I'd say Billy is sending out his annual letter for Mr. Rice, but the ball remains in Mr. Rice's court. Mr. Rice needs to find
an Engineer. Unless CO has received a complete AtC application then nothing has changed. The Permit states an AtC
has to be obtained, and Mr. Rice needs to find an Engineer that will complete the AtC for him.
There are components in the ground and being used that should handle the 50k, and Mr. Rice did get an Engineer to sign
off on those components back in 2015-16. I imagine getting an Engineer to submit for components in the ground and
designed by another Engineer presents a challenge for Mr. Rice.
The facility has not had compliance issues which is good news, I'd say. The facility is averaging < 20k, so Mr. Rice still has
some flow available until he gets to 32k or 80% of that. It has not had issues with Limits violations and the Process
Control Logs indicate it is being operated satisfactorily. The compliance issue in what Billy highlighted in yellow
"provided the facility is being operated in a manner such that is it compliant with its permit", is the Owner is not
operating the facility in a manner compliant with the permit because the permit clearly states at the beginning #2 that
an AtC is to be obtained to advance to 50k flows and it appears it has not.
I'd say we have all come along way with this facility, the operations and ownership appear to be keeping a tough to
manage waste stream in check. What would another 20-30k look like in this system? He needs to get an Engineer to
help him explain this on paper, hence the AtC.

Good morning Mr. Rice,
The Division has reviewed the request for flow expansion from the Northview Mobile Home Park WWTP as permitted in
Section A. (2) of NPDES permit NC0067342. Per the current NPDES permit, effective April 1, 2018, in order to expand
from a permitted flow of 0.032 MGD to 0.050 MGD, the permittee was required to obtain an Authorization to Construct
(ATC) for 0.050 MGD and the Division had to perform an instream assessment of the receiving stream. The Division
completed an instream assessment in September 2018; however, Eaven Brice Partnership has not obtained an AtC for
an expansion to 0.050 MGD.
Based on information available to the Division, all requirements to allow expansion have not been met. Therefore, the
Division is unable to grant Eaven Brice Partnership permission to expand their discharge up to 0.050 MGD from the
Northview Mobile Home Park WWTP at this time. The attached ATC Application Form along with any supplementary
materials (plans, specifications and calculations, etc.) must be completed and submitted to request plant expansion. The
permittee can also refer to this website for more information regarding the ATC permit:
https://deq.nc.gov/about/divisions/water-resources/water-resources-permits/wastewater-branch/npdes-
wastewater/authorization-to-construct.
Once the Division receives a formal ATC application, a staff engineer will review the request. If an AtC is granted, and all
requirements and certifications are completed, Eaven Brice Partnership may submit another request to expand flow at

Hi Landon,
I hope you are doing well in these trying times. It has been a couple years since I've reached out but am
interested in getting access to current testing and capacity water and sewage information with regard to North
View Trailer Park in Weaverville.
I know that houses and trailers have been added since we were engaged in the water quality and sewage issues
from the owner of the park. I was recently looking on the county website GIS (aerial views) and it appears that
about 65 street addresses have been assigned to the hillside that is on the Martin Ford Road side (across from 60
Martin Ford). I've attached a screenshot showing them (blue dots with address in the wooded area).
Additionally there are approximately 30 new hopes (red outlines in attached), most of which have yet to built.
So the plan appears to be to have almost 100 new residences tightly packed and using North View's water and
sewage systems.
Is North View currently meeting legal requirements? Have they asked for expansion and have they received
approvals (if sowould like details please).
The reason I was on the county's GIS site is to collect information for an appeal on incredibly high tax
assessments for our properties on Martin Ford Road. It would seem like a trailer park across from our property

would dramatically and negatively impact our property values. Also, our parents fought legally with the Park
for years because when the started to clear the area on Martin Ford road, the runoff flooded our hay fields; the
runoff with just the woods there now still causes flooding in the spring. The trash, noise and crime continue to
be an issue from the existing Park and adding another 100 home sites won't improve that either. I realize all of
this is not in your area of responsibility but would appreciate feedback on where the Park stands with your
departments testing and how new home sites would be managed asap please. I would also like to know who
does the testing for them now; are they being trusted to do their own testing when it was proven that they
misreported data in the past?

Apologies for the delay in responding. You are welcome to send out this email to your group but I did not want
to `reply all' from your email due to the number of recipients. Your primary question seems to center around
how we implement the tap moratorium. For the planned new development, we work with the local building
inspection department to limit subdivision platting, etc. which is currently on hold. We were also working with
them (building inspections) even before the moratorium to keep them posted on the compliance state of the
treatment facility. Implementing that portion of the moratorium that restricts new renters is more of a challenge
as you point out. There is no baseline census nor a required reporting of unit occupancy. Our agency must
utilize other methods to try and ensure Mr. Rice complies with this portion of the moratorium. To do this, we
will periodically check the mobile home community for what appears to be vacant units and look for changes in
those units' status. We were at the facility June 1st and today observing. We are also exploring other means to
monitor as there are in inherent challenges. I reiterated to Mr. Rice in -person at the site June 1st that he cannot
rent units that become vacant while the moratorium is in place. The moratorium will remain in place until we
feel the facility is compliant and able to treat incoming flow. Based on our June 1st inspection, there have been
many improvements at the plant and the new treatment units are operational. There is also a new operator that
we believe is working to make the plant compliant. They are also collecting samples in accordance with the new
permit which required additional sampling. We noted several changes we need to see in plant operation,
sampling point, etc. during our June 1st review.
Also of note, we collected a grab sample Friday on an unannounced visit and the preliminary results indicate 11
CFU/100m1 for fecal coliform, well below their daily max limit of 400CFU/100 ml. We also collected a sample
yesterday which results are currently pending.

Also, the folks are wondering how long something like this would take to resolve? In thinking about this
further we wonder if there was a census or baseline prior to the moratorium? In order to be certain about
whether the "mobile home park community" has increased or not it would require knowing what the community
size was beforehand (or now, if no prior count was known). How do you confirm the community isn't
increasing? Are changes in incoming and outgoing residents monitored? Is Mr. Rice giving some regular
reporting on changes within the park? Based on prior behavior Mr. Rice cannot be trusted to provide accurate
information without independent third -party verification.

The Feb. 22nd letter does also state, "Additionally, should a currently occupied unit be vacated, that unit cannot
be reoccupied until the moratorium is lifted." Apologies, it appears there may be an issue with this unit and

In reading the moratorium letter, it does state that "furthermore this is to be interpreted to mean that the current
occupancy of the mobile home park community cannot be increased." It would seem like a validation of number
of occupants would be required before determining whether this is acceptable or not.
