WALTERS — DEPUTY PUBLIC WORKS DIRECTOR CITY OF LUMBERTON POST OFFICE BOX 1388 LUMBERTON, NORTH CAROLINA 28359 Subject: Application No. WQ0000672 Permit Application Return City of Lumberton Class B Residuals Program Land Application of Class B Residuals Robeson County Dear Mr. Walters: This letter is in reference to your permit major modification and renewal request received March 21, 2022. During the pre -review process, it was noted that the following items were missing from the submitted application package: 1. Pursuant to Application Instruction B on Form: RSC, submit a vicinity map for each residuals - source generating facility that shows the location of the facility and meets all of the criteria in the "Map Guidance for Residuals Land Application Permits". 2. Pursuant to Application Instruction B on Form: RSC, submit a detailed narrative and/or process flow diagram for each residuals -source generating facility that describes how the residuals are to be generated, treated, processed, and stored at the facility. Pursuant to Application Instruction B on Form: RSC, submit a quantitative justification for the value provided in Application Item I.8. Ensure that the amount of residuals listed is the maximum amount expected to be generated by the facility for the life of the permit. In addition, ensure that this amount is equivalent to that which is actually to be land applied, distributed, and/or disposed, including any chemicals, amendments, or other additives that are added to the residuals during processing. 4. Pursuant to Application Instruction B on Form: RSC, submit a detailed sampling plan for the residuals source -generating facility. Ensure that the plan identifies sampling points, sampling frequency, sample type, as well as the Division -certified laboratory to be used. In addition, ensure that the plan details how the facility and/or the residuals are monitored for any applicable pathogen reduction and vector attraction reduction requirements. Note that all sampling and monitoring must be completed on the residuals as they are to be land applied, distributed, and/or disposed. Pursuant to Application Instruction C on Form: RSC, submit the laboratory analytical reports and operational data - reports for all laboratory analyses used to complete this certification. 6. Pursuant to Application Instruction C on Form: RSC, submit documentation that each residuals -source generating facility complies and/or the residuals comply with any applicable pathogen reduction and vector attraction reduction requirements. 7. Pursuant to Condition IIL16. of Permit No. WQ0000672 issued April 27, 2017, the existing Land Owner Agreements expire March 31, 2022. Therefore, pursuant to Instruction B on Form: LASC, please submit new executed and notarized agreements for the following fields: ➢ Fields NC-RO-16-01 through -08, and -16 through -19. ➢ Fields NC-RO-17-01 through -04. Please note that these field names are listed both as new and renewed but with different acreages in the Land Application Site Certification table. ➢ Fields NC-RO-18-01 and -02. ➢ Fields NC-RO-20-03, -04, -06, -07, -08, and -14. ➢ Fields NC-RO-21-01 through -05. ➢ Fields NC-RO-28-01 through -03. ➢ Fields NC-RO-39-OIA through -09. 8. Please note that the submitted Land Owner Agreement for Field NC-RO-17 does not include NC-RO-17-02, and the agreement for Field NC-RO-42 does not include NC-RO-42-9. Please submit. 9. Pursuant to Instruction B on Form: LASC, submit an updated vicinity/setback map for every new and renewed residuals field. 10. Pursuant to Instruction B on Form: LASC and 15A NCAC 02T. 1104(c)(2), submit a soils repot for each new land application site. This report shall be prepared by a soil scientist, and include 11. Pursuant to Instruction B on Form: LASC and 15A NCAC 02T .1104(c)(3), submit a project evaluation and a land application site management plan, if applicable, with recommendations concerning cover crops and their ability to accept the proposed application rates of liquid, solids, minerals and other constituents of the residuals. 12. Pursuant to Instruction B on Form: LASC and 15A NCAC 02T .I 105(b), submit an updated accounting of each renewed land application site's cumulative pollutant loading rates (CLPRs). Accordingly, your permit major modification and renewal request is being returned as incomplete pursuant to 15A NCAC 02T .0107(b). The success of the Water Quality Permitting Section's Non -Discharge Branch process depends upon the receipt of complete and accurate applications and supporting documentation. Please amend the application package to include the previously noted omitted items and resubmit with the appropriate permit processing fee. Please be advised that construction and/or operation of the subject facilities without a valid permit is a violation of G.S. 143-215.1, and may subject you to appropriate enforcement actions pursuant to G.S. 143-215.6A.9 6B., and 6C. Civil penalties of up to $25,000 per day per violation may be assessed for failure to secure a valid permit. Mr. Corey J.
