Wieland's toxicity self-monitoring reports revealed that the average chronic value for the fourth quarter of 2021 to be 39.75%which is lower than the chronic limit for the facility(90%).The facility has failed monthly toxicity testing since April 2021. In this letter I am requesting a remission of the civil penalty because the violation was unintentional and inadvertent. In addition to incurring significant costs to abate the toxicity failure in our effluent and return to compliance,Wieland has spent considerable time and taken numerous actions to determine the root cause(s)of the failure. While our actions have shown improvements to the discharge effluent,Wieland is still not meeting the minimum 90%requirement.Wieland has also ensured NCDEQ was kept well informed of the progress and has acted in good faith in our environmental protection efforts both historically and during our mission to return to full compliance. Summary of actions taken: 1. May 3, 2021,Wieland was notified by Pace Analytical that Outfall 003 failed Whole Effluent Toxicity Testing for Q2 taken in the month of April.An investigation was started to determine the root cause and to prevent the toxicity failure in the future.The Incident Investigation Report shows the complete history of the major corrective/preventative actions taken to date (See Attached). Note*The failure coincided with the sale and transition of R&A Laboratory to Pace Analytical (who utilizes Meritech for lab testing) and the removal of our outdated Water Tube product line and associated machinery.The effects to the quality of the effluent are undetermined, but testing/sampiing hasn't revealed any major changes.To our knowledge the new lab is testing as required, but I feel these major changes are worthy of note. 2. Wieland has contracted Pace Analytical to perform toxicity, heavy metals,PPA, and tank study sampling on the various cooling water systems,holding tanks,influent,and effluent streams of the processes in an attempt to determine the source of the toxicity.Total cost to date of$17,737.50. No red flags were discovered through testing that would indicate a toxicity failure and the sampling results were similar to historical sampling results. 3. Wieland has contracted environmental remediation companies to empty and clean the cooling water tanks and pits at a cost of$45,706.45. 4. Wieland has started adding bentonite clay and activated carbon to the process to absorb any toxins and aid in flocculation.Cost$4,090.00. 5. Wieland is currently in the process constructing and installing an additional waste water treatment plant which utilizes an ion exchange resin to remove copper at a cost of $529,751.27.We are hoping that this system will eliminate the toxicity issue.(See Attached). 6. Closed all blow downs from machinery influents and instead pump to totes.Then send out totes via tanker trucks to segregate the cooling water only in our WWTP and sample(no changes,still failed toxicity). 7. Wieland has consulted with leading water treatment engineers in our area for help in determining the source of the toxicity,and so far all are at a loss as to the cause.Wieland has recently reached out to a Ph.D.Aquatic Toxicity Engineer with ERM Environmental to further assist in analyzing the toxicity issue. Wieland will continue to utilize all available resources to determine the source of the toxicity in Outfall 003 so the proper corrective actions can be implemented.Wieland hopes NCDEQ is satisfied with our actions taken and will approve our request for remission. FINDINGS(ROOT CAUSE): a To prevent the overflow and volume in the catch pits,which then require an operator or maintenance to pump out,a redesign is needed to the levels and shower drain. The cooling water and waste sludge need to be separated and processed separately. To limit labor, investigate how much the catch pits fill once the shower has been separated and then set a contract with a waste disposal company to perform regular pump outs. Level alarms will indicate if an abnormal condition occurs so WCP personnel can respond in a timely fashion. The analysis showed that the water did not contain any solvents,metals were low,and the salts were not high enough to cause a toxicity issue. (See Documentation) On 9/22/21,Pace Analytical Laboratories performed Toxicity Analysis on 10/19/2021 10/19/2021 the following cooling water systems:Direct Cast 1-4,Annealing Furnaces 1&3,Bunch Coilers 1&2 Quenchwater,IH Shower Water.The results showed that the Bunch Coilers and IH Water failed immediately.The other systems failed slightly due the systems possibly being cycled up. The corrective action that was implemented as follows:Eliminated the Bunch Coiler and IH blowdowns and adjusted the Conductivity from 800 u/S to 600 u/S all other cooling systems. SE Laboratories has performed testing on the Promoss and sent the 10/27/2021 10/27/2021 samples to Pace Laboratories for Toxicity Analysis.We are waiting on the results in order to try to determine if corrective action is needed. The results of the testing will determine our next course of action. 10/27/2023 11/9/2021 The results of the testing will determine our next course of action. 10/27/2022 1/7/2022 Ken Ridings of SE Laboratories conducted a second round of toxicity 11/22/2021 11/22/2021 testing on the Promoss because ProMoss failed toxicity on the first round of testing.Ken seems to think that the failure was due to his lab technician used a zinc coated paper clip and a dirty magnetic stirring stone.The ProMoss passed the second round of toxicity testing at 100%. The EHS Department of WCP has contracted Meritech Laboratories to conduct toxicity testing on the ProMoss to confirm the results of SE Laboratories testing. SE Laboratories is contracted to provide WCP with cooling water 12/17/2021 12/9/2021 treatment utilizing Promoss instead of chemical treatment.On 10/27/21, SE laboratories was notified by Meritech Laboratories that their first round of toxicity testing failed.Ken Ridings of SE Laboratories thinks that a zinc coated paperclip and a dirty magnetic stirring stone may be the reason.On 11/17/21,SE Laboratories was notified by Meritech Laboratories that their second round of testing passed at 100%.WCP has sent a sample of the Promoss to Meritech Laboratories to do toxicity testing in order to confirm whether or not the ProMoss is the cause of the toxicity failures.Ken Ridings tested 0.1 of a gram of Promoss.I have asked Meritech to follow Kens procedures but to conduct two tests using 0.1 of a gram and 1 gram and to make sure that the Promoss is in full contact with the water.
