posts and signs on December 141", 2021. The easement was
originally marked per the signage every 150 ft, and additional signs have been added. String and
flagging tape were also used to demarcate the boundary. Replanting occurred on December 7"
2021. Photos of encroachments and replanting are attached and will be provided in the MY3
report.
Also, the 0.05-acre encroachment was overestimated in the monitoring report and was more to be
able to show such a small area on the map. During the adaptive management tasks in December
2021 the area was recalculated (via GPS points) to be 0.01 acres; the encroachment is mowing
about a foot into the easement and mowed herbaceous vegetation, but no trees. The marked
easement line/t-posts are 6-12 inches outside the conservation easement boundary.
4. WLS indicated they had contacted the landowner about the encroachments. Action
required: DWR needs written documentation confirming that WLS notified the landowner of the
encroachment in writing. Email or written letter will suffice for this comment.
Response: Letters were sent to landowners on August 10th, 2021 and are attached to this memo.
Please provide a response to the comments above, and include all required documentation
requested. Once DWR receives a response to comments, DWR can proceed issuing a credit release for
this task. Considering only 0.05 acres of the encroachment were in buffer or nutrient offset credit
generating areas, DWR will issue a partial (7.5%) credit release for this task with the remainder 2.5%
released upon documentation of completion of items in the adaptive management plan.
Response: WLS has provided their response to DWR's comments, and all required documentation is
attached. Since WLS has completed the adaptive management plan for MY2 and provided the
documentation, WLS requests the full credit release of 10% for the MY2 task.

During recent project monitoring of the Hollowell mitigation project on your property we noticed
several easement encroachments along multiple fields. These areas occurred where a mower/farm
equipment has removed and/or damaged easement signs on t-posts and damaged and/or removed
vegetation within the easement.
Please be aware of these activities and pass the information along to those farming the land to prevent
this from happening again in the future. We will remark the areas with taller t-posts and line to
demarcate the easement boundary more clearly. No vehicle travel or damage to vegetation is permitted
within the conservation easement.
Included are maps of the areas of encroachment. We also contacted Debra and George Grantham as
these issues also occurred on their property.

Adaptive Management Plan
Hollowell MY2 Encroachment Adaptive Management Plan
Three areas of landowner encroachment were identified in MY2 in the conservation easement area. One
area is located along the easement near Wetland 4 (W4) and is approximately 0.47 acres. The second
area is along the easement near UT2-RI and is approximately 0.19 acres. The third area is along the
easement by UT2-R3 and was estimated to be approximately 0.05 acres in the monitoring report. All
encroachments are a result of mowing vegetation along the easement boundary due to farming
activities.
All encroachment areas were marked with additional t-posts and signs on December 14th, 2021. The
easement was originally marked per the signage every 150 ft, and additional signs have been added.
String and flagging tape were also used to demarcate the boundary. The encroachments near Wetland 4
(0.47 ac) and UT2-RI (0.19 ac) were replanted on December 7t", 2021, with 150 bare root trees (see
table below). The 0.05-acre encroachment near UT2-R3 was not replanted, and was marked with
additional signs and string. This encroachment was overestimated in the monitoring report and during
adaptive management plan tasks in December 2021 was recalculated to be 0.01 acres. Please note that
all three encroachment areas were overestimated in the MY2 report. The 0.01-acre encroachment is
less than a foot into the easement and mowed herbaceous vegetation, but did not harm any planted
trees. The marked easement line/t-posts are 6-12 inches outside the conservation easement boundary.
These areas will be monitored closely in MY3 and additional adaptive management will be completed if
needed.
