The parcel had one single family residential structure however, that residence had been abandoned for 10+ years. The general land use int the area is low density residential and agricultural. k��' 4b. Explain the purpose of the proposed project: * The owner wants to clean up the area for aesthetics. He wants to install two culvert crossings to keep livestock out of the creek. Currently, the livestock access Little Flat Creek in various locations. 4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used: * The contractor removed trees, brush and debris along the creek bank. The contractor states that he did not disturb the creek bottom but he did "smooth" the creek banksto reduce existing erosion and provide bank stabilization. The consultant met on site with the contractor and field directed changes and additions to the existing erosion control measures noted at the time of the site visit. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: The contractor immediately seeded the disturbed ares and installed coconut fiber matting on the disturbed areas. Per the email from Mr. Andrew Moore, PQ (NCDEQ) [see email copied below], you have disturbed approximately 600 lineal feet of Little Flat Creek as well as a portion of an Unnamed Tributary (UT) to Little Flat Creek. After your conversation on site with Mr. Moore and his subsequent email, yo contacted our firm to assist with eh after the fact plan and permitting. We visited the site with you in mid December and observed the work completed and went over the aforementioned email. Our staff observed the removal of the erosion control matting that has plastic mesh and observed replace it that with a natural fiber EC matting as discussed with MR. Moore. Our staff measured the disturbance, documents the work in photographs and collected data from the surveyor associated with he project. From that information we have prepared an after the fact plan for the PCN notification. We have made subsequent visits to the site and have fount the stabilization to be effective with good ground cover in most areas being established. I understand for our conversation yesterday that the land -disturbance associated with the project is for the purpose of improving a pasture for cattle grazing as well as development of the property for the construction of a single family residence. During the course of the inspection, I observed approximately 300 feet of the streambanks of Little Flat Creek (Classified Q had been sloped back and stabilized with hydroseed and matting that contains plastic mesh. An additional 300 feet of Little Flat Creek were in the process of being graded and sloped at the time of the inspection. Two 20-foot sections of 36-inch corrugated metal pipe have been placed in Little Flat Creek MrAcimit DKoxm GRoup, PC 02aa3 P.O. Box 15 16 WEAVERVILLE, NC 28787 P. 828-645-7088 temporarily to provide construction access. An area adjacent to an unnamed tributary (UT) of Little Flat Creek (near the spring house), has been disturbed with no erosion and sediment control measures in place, nor any ground stabilization measures in place. The grading and sloping of the streambank is considered a streambank stabilization activity and is generally covered under the US Army Corps of Engineers (USACE) Nationwide Permit 13 (NWP 13). The Division of Water Resources issues 401 Water Quality Certifications for any federally permitted project involving waters of the US. I have attached to this email 401 Water Quality General Certification 4134 (GC 4134), which corresponds to NWP 13. The second page of the attached documents lists a number of thresholds or circumstances under which written approval for a 401 Water Quality Certification would be required. If your proposed activity will not meet any of the thresholds listed, then written approval is not required, provided all of the conditions of the Certification will be met. The project at the subject address meets threshold f) as it exceeds 500 feet, and therefore requires written approval from the Division. In addition, the project is not meeting Condition 11.7. of GC 4134 as the erosion control matting used along the streambanks contains plastic mesh. Based on the above noted observations, the project is non -compliant with the Division's rules. Thus far, you've indicated a willingness to bring the site into compliance. As such, the Division will refrain from issuing a Notice of Violation as long as the following actions are taken: - Submit a Pre -Construction Notification ([PCN] i.e. application) and associated review fee within 30 days, to the Division of Water Resources for the impacts associated with the bank grading and temporary culverts.
