On June 14, 2011, the Wilmington Regional Office received a request for the transfer of
ownership of the Stormwater Management Permit for the subject project. Staff of the Division of
Water Quality have inspected the project, determined that the documentation is in order, and
the project is in compliance with the Stormwater permit requirements. As indicated on the
Name/Ownership Change form, you have acknowledged receipt of a copy of the permit, which
includes the application and supplement forms, a copy of the approved plans and a copy of the
required Operation and Maintenance agreement from the previous permittee. By acknowledging
receipt of the permit, and by signing the Name/Ownership Transfer form, you have accepted the
responsibility for complying with the terms and conditions outlined in this permit. If you need
additional copies of the permit, or copies of the approved plans, please contact the Division of
Water Quality in the Wilmington Regional Office at the phone number below. Please replace the
old second page of the permit with the enclosed updated page.
Please be aware that the project's built -upon area and stormwater controls must be built and
maintained in compliance with the permit documents and the approved plans. Maintenance
of the approved system shall be performed in accordance with the Operation and
Maintenance agreement. Any modifications to this project must be submitted to the Division
of Water Quality and approved prior to construction. The issuance of this approval does not
preclude you from complying with all other applicable statutes, rules, regulations or
ordinances, which may have jurisdiction over the proposed activity, and obtaining a permit
or approval prior to construction.

attached and on file with and approved by the Division of Water Quality and considered a part of
this permit.
This permit shall be effective from the date of issuance until September 14, 2012 and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater described
in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as
described on page 3 of this permit, the Project Data Sheet. The subdivision is permitted for
150 lots, each limited to a maximum built -upon area as follows: Lots 1-19 @5,775 ftZ; Lots
20-40 @4,900 ftZ; Lots 41-65, 89-100, 116-120, and 137-141 @3,200 ftZ; and Lots 66-88,
101-115, 121-136, and 142-150 @3,500 ft2

3. Approved plans and specifications for this project are incorporated by reference and are
enforceable parts of the permit.

STORMWATER OPERATION AND MAINTENANCE PLAN
FOR
GREENBRIAR SOUTH I JUN -14 2,011
WILMINGTON, NORTH CAROLINA
1. The owner will be responsible for the proper operation and maintenance of the
stormwater collection and treatment facilities.
2. The collection system will be inspected monthly by the owner to identify
malfunctioning catch basins and drainage pipes. The collection system will be kept
relatively clear of debris and sediment. The stormwater system shall be kept in good
working order. Any malfunctioning component shall be repaired/replaced per approved
plans as necessary to assure proper operation of the system.
3. The treatment facilities consist of two (2) stormwater ponds with outlet control.
These facilities will be inspected twice a year by the owner to determine the mean depth of
the ponds and identify any malfunctions. The mean depth of Pond No. I (existing pond)
under normal conditions, shall be 7.5 feet. The owner will remove the sediment from the
pond -if ,the mean depth is determined to be less than 5.2 feet and will correct malfunctions
when necessary. The mean depth of Pond No.2 (new pond) under normal conditions
shall be 4.0 feet. The owner will remove the sediment from the pond if the mean depth is
determined to be less than 3.0 feet and will correct malfunctions when necessary.
4. The outlet structure, orifice, and sidesteps will be inspected immediately after every
runoff producing rainfall event. Any debris observed on the orifice and outlet structures
will be removed. Eroded areas will be repaired and reseeded immediately after a rainfall
event.
5. A permanent stand of grass shall be maintained at all times. Mowing during the
growing season will be done as needed, otherwise, the grass height will not exceed 6".
6. The grass swells shall be inspected twice a year by the owner to determine if sediment
has accumulated in the swale and to determine if any erosion has occurred. Mowing will
be accomplished as needed according to the season. Grass height will not exceed 6" at
any time. Swales will be inspected monthly or after every ninoff rainfall event for
sediment build-up, erosion and trash accumulation. Accumulated sediment and trash will
be removed as necessary. Swales will be reseeded or sodded following sediment removal.
Eroded areas of the swales will be repaired and reseeded. Swales will be revegetated as
needed based on the monthly inspections. Catch basins, curb cuts, velocity reduction

devices, and piping will be inspected monthly or after every runoff producing rainfall
event. Trash and debris will be cleared away from grates, velocity reduction devices, and
piping.

We evidently sent a renewal request to Maurice Emmart of Greenbriar South Partnership, but he says that he has
transferred this to the HOA. He said that he had talked to the current HOA person, Mike Nevin (4808 Coronado Drive,
Wilmington, 28409) recently and that the HOA knew about and was expecting to receive the transfer form in the mail. It
sounds like he really did transfer it and it just didn't get logged in. Anyway, it sounds like that letter needs to be resent
to Mr. Nevin.
Mr. Emmart's number is 791.2204 if you need to call him. (I think David does the transfers and Janet does the renewal
letters, so I thought I would send it to both of you so that you can figure out what to do with this.) Also, fyi, there are
evidently three HOAs under this permit. But, Mr. Emmart said that Mr. Nevin was the main contact.

Dear Mr. Emmart:,
On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any
development approval issued by the Division of Water Quality under Article 21 of
Chapter 143 of the General Statutes, which is current and valid at any point between
January 1, 2008, and December 31, 2010. The law extends the effective period of any
stormwater permit that is set to expire during this time frame to three (3) years from its
current expiration date. On August 2, 2010, the Governor signed Session Law 2010-
177 which grants an extra year for a total of four (4) years extension.
Accordingly, Stormwater Permit # SW8 931105 which has already expired on
September 14, 2008, is now in effect until September 14, 2012. Please resubmit the
renewal application and fee at least 180 days prior to September 14, 2012, which would
be March 14, 2012. A copy of the Renewal Application can be obtained from the

The following information is in reference to your letter dated June 21, 2000. After starting
construction on the rest of Greenbriar South, the developers decided to separate the
development of the neighborhood into three different named sections; Greenbriar South,
Masonboro Woods and Madison Place. The lots sizes and type of houses for each of the
named sections will be different, thus for the need for different section names. Lot numbers
have also been changed from what was originally submitted. However, the allowable
impervious per lot was not changed. I have attached two pages that have the old lot
numbers, new lot numbers and allowable imperviousness in square feet. I am also providing
you with a copy of everything that has been recorded since WK Dickson started work on
Greenbriar South as well as an overall sheet showing the new lots numbers and each of the
three different named sections within Greenbriar South.

Dear Mr. Emmert: New Hanover County
On June 15, 2001, the Wilmington Regional Office received a copy of the proposed restrictions for
Greenbriar South, Masonboro Woods and Madison Place at Masonboro Woods. As indicated in my letter of
May 16, 2001, neither of the latter two subdivisions is on our database under those names. Please provide the
project numbers or -original subdivision names for those projects. If there has been a project name change,
please complete the attached form and return it to the Division at the address at the bottom of this letter.
Additionally, the permit for Greenbriar South had assigned a specific built -upon area per lot by lot
number, not .section. Please specify the lot numbers in the deed restrictions, as shown on the approved plans, or
provide a copy of the recorded section maps showing the lots that are contained within each section.
Please submit the requested information by July 21, 2001. If you have any questions, please do not
