Division of Water Resources’ Central and Regional staff has reviewed the application package
received January 14, 2022. However, additional information is required before the review may be
completed. Please address the items on the attached pages no later than the close of business on April 29,
2022.
Please be aware that you are responsible for meeting all requirements set forth in North Carolina
rules and regulations. Any oversights that occurred in the review of the subject application package are
still the Applicant’s responsibility. In addition, any omissions made in responding to the outstanding items
in Sections A through O, or failure to provide the additional information on or before the above requested
date may result in your application being returned as incomplete pursuant to 15A NCAC 02T .0107(e)(2).
Please reference the subject application number when providing the requested information. All
revised and/or additional documentation shall be signed, sealed and dated (where needed), with an

1. Within Section III – Flow Information, there are several items that need to be addressed as follows:
a. The provided hydraulic capacity determination was based on the treatment capacity. However,
the Town of Surf City’s WWTF is not limited by treatment capacity, it is limited by a disposal
capacity of 767,800 gallons per day (GPD) based on the available irrigation acreage at the
Sarge Martin and Juniper Swamp sites. This is reflected in the existing permit’s facility
description and Attachment A which indicate that the annual average flow for the facility is
767,800 GPD. Please recalculate the hydraulic capacity using the as-built disposal capacity.
b. The provided flow determination in Section III, Item 3 of 907,772 GPD does not appear to
match our NDMR records. Please provide additional information regarding the average flow
determination presented in Section III, Item 3.
2. Four structures are listed in Section VI – Open-Atmosphere Structures. Our records indicate that
there are six open-atmosphere structures located between the two sites (Sarge Martin and Juniper
Swamp). Additionally, it appears that coordinates for the first three list items are the same for all
three structures. Please provide information for all six of the open-atmosphere structures, include
updated coordinates for each feature, and provide a brief explanation of each structure’s function
or any associated naming conventions.
3. Within Section VII – Related Permits, a collection system permit (WQCS00278) is listed as a
receiving collection system. Our understanding is that this permit is for the upstream sewer
collection system for Town of Surf City. Please clarify the relationship between WQ0000795 and
WQCS000278.

I. Attachment F – Demonstration of Future Wastewater Treatment Capacities:
1. Our preliminary calculations using the last calendar year’s data indicate that the hydraulic capacity
is in excess of 80% (and possibly 90%). Pursuant to 15A NCAC 02T .0118, no permits for sewer
line extensions shall be issued to wastewater treatment systems owned or operated by
municipalities unless they meet the requirements outlined therein. Has an engineering evaluation
of the Town of Surf City’s future wastewater treatment, utilization, and disposal needs been
performed? Has a timeline for expansion been established? Please address the requirements of
15A NCAC 02T .0118 based on the revised hydraulic capacity from Comment C.1.
J. Attachment G – Easement, Encroachment and Lease Agreements:

1. It was indicated that the existing permit does not include any compliance schedules; however, our
records indicate that the modifications outlined in the permit dated October 3, 2018 have only been
partially completed and certified for the mechanical bar screen replacement. Has any additional
progress been made regarding the previously permitted modifications?
