THIS DEED, Made this the 28th day of June, 2021, by DAVID K. SMITH, by and
through his attorney -in -fact Linda L. Smith, and wife, LINDA L. SMITH, parties of the first
part, GRANTORS; and TANYA CAMPBELL, of 460 Garden Lane, Franklin, NC 28734, party
of the second part, GRANTEE, ; whether one or more; the neuter gender shall be deemed to include
the masculine and feminine and the singular number the plural, and vice versa;
WITNESSETH, That the said parties of the first part in consideration of Ten Dollars and
other valuable consideration, the receipt of which is hereby acknowledged, have bargained and sold
and by these presents do bargain, sell and convey unto said party of the second part, and her heirs
and assigns, a certain tract or parcel of land in Cowee Township, Macon County, State of North
Carolina, being more particularly described as follows:
BEING all of the same lands, easements, privileges and appurtenances as described
in and conveyed by the deed from John D. Kellberg and wife, Anne B. Kellberg to
David K. Smith and wife, Linda L. Smith, dated February 25, 2000, recorded in the
Office of the Register of Deeds for Macon County, North Carolina, in Book V-23,
Pages 906-911, and being further described in accordance with a more recent survey
as follows:
BEING all of Lot # 1, consisting of 2.49 acres, all of Lot # 2, consisting of 4.61
acres, and all of Lot # 3, consisting of 4.51 acres, as surveyed by Renee K.
Cooney, Professional Land Surveyor and as shown on her plat thereof ( Drawing
1057-21) dated June 10, 2021 as recorded in the Office of the Register of Deeds for
Macon County, North Carolina at Plat Book 5, Card # 115 r1'r1 , to which
plat as so recorded reference is hereby made for a more complete and accurate
description of the lands hereby conveyed.

Parties of the first part further convey unto party of the second part, here heirs and
asigns, the right to use in common with parties of the first part, their heirs and
assigns, and all others who now have or hereafter acquire he right to use the same,
the road and utility right of way easements, 30 feet and 50 feet, leading from State
Road 1341 to the southwest corner of the lands hereby conveyed, and thence along
a portion of the west boundary of the same, the location of said road and utility right
of ways being more particularly described by courses and distances in "Tract Two'
of the lands described in the deed recorded in Book U-28, Pages 906-911 referred
to above, the description of said road and utility right of ways being incorporated
herein by reference as if set forth herein verbatim. Parties of the first part
specifically reserve for themselves, their heirs and assigns, the right to use said 30-
foot wide easement and 50 -foot wide road and utility right of way easements in
common with party of the second part, her heirs and assigns, and particularly any
portion thereof falling within the boundary of the lands hereby conveyed.
This conveyance is made subject to that provision set forth in the deed recorded in
Deed Book V-23, Pages 906-911 as follows:
"As a material part of the consideration for this conveyance, parties of the second
part shall pay their proportionate part of the cost of maintenance, upkeep, repair and
improvements of the 30-foot wide road and utility right of way hereinabove
described, in common with all other parties who may now or hereafter utilize the
same, said costs to be divided among the parries having the right to use said right
of way based upon the actual usage thereof."
This conveyance is made subject to existing easements for roadways and utility
lines and facilities..
All or a portion of the lands herein conveyed does not include the primary residence of a Grantor
TO HAVE AND TO HOLD the aforesaid tract or parcel of land and all privileges and
appurtenances thereunto belonging, or in anywise thereupon appertaining, unto the said party of
the second part, and her heirs, successors and assigns, to their only use and behoof, in fee simple
forever, subject to those exceptions, reservations and limitations following the description
hereinabove set forth.
And the said parties of the first part covenant with said party of the second part, her heirs,
successors and assigns, that they are seized of said premises in fee, and have the right to convey the
same in fee simple; that the same are free and clear from all liens and encumbrances and that they
will warrant and defend the said title to the same against the lawful claims of all persons
whatsoever, subject to those exceptions, reservations and limitations following the description
hereinabove set forth.
