Subject: REQUEST FOR ADDITIONAL INFORMATION
Westpoint Residential Development
Dear Mr. Holtvedt:
On September 16, 2021, the Division of Water Resources (Division) received your application requesting
a 401 Individual Water Quality Certification and Buffer Authorization from the Division for the subject
project with fee paid on September 17, 2021. The project was placed on public notice on September 27,
2021 and the comment period for the notice ended October 28, 2021. A public hearing was held on
January 20, 2022 to received comment and additional information on the proposed project, and the
public notice comment period closed on February 21, 2022. After review of all the comment received
during the hearing and public comment period, the Division has additional questions and has
determined that your application is incomplete and cannot be processed until they are resolved. The
application is on -hold until all of the following information is received:
1. The Division requested a copy of the Stormwater Management Plan (SMP) for this project in a
previous request for additional information dated November 16, 2021. The provided plans,
received December 16, 2021, included calculations for wetlands sizing but no design details
were provided. The following additional information is needed to clarify and complete the plan
[15A NCAC 02H .0502(c); 15A NCAC 02H .0506(b)(1)]:
a. The drainage, peak flow, and water quality analysis maps submitted with the
stormwater analysis are illegible. Please submit new maps (as a separate file) that
clearly shows:
i. Identification and boundary for each of the drainage basins (different color line
for each basin is recommended);

ii. Identification and location of each analysis point and outfall;
iii. Identification and location of each proposed stormwater wetland including their
inlet and outlet locations;
iv. Essential collection system routing stormwater in the drainage area to each
SCM;
v. Relevant stream(s) and water features;
vi. Any vegetative conveyances and energy dissipaters (if provided);
vii. Easement and maintenance access to each of the stormwater wetlands. A
minimum 10-foot wide access around the SCM is required.
b. Provide a copy of the O&M Plan for the stormwater wetlands including estimated
annual maintenance cost (ex. trash/debris removal, inspection, plants trimming and
maintenance, etc.).
2. The Division has received comments indicating that site development work, such as clear cutting
and vegetation removal on site may have been initiated. Please indicate if any impact to
regulated riparian buffers has occurred. [15A NCAC 02B .0714(3)]
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested
information for the proper consideration of the application. Please respond in writing within 30
calendar days of receipt of this letter by sending one (1) copy of all of the above requested information
to the 401 & Buffer Permitting Branch, 1617 Mail Service Center, Raleigh, NC 27699-1617 OR by
submitting all of the above requested information through this
link: https://edocs.deg.nc.gov/Forms/Supplemental-Information-Form (note the DWR# requested on
the link is referenced above).
If all of the requested information is not received within 30 calendar days of receipt of this letter, the
Division will be unable to approve the application and it will be denied as incomplete. The denial of this
project will necessitate reapplication to the Division for approval, including a complete application
package and the appropriate fee.
Please be aware that you have no authorization under the Section 401 of the Clean Water Act or the
Neuse River Buffer Protection Rules for this activity and any work done within waters of the state of the
regulated riparian buffers may be a violation of North Carolina General Statutes and Administrative
Code.
